On this day, 10/01/24, I, Officer G. Castillo, responded to 1200 Memorial Dr Hamilton Medical Center in reference to a disturbance. The caller, a nurse on staff at Hamilton Medical Center, stated a individual was causing a disturbance and being aggressive with public safety. The subject causing a disturbance, later identified as Maurisio Fraire.
The originating call involving Maurisio was in response to a noise complaint at [500 BLOCK] Parkside Pl; Apt [REDACTED]. Upon my arrival at Apt [REDACTED], I observed Maurisio asleep in the driver’s seat of the vehicle with tag number [REDACTED]. I spoke with the owner of the vehicle, [WITNESS #1]. [WITNESS #1] stated they were all just drinking Modelos and that Maurisio always drinks till he falls asleep. [WITNESS #1] stated that he was playing music with his vehicle and that he only turned it on so the battery would not die. [WITNESS #1] stated he was never going to let Maurisio drive the vehicle due to him being intoxicated. [WITNESS #1] stated that is just where Maurisio was sitting when he decided to close his eyes. I attempted multiple times to wake up Maurisio by moving him and calling his name but he stayed asleep.
Officer Mullinax applied multiple sternum rubs in an attempt to wake up Maurisio, but no response. Officer Mullinax advised that Maurisio’s breathing sounded weird and that it would be better if we called EMS. [WITNESS #1] stated that they only drank alcohol and did not know of any other substances Maurisio may have consumed. Maurisio was transported to the ambulance and was still asleep.
EMS transported Maurisio for further medical treatment.
Upon my arrival at the Hamilton Medical Center, public safety staff member [VICTIM #1] informed me that Maurisio was being loud, aggressive and disorderly with staff members. [VICTIM #1] stated that staff members were attempting to render further medical attention to Maurisio. [VICTIM #1] then stated Maurisio “bucked up” at him. [VICTIM #1] stated that is when he pepper sprayed Maurisio.
Maurisio stated he wanted to leave the hospital because he knew his rights. Maurisio stated he was not fighting and that [VICTIM #1] pepper sprayed him for no reason. Maurisio stated this multiple times. At this time, Maurisio could not open his eyes due to the effects of the pepper spray. I assisted Maurisio by showing him the proper methods to clear pepper spray off of his eyes.
Once Maurisio eyes were open, Maurisio pointed at [VICTIM #1] and stated again that he pepper sprayed him for no reason.
I placed Maurisio under arrest for disorderly conduct. I searched his person incident to arrest. I asked Maurisio if he was a United States citizen, and he stated yes. I seat-belted him into my vehicle and transported him to the Whitfield County Jail. Upon my arrival, I secured my firearm in a sally port lockbox. I transferred Maurisio to Whitfield County Jail staff along with his property. I charged Maurisio on warrantless arrest form #69416.
I returned to the sally port and secured my firearm. I then searched my backseat and made sure Maurisio left nothing behind.
This incident is cleared by arrest and nothing further.
