On 20 August 2024, at approximately 17:46 hours, I was dispatched to [REDACTED BY AGENCY] in reference to a domestic dispute.
I was advised by dispatch the male subject had left the scene. Upon arrival, I made contact with the complainant, [VICTIM #1], who advised she and her boyfriend, Rafael Soto, had been in a physical altercation this date.
It should be noted, I was also dispatched to the aforementioned address on 19 August, 2024 in reference to a domestic dispute which was unfounded in nature.
[VICTIM #1] stated on this date around 15:30 hours, Soto arrived home and she was trying to avoid a conflict with him by avoiding eye contact and not speaking to him. [VICTIM #1] stated Soto told her to change the baby’s clothes because the shirt smelled. [VICTIM #1] stated she did this and he then told her to bring the garbage can from the side of the road to which she complied. [VICTIM #1] stated at this point a verbal argument started.
[VICTIM #1] stated she went into the residence and into the kitchen. Once inside [VICTIM #1] stated Soto told her to get out of the kitchen and she began walking away. While walking, [VICTIM #1] stated Soto threw a plastic seasoning container at her striking her in the mid back. [VICTIM #1] stated Soto then struck her in the back of the head with either an object or his hand but she was not sure as she only felt an impact. [VICTIM #1] stated Soto then snatched her phone from her and intentionally threw it causing it to break. When ask if he threw it on the ground or wall, [VICTIM #1] stated she could not remember nor did she know where the phone was currently at.
[VICTIM #1] stated she then walked outside to smoke a cigarette and while outside, Soto snatched her eye glasses off her face and threw then down causing them to break.
I did not observe any signs of a physical altercation on [VICTIM #1]’s person. I did observe her eye glasses to appear to be broken, I photographed them which are attached to this report.
[VICTIM #1] stated Soto then took their [REDACTED BY AGENCY] and left the scene in a jeep compass. [VICTIM #1] stated his family gave it to her but he drives it to and from work regularly.
[VICTIM #1] stated shortly after Soto left, his niece [REDACTED], arrived on scene. [VICTIM #1] stated she and [REDACTED] then left to a farmers market and upon retuning home around 17:30 hours she notified 911 of the incident.
It should be noted, while attemting to provide [VICTIM #1] with services, her friend continunally interjected herself into the conversation demanding protection for [VICTIM #1]. Her friend would continually talk over me and at one point she demanded to speak to a supervisor. I notified Sgt Parker who arrived on scene to speak with the friend. I provided [VICTIM #1] with a case card and case information.
I was advised by Sgt. Parker that while she was on scene, she attempted to provide [VICTIM #1] with available services however, [VICTIM #1]’s friend would continually interject and disrupted the conversation.
I then made contact with Soto via telephone who advised he arrived home this date and noticed on [VICTIM #1]’s phone her to be texting someone. Soto stated an arugment started and he grabbed the phone that was laying on the couch and broke it. Soto stated several times that the phone belongs to him and he can break his own property. When ask if anything became physical, Soto denied all allegations.
