On this day, 08/17/24, Officer G. Castillo responded to 1315 W Walnut Ave in reference to a domestic disturbance in progress. 911 gave me a description of a individual involved white male with no shirt, later identified as Mark Nelson; a white female, later identified as [VICTIM #1]; and a black male, later identified as [VICTIM #2]. While in route, 911 notified us that the caller stated Mark and [VICTIM #1] were physical and that [VICTIM #2] intervened by pushing Mark. Caller then stated that Mark was being belligerent in the parking lot. 911 notified us that Mark would be sitting on a bench outside of Longhorn shirtless.
Upon arrival, I spoke with [VICTIM #1] and [VICTIM #2]. [VICTIM #1] stated that she and Mark were at 1522 W Walnut Ave (BP). [VICTIM #1] stated that Mark took her phone cause he believed she talked to other men. I asked [VICTIM #1] who Mark was to her, and she stated it was her children’s father. [VICTIM #1] then states that she tried to get the phone back, but Mark was being mean to her and yelling. To separate, she stated she walked away to 1433 W Walnut Ave (KFC) but that Mark followed them and continued and argue. [VICTIM #1] then stated they walked towards Longhorn, and Mark continued to follow her and [VICTIM #2]. [VICTIM #1] stated that she tried to grab her phone back, and Mark pushed her into the bushes.
[VICTIM #2] then stated that it all started because Mark wanted a cigarette from [VICTIM #1], but she would not give it to him. [VICTIM #2] then stated that they walked over to KFC to separate themselves from him but that he followed them and kept arguing. [VICTIM #2] then stated that they walked towards Longhorn that is when it got physical. [VICTIM #2] stated that Mark pushed [VICTIM #1] into the bushes. [VICTIM #2] stated that Mark continued to follow them and yell. [VICTIM #2] stated that Mark got into [VICTIM #2]s face yelling and that is when [VICTIM #2] pushed Mark to separate Mark from them.
I spoke to Mark, and he stated that they were at the BP and that he got her phone. I asked Mark if [VICTIM #1] consented to him grabbing her phone, and Mark seemed very hesitant to answer the question. After multiple times asking Mark the same question, Mark stated all [VICTIM #1] said was “go on.” Mark stated that they walked over to Longhorn and that [VICTIM #1] tried grabbing the phone, and she pushed him, falling into the bushes. Mark stated that he was not arguing with them that he just talks loud. I asked Mark why his shirt was off, and he stated he got hot.
I spoke with the witness, [WITNESS #1], and she stated that she saw Mark, [VICTIM #2], and [VICTIM #1] walking in the parking lot. [WITNESS #1] stated she saw Mark holding up a bag to keep it away from [VICTIM #1] in an instigating manner. [WITNESS #1] then stated that [VICTIM #1] lunged at Mark, grabbing him and trying to grab the bag. [WITNESS #1] then stated that they separated and that [VICTIM #2] pushed Mark back.
Officer Walker spoke with [WITNESS #2], and she stated she saw them arguing while Mark was holding up the bag. [WITNESS #2] then stated that [VICTIM #1] lunged at Mark, grabbing his head, and that is when they fell into the bushes. [WITNESS #2] stated to Officer Walker that is when she started recording. In the video, you can see Mark getting in [VICTIM #2]’s face to the point [VICTIM #2] push Mark to separate himself. You can also hear Mark screaming, “fuk you, mother fuker do something” repeatedly. Mark continues to scream and follow [VICTIM #2] and [VICTIM #1] as if he was trying to start a fight as the video stops. [WITNESS #2] stated that it seemed to her that Mark started it.
Due to the conflicting statements between Mark and [VICTIM #1]s physical disturbance. No arrest was made realated to their disturbance.
I placed Mark under arrest for disorderly conduct instead. I double locked his handcuffs searched him incident to arrest. I asked him if he was a US citizen, and he stated yes. I then placed him in the back of my patrol car and seat-belted him.
Upon arrival at the Whitfield County Jail, I secured my firearm in a lockbox. I then walked Mark into the jail and handed him over to the jailers along with his property. I charged Mark on warrantless arrest form #69123 for the charge of disorderly conduct 16-11-39.
Upon returning to my vehicle, I searched where Mark was sitting and saw greasy, dirty fingerprints on the seat, leading me to believe Mark hid something in the back seat. I dropped the back of the seat and saw a glass smoking device. Took a picture of it and safely removed it to secure it. The glass smoking device was broken, but I collected all the pieces. Officer Walker advised me that there was a crystal-like substance in the device. After I collected the glass smoking device, I charged Mark with possession of drug related objects 16-13-32.2 onto warrantless arrest form #w69123. I then placed the glass smoking device in evidence after I left the jail.
This incident is cleared by arrest.
