Deputy Bandy was then advised by EMS personnel that Nathaniel was inside the store, causing a disturbance, saying the female inside did not have the right to drive his car, and that he was now standing in front of the Ambulance and refusing to move so they could leave.Deputy Bandy then had Nathaniel move out from in front of the Ambulance and in front of his patrol car, and the EMS personnel had to leave the scene to respond to an emergency call. Deputy Bandy asked Nathaniel what was going on, but he would not respond answer and continued to ask Deputy Bandy what the EMS employee had told him, while balling up his right fist.Deputy Bandy observed several signs of impairment from Nathaniel, such as glossy eyes, inability to maintain balance while standing, slurred speech, the odor of alcoholic beverages coming from his person, and that Nathaniel appeared to have urinated on himself. Nathaniel was not making much sense and advised his brother had brought him to the location. [VICTIM #1] stated that she then observed Nathaniel seated in the passenger seat of her vehicle. [VICTIM #1] stated that they then advised Nathaniel that it was not his vehicle, but he stated it was. [VICTIM #1] did not know Nathaniel.Deputy Bandy then observed another male in the store later identified as Jesse Lara, who advised him that he was there with Nathaniel and another male who was inside a vehicle in the parking lot. Deputy Bandy exited the store and went to the vehicle that Jesse advised they arrived in. Deputy Bandy observed a green 2006 Ford F-250 with Georgia tag number [REDACTED] and vehicle identification number [REDACTED].Upon approaching the driver’s side, Deputy Bandy observed a male later identified as [REDACTED] sitting in the driver’s seat and immediately noticed that [REDACTED]’s eyes were glossy and his face looked flushed, and he appeared to be under the influence based on Deputy Bandy’s training and experience. Deputy Bandy then asked [REDACTED] to exit the vehicle for a possible DUI investigation and to keep him from possibly driving off while impaired. [REDACTED] then rolled the window up. Deputy Bandy then knocked on the vehicle window, and [REDACTED] then exited the vehicle.Deputy Bandy noticed his responses were delayed, and he was having a hard time keeping his balance. Deputy Bandy then asked [REDACTED] to step to the front of his patrol vehicle, and [REDACTED] did not listen after being told multiple times. Deputy Bandy went to guide [REDACTED] towards his vehicle, and [REDACTED] then pulled away. Deputy Bandy then placed [REDACTED] in handcuffs for his, the public’s, and the officers safety. [REDACTED] advised Deputy Bandy that he did not drive the vehicle to the location. [REDACTED] did advise Deputy Bandy that he had a little bit of alcoholic beverages to drink.While Deputy Bandy was dealing with [REDACTED], Nathaniel kept walking away despite being told to stay in front of the patrol vehicle multiple times. Deputy McKenzie then detained Nathaniel in handcuffs. Nathaniel was then placed into the backseat of Deputy Bandy’s patrol vehicle, where he was being belligerent by yelling, screaming, and continuously kicking the back driver’s side door of the patrol vehicle. At one point, while in the back seat of the patrol vehicle, Nathaniel had slipped out of the handcuffs and was no longer restrained by the handcuffs.Deputy Bandy then spoke with Jesse again, and he stated that he, Nathaniel, and [REDACTED] had been at a Mexican restaurant located at 1525 Cleveland Hwy before arriving at this location. Jesse stated that [REDACTED] had driven them there. Jesse then provided Deputy Bandy with his driver’s license, and upon running it, dispatch advised Deputy Bandy that Jesse had an active warrant through the Murray County Sheriff’s Office. Deputy Bandy then returned to Jesse, who turned around without being told and placed his hands behind his back. Deputy Bandy then placed Jesse in handcuffs, which were checked for fit and double-locked.Sgt. Barnett, Deputy Dominick, and Deputy Watkins then arrived on scene to assist. Deputy Bandy then asked the store management if they had video footage of the parking lot to see who was operating the vehicle when it arrived. The employee advised Deputy Bandy she was unable to play back the video at this time. No other subjects on scene were able to advise who was driving the vehicle when it arrived.Deputy McKenzie spoke with [VICTIM #1], who advised him that she did not believe any items were missing from her vehicle and that it did not appear the male was attempting any theft. [VICTIM #1] advised Deputy McKenzie that she did want to press charges against Nathaniel for entering her vehicle without permission. Deputy McKenzie did locate a store bag in [VICTIM #1]’s vehicle that contained Nathaniel’s wallet with his driver’s license inside.[VICTIM #1] did advise Deputy Dominick that damage was done to her vehicle by Nathaniel. The damage that was done to the vehicle was the lever for the vehicles windshield wiper had been broken off. [VICTIM #1] advised that she was unsure how much it would cost to fix at the time. Deputy Bandy then transported Nathaniel to the Whitfield County Jail.
