On 08/11/2024 at aproximately 2204 hrs, I, Ofc W Womack and Mpo Shope, responded to an aggravated assault call at [900 BLOCK] S Hamilton St.
Dispatch advised the call taker, operator 232, could hear a female scream for help and saying she could not breathe. The following is the cad dispatch prompt that was recorded prior to our arrival:

I heard the male stated “you bit me!” and then the female screamed for help. Mpo Shope arrived on scene and I knocked on the door and announced “police”. A female answered the door. She was crying and holding an ice pack on her face. Her face was red from crying. When she removed the ice pack I could see red welps that were beginning to blue on her forehead and on her left eye. Mpo Shope entered the residence and placed the male subject in hand cuffs. The male suspect was placed in the back of Mpo Shope’s patrol vehicle to separate the two due to the small area of the residence. I began to speak with the victim, [VICTIM #1], who stated “its never been this bad before”. She then began to talk about a brain injury she had explaining she had a “twitch”. As I tried to ask her about the events of the night, she began crying. She advised he choked her and she bit him on the leg when he did. [VICTIM #1] was in distress and would start talking about things not relevant to the night. I decided it would be better to interview her at the hospital. [VICTIM #1] stated her children were asleep in the back room. Ofc C Wingate went to check on them and advised they were still asleep. [VICTIM #1] stated she coud call her mom, [REDACTED], to come and stay with the children. EMS was requested to come check out [VICTIM #1]. Mpo Shope advised that he read the suspect, Kohl Wheeler, his miranda rights to which Kohl advised he did not want to speak to us. We took Kohl out of Mpo Shope’s patrol vehicle and placed him in mine. While we transferred him to my patrol vehicle, I looked over Kohl’s legs. He had two distinguishing fresh bite marks on his legs. I went into the room and observed the room in some disarray. There were several overturned trashcans and a shattered circular fan on the ground. Mpo Shope stayed at the house until [VICTIM #1]’s mom was able to get there. I took Kohl up to the Whitfield County Jail. He was charged with aggravated assault for attempting to choke [VICTIM #1]. As I transported Kohl, he stated he “didn’t do anything to her” multple times. He was charged, OCGA 16-5-21 aggravated assault (fv), on warrantless arrest form 69112. I then went to Hamilton Medical Center to speak with [VICTIM #1]. I made contact with [VICTIM #1] in room 26. [VICTIM #1] had calmed down and was able to explain the events of the night. She stated she and Kohl were arguing over groceries and bills and that he was tired of her waiting on her disability check. She then said she was scared so she recorded the incident on her phone. She told Kohl that she was listening to music with her earpods in, but she was recording the incident. I then listened to recordings starting at 2040 hrs 08/11/2024 (see attached). I heard the argument about his displeasure with her disability. He states she would be better off if he beat her to death. After this, she told him he fixed his watch incorrectly. She started to fix it for him. As they argue back and forth about earlier comments, a loud pop happens. Instantly Kohl is heard saying “you hit my eye”, [VICTIM #1] gets defensive and says she didn’t hit him. [VICTIM #1] pauses the recording and stated she had a tote that had all the things to fix the watch in it. She was trying to open it when it tore open and her hand hit Kohl. I did not observe any marks on Kohl’s face, at his time of arrest, indicating being struck. On the recording, Kohl becomes livid and begins shouting at [VICTIM #1] and “accusing” her of hitting him in the eye. She repeatedly stated, on the recording, she didn’t hit him in the eye. Kohl’s voice becomes very clear, as if he is next to the phone. [VICTIM #1]’s voice is heard muffled saying she cant breathe. Kohl states “I’m gonna teach you”. [VICTIM #1] is heard crying she “cant breathe” then Kohl is heard saying “you bit me”. He shouts again that he’s gonna hurt [VICTIM #1]. [VICTIM #1] asked for ice for her face. Kohl says “Im gonna fuk you up”. She begins crying. Kohl says “you gonna call the cops or do you wanna get trashed some more”. Kohl says “Im gonna fuk you up, what you gonna do you wanna bite me?!” His voice becomes very clear in the recording, as if closer to the microphone. Kohl yells “apologize” multiple times [VICTIM #1] can be heard grunting. He says “fuk you you dont need this arm” [VICTIM #1] attempts to tell her phone through sir I to call 9-1-1 but it doesnt register.
[VICTIM #1] goes to the bathroom to call 9-1-1. (See attached audio files)
At this point, the call taker for dispatch is able to hear what is happening.
I asked [VICTIM #1] to clarify some of the recording for me. She adivsed they were laying on the bed. Kohl threatens to beat her. They tranisition to talking about his watch. She starts to fix the watch and accidentally hits him. That’s where he said “you hit me in the eye”. She adivsed he then jumped up on the bed and began strangling her with his leg. I asked how that happened. She stated he had a background in Muay Thai and MMA. [VICTIM #1]’s cries for help are muffled and she states on the recording she cant breathe. She says this is where he began to choke her with his leg, so she bites him twice (consistent with the marks we found on his legs).
Based on my training, knowledge and experience, this kind of vascular neck restraint, aka a triangle choke, would have given [VICTIM #1] the chance to defend herself by biting Kohl’s leg.
Loud pops are heard on the audio and [VICTIM #1] crying. [VICTIM #1] says aloud you didn’t have to hit me. Kohl is heard saying he had to hit her twice. I ask about when Kohl tells her to apologize. [VICTIM #1] stated he jumped on top of her again and attempts to choke her with his arms. He then transitions to an armbar when he says “fu*k you, you dont need this armr. [VICTIM #1] stated once he let go, she got up and went to the bathroom to call 9-1-1.
I gave [VICTIM #1] a victims rights form and explained it.
During this incident the suspect was advised that they were under arrest. The suspect was searched incident to the arrest. My patrol vehicle was searched prior to and following the transport of the suspect. The suspect was secured in a seatbelt during transport. The suspect advised that they are a U.S. citizen. While at the jail my department issued side arm was secured in a locker. The suspect and their belongings were handed over to booking staff at the jail with no issues. Booking staff was made aware of any medical or security risks at the time of handing them over.
