Discretion is advised.]On February 08, 2025at approximately 1605 hours Deputy Center was dispatched to [3300 BLOCK] Mount Pleasant Rd NE in reference to a single motor vehicle collision. While enroute, the Whitfield County Dispatch advised Deputy Center that there were multiple calls on this incident where callers were stating that the driver of this collision smelt like alcohol, appeared intoxicated, and left the scene of the collision as he walked north on Mount Pleasant Rd NE. As Deputy Center arrived, the Whitfield County Dispatch advised Deputy Center that the driver had returned to the scene.Upon arrival, Deputy Center made with [WITNESS ]. Mr. [WITNESS ] identified himself as Mr. Willard Dunn’s stepfather. Mr. [WITNESS ] stated that Mr. Dunn was driving the vehicle, a 2018 Volkswagen Passat bearing Georgia registration [REDACTED]. Deputy Center asked Mr. Dunn if he was okay, which Mr. Dunn replied “I am fine, yes sir I am fine”. As Mr. Dunn spoke, Deputy Center noticed he had a thick, slurred speech. Deputy Center noticed Mr. Dunn had a laceration on his forehead, which he asked to look at. Mr. Dunn agreed to let Deputy Center look at his forehead. As Deputy Center was close to Mr. Dunn’s head, he could smell the distinct smell of alcohol emitting from Mr. Dunn’s person.Mr. Dunn began telling Deputy Center what had happened that caused the collision. Mr. Dunn explained that as he entered the curve near box number [REDACTED], a deer had entered the roadway. Mr. Dunn stated he swerved to miss the deer and collided into the ditch. Deputy Center asked Mr. Dunn if he needed an ambulance which Mr. Dunn replied “No, I don’t need an ambulance, I am fine, I am completely fine”. After Mr. Dunn stated that his car was “trashed” Deputy Center asked Mr. Dunn if he felt okay, which Mr. Dunn stated “oh, I am fine” then commented about his cut on his head, but continued to say the he was fine. Deputy Center asked Mr. Dunn for his license, which he was able to provide after getting his wallet out of the car via the opened sunroof. As Mr. Dunn was retrieving his license from his wallet Deputy Center noticed Mr. Dunn to have a sway and a hard time balancing. Deputy Center asked Mr. Dunn if he could look at his eyes, which Mr. Dunn agreed.Mr. Dunn stated the only recent head injury that he had was from the wreck. Mr. Dunn stated he had no known medical issues or diagnosis in regards to his eyes or his head. Mr. Dunn stated that he was not wearing s, and he did not have any glasses on. Deputy Center instructed Mr. Dunn into the standing position for the Horizontal Gaze Nystagmus task and explained the directions which he stated he understood. Deputy Center did not observe any resting nystagmus, and Mr. Dunn’s pupils were equal in size. Deputy Center observed Mr. Dunn’s eyes to track equally as well. As Deputy Center began observing a lack of smooth pursuit in Mr. Dunn’s eyes, Mr. Dunn began moving his head instead of his eyes only. Deputy Center had Mr. Dunn attempt to hold his head still with his hands. Deputy Center observed in both eyes; a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and nystagmus prior to 45 degrees. As Deputy Center was observing nystagmus prior to 45 degrees Mr. Dunn appeared to become agitated by stating “obviously I can follow your pen”. After this statement, Deputy Center did not observe vertical nystagmus in either eye when checking. Deputy Center observed 6 out of 6 validated clues.Deputy Center then asked Mr. Dunn if he would preform a Walk and Turn task, which he agreed as he took his shoes off. As Deputy Center was instructing Mr. Dunn into the starting position, Mr. Dunn began the task without being instructed to do so, twice. As Deputy Center was instructing Mr. Dunn into the starting position again, Mr. Dunn could not keep his balance as he swayed and had to step to the side to catch his balance. Mr. Dunn was reinstructed again into the starting position and was told to stay in this position until told to do otherwise, which he stated he understood. As Deputy Center was demonstrating the Walk and Turn task, Mr. Dunn stepped out of the starting position again as Deputy Center was demonstrating the proper turn. Deputy Center finished the demonstration and instruction for the Walk and Turn task which Mr. Dunn stated he understood. On Mr. Dunn’s first set of nine steps, he missed heel-to-toe on steps 1, 2, 3, 4, 7, 8, and 9; stepped offline on steps 1, 2, 3, and 9; raised him arms more than 6-inches from his side for balance on all steps, and preformed a half step before making an improper turn by making a swift turn in one big step rather than taking a series of small steps as Deputy Center demonstrated. On Mr. Dunn’s second set of steps, he missed heel-to-toe on steps 1, 2, 4, and 5; stepped offline on step 1; raised his arms more than 6-iches from his side for balance on all steps, and took 8 steps when instructed to take 9 as he counted “9” when he turned around from the 8th step. Deputy Center observed 7 out of 8 validated clues.Deputy Center instructed Mr. Dunn into the standing position for the One Leg Stand task. As deputy Center was attempting to ask Mr. Dunn if he understood the instructions thus far, Mr. Dunn interrupted Deputy Center by stating “you know you can’t do this sober right?”. Deputy Center asked what, which he repeated that again. Deputy Center explained that he is doing it all too, and that he is doing it in 20 pounds of gear, which Mr. Dunn stated “you know this is a trick, you cannot do this sober”. At this time, Deputy Center instructed Mr. Dunn into the starting position and advised him to stay in this position until told to do otherwise, which he stated he understood. Deputy Center then demonstrated the One Leg Stand task for Mr. Dunn, which Mr. Dunn stated he understood. Mr. Dunn first stood on his left foot and raised his right foot. While doing this Mr. Dunn maintained a noticeable sway, raised his arms more than 6-inches from his side for balance, and put his foot down on counts 1008, 1009, and 1010. Mr. Dunn then asked if he could switch legs, which Deputy Center agreed that he could. While Mr. Dunn stood on his right foot and raised his left foot, he maintained a noticeable sway, raised his arms more than 6-inches from his side for balance, and put his foot down on counts 1011, and 1014. Deputy Center stopped the task at this time for safety reasonings concerning Mr. Dunn in regards to him loosing his balance. Mr. Dunn attempted the task for approximately 23 seconds and reached count 1014. Deputy Center observed 3 out of 4 validated clues.Deputy Center asked Mr. Dunn if he could look at his eyes again, which Mr. Dunn stated he could. Deputy Center explained the instructions for the Lack of Convergence task, which Mr. Dunn stated he understood. Mr. Dunn had a lack of convergence in both of his eyes as they both remained at center instead of converging as Deputy Center moved the stimulus toward the bridge of Mr. Dunn’s nose.Deputy Center asked Mr. Dunn if he would participate in one more task which Mr. Dunn agreed. Deputy Center explained and demonstrated the instructions for the Modified Romberg Balance task which he stated he understood. As Mr. Dunn closed his eyes and leaned his head backward he immediately had a noticeable circular sway. Mr. Dunn began counting out loud which Deputy Center stopped the tasked and clarified with Mr. Dunn that he needed to count silently, in his head. Mr. Dunn stated he understood. Deputy Center observed Mr. Dunn to have a circular sway again and body tremors. Mr. Dunn blurted “20” after doing the task for approximately 18-seconds, then blurted “30” approximately 4-seocnds after blurting “20”. Deputy Center asked Mr. Dunn if he felt as if that was 30 seconds, which he stated yes, and that he had counted numerically in his head. Mr. Dunn’s time estimation of 30-seconds was approximately 22 seconds.At this time, Deputy Center placed Mr. Dunn under arrest with handcuffs, checked for proper fit and double lock. Deputy Center advised Mr. Dunn that he was being arrested for driving under the influence. Deputy Center confirmed that Mr. Dunn was over the age of 21, then read Mr. Dunn the Georgia Implied Consent Notice for Suspect Age 21 and Over for the state administered chemical test of his breath and blood, which Mr. Dunn denied. Mr. Dunn was escorted to the rear seat of Deputy Center’s patrol car.Deputy Center preformed a of the Volkswagen which 6-unopened cans of cold beer were located in the front passenger foot well. No open containers were located or other intoxicating substances were located. Deputy Center did observe that both seatbelts were locked into place in their retracted position, signifying that Mr. Dunn could not have been buckled up during the collision, as well as blood on the passenger side door, while Mr. Dunn was only a single occupant of the Volkswagen.Deputy Center spoke with Mr. [WITNESS ] again. Mr. [WITNESS ] stated that this has happened before. Mr. [WITNESS ] stated that Mr. Dunn did leave the scene and came to ask Mr. [WITNESS ] to pull him out of the ditch instead of reporting the incident that caused damage to other property. Deputy Center then traced the Volkswagen’s roadway markings which showed that the Volkswagen was traveling north on Mount Pleasant Rd NE. As the Volkswagen approached a curve just south of box number [REDACTED], it left the east side of the road instead of following the curvature of the road. This resulted in the Volkswagen driving along the ditch and across the driveway of [3300 BLOCK] Mount Pleasant Rd NE striking the mailbox, where it re-entered a ditch and struck a tree that caused the Volkswagen to make an abrupt change of direction from the farrows left in the loose ground. As the Volkswagen re-entered the roadway traveling north-west between box numbers [REDACTED] and [REDACTED] the Volkswagen left gouges in the roadway from the wheel and/or frame of the car making with the blacktop. The Volkswagen then traveled across Mount Pleasant Rd NE where it left the road on the west side of the roadway, striking another ditch, and came to a final uncontrolled rest in front of the residence of [3300 BLOCK] Mount Pleasant Rd NE.Frank’s Wrecker Service was called to the scene from the county’s list to retrieve the Volkswagen. Mr. Dunn’s mother, Ms. [REDACTED], spoke with Mr. Dunn as he was in the rear seat of Deputy Center’s patrol vehicle. Ms. [REDACTED] stated that Mr. Dunn was intoxicated and that from her experience, Mr. Dunn’s behavior was as such when he is intoxicated.Deputy Center transported Mr. Dunn to the Whitfield County Jail. On the drive there, Mr. Dunn appeared to have fallen asleep as Deputy Center had to call his name and knock on the partition to wake up in order to check welfare on his several different times. Once at the Whitfield County Jail Mr. Dunn was turned over to booking staff where he was patted down, ed, and placed into a holding cell in booking staff’s custody. Here, Mr. Dunn provided a voluntary breath sample into a Preliminary Breath Test machine for booking staff which read his BrAC as 0.185.Deputy Center charged Mr. Dunn with O.C.G.A. 40-6-391(a)(1) DUI Less Safe on citation 18498, O.C.G.A. 40-6-48 Failure Maintain Lane on citation 18499, O.C.G.A. 40-6-180 Too Fast for Conditions on citation 18500, O.C.G.A. 40-6-272 Striking Fixed Object on citation 18551, O.C.G.A. 40-6-270 Leaving the scene of an Accident on citation 18552, and O.C.G.A. 40-8-76.1 No Seatbelt on citation 18553. As Deputy Center was attempting to explain the DDS-1205 Administrative License Suspension Form due to him refusing the Georgia Implied Consent Notice for Suspect Age 21 and Over for the state administered chemical test of his breath and blood, Mr. Dunn stated he could not sign due to his right side hurting him, and him being short of breath. Deputy Center immediately let Booking Sgt. Martin know of this, which he correlated this information to the Whitfield County Medical staff which they made the decision to send Mr. Dunn to Hamilton Medical Center. Sgt. Martin had Hamilton Emergency Medical Services come to the Whitfield County Booking to retrieve Mr. Dunn.[End of Narrative].
