On 09-28-2024 at approximately 1725 hours, Deputy Winkler was patrolling the area of South Dalton Bypass near Airport Road when he observed a white Ford Expedition, matching the description of a vehicle that had just been involved in a hit and run in the area.
Deputy Winkler further confirmed the vehicle description of the Offender vehicle with Whitfield County Dispatch. The vehicle had moderate to heavy front-end damage with parts hanging off that would only be present in a recent collision. Deputy Winkler maneuvered his patrol car into position behind the vehicle and observed it had an extremely dark tag cover concealing the tag. He initiated a traffic stop at Airport Road and Thomas Drive.
The vehicle ran off the right shoulder of the roadway prior to turning left onto Thomas Drive, indicating the driver was unable to safely operate the vehicle. After turning onto Thomas Drive, the vehicle accelerated then turned right onto Putnam Drive. It continued to [1100 BLOCK] Putnam Drive where the road came to a dead end. With the Patrol vehicle blocking the driveway Deputy Winkler opened his door and attempted to exit his vehicle when the Offender accelerated toward his open door. Fearing the intention was to strike himself or his Patrol vehicle, Deputy Winkler retreated back into his vehicle as the Offender drove through where Deputy Winkler would have been standing had he not retreated. Due to the offender driving toward Deputy Winkler, he could clearly see the driver and saw no passengers inside the vehicle.
The Offender traveled back out Putnam and Thomas, then turned left onto Airport Road. On Airport Road where he reached speeds exceeding eighty miles per hour, based on Deputy Winkler’s knowledge training and experience as a certified speed detection operator, and the relative speed of Deputy Winkler’s patrol vehicle while pacing the Offender. The Offender passed multiple vehicles in no passing areas, while failing to maintain lane and endangering others on the roadway. He continued down Airport Road past the airport where he increased his speeds to exceed ninety miles per hour, based on the same principles of speed estimation as before. After passing the airport, Whitfield County Deputy Kadinger joined the pursuit and Deputy Winkler became the secondary pursuing vehicle.
The Offender continued into Murray County before turning left onto Brown Bridge Road, where Murray County Sheriff’s Office Deputies that had staged in the area, took over as the primary pursuit vehicles. After it was determined that Murray County had the required manpower in the area, Deputy Winkler and Deputy Kadinger terminated their pursuit. Soon after, Whitfield County Dispatch advised Deputy Winkler that Murray County requested that he continue to [300 BLOCK] Chevelle Drive to meet with their Deputies. Upon arrival, the Offender’s vehicle was parked at [300 BLOCK] Chevelle Drive and the Offender had left the scene on foot.
After Deputies had been in the area for several minutes, they were flagged down by Ms. [REDACTED] who lives at [300 BLOCK] Chevelle Drive. Ms. [REDACTED] stated she heard the sirens, and then saw the Offender’s vehicle pull into her neighbor’s driveway. She watched as the driver exited the vehicle and came onto her front porch. Ms. [REDACTED] confronted the driver, whom she didn’t know, and told him to leave before going back inside and locking her door. When Deputies arrived, Ms. [REDACTED] went out her back door and contacted the Deputies, letting them know that the driver was sitting outside her residence. Deputy Winkler was able to make a positive identification of the driver, who was identified as Mr. Manuel Fraire. Mr. Fraire’s father was the registered owner of the vehicle. Deputy Winkler could smell a strong odor of alcohol coming from Mr. Fraire’s mouth, and he was extremely unsteady on his feet.
Deputy Winkler performed a pat down search of Mr. Fraire, placed him in handcuffs, checking for fit and confirming double lock. He then read Mr. Fraire Implied Consent and he refused testing. Lieutenant Rann arrived on scene, was advised of the refusal and instructed Deputy Winkler that he would inventory the vehicle and wait for the wrecker, allowing Deputy Winkler to proceed with his transport of Mr. Fraire. Deputy Winkler advised Mr. Fraire of his charges, then transported him to Whitfield County Detention Center without incident and released custody over to Booking Staff. Lieutenant Rann completed the vehicle inventory where he located multiple open containers of alcohol, one of which being in the center console area of the vehicle. Parrish wrecker service towed the vehicle to their lot.

Mr. Fraire’s Georgia Driver’s License was seized due to his implied consent refusal
Deputy Winkler completed the ALS form, DDS 1205, and attached his license to the form
While Booking Staff were searching Mr. Fraire’s belongings inside the Whitfield County Detention Center, a small cut off straw consistent with one used as a drug related object, along with a dollar bill that was folded up, was found inside Mr. Fraire’s wallet. The one-dollar bill contained a white powder residue that field-tested negative for Methamphetamine, but did not contain enough residue to perform further testing. Both items were packaged together and entered into evidence by Deputy Winkler as item one, to be destroyed.
Deputy Winkler completed his report, then concluded his investigation of the incident.
