On 08/30/2024 around 1100 hours Deputy Kirby responded to 205 North Selvidge Street (Whitfield County Sheriff’s Office) at the District Attorney’s Office. District Attorney [REDACTED] met with Deputy Kirby along with [VICTIM #1]. District Attorney [REDACTED] was present for the entirety of the investigation with [VICTIM #1].
[VICTIM #1] appeared to have a severely blacked left eye with bruising and a laceration to his left cheekbone area. [VICTIM #1] had a wound on the top of his left hand. later [VICTIM #1] showed that he had bruising to the front of his left shoulder.
[VICTIM #1] stated that his son, Hunter Blackwell. assaulted him in his home located at [200 BLOCK] Keith Street due to an argument. [VICTIM #1] stated the argument started when he asked Hunter to place the guns in his (Hunter’s) room in the gun safe. [VICTIM #1] advised that Hunter was playing a video game and had began to become angry.
[VICTIM #1] stated that roughly a minute or so after advising Hunter to put the guns up he (Hunter) “jerked” the living room door open and threw a Maglite (Flashlight) at him. [VICTIM #1] stated that Hunter also threw a 9mm Glock pistol down in the hallway causing the gun to leave its holster, and the magazine to dislodge from the pistol. [VICTIM #1] stated that Hunter returned to his room before returning into the living room stating “Here’s your other gun”
[VICTIM #1] stated that Hunter had a rifle, a Remington pump 22. caliber rifle, and struck him with the butt of the rifle in the face. Deputy Kirby asked if that is how [VICTIM #1] sustained the blackened eye. [VICTIM #1] advised “Well, that was part of it.” The impact of the rifle caused him to lose consciousness. [VICTIM #1] stated that he “came to” with Hunter in a mounted position on top of him striking him in the side and back of the head with his fist. [VICTIM #1] stated that Hunter quit striking him, got up, and began choking him in a headlock style chokehold from behind [VICTIM #1].
[VICTIM #1] stated that he was in a seated position reaching up and placing his thumbs into the eyes of Hunter and applied pressure until Hunter stopped choking him. [VICTIM #1] stated that had he not defended himself that Hunter would not have stopped choking him. [VICTIM #1] stated that Hunter disengaged from any further physical altercation.
[VICTIM #1] stated once Hunter saw the extent of his injuries he became apologetic. [VICTIM #1] stated Hunter acted like he “Didn’t mean to do it.” [VICTIM #1] advised that he felt Hunter had this reaction due to fearing that he would reach out to law enforcement.
[VICTIM #1] advised that he went and got a washcloth to tend to his wounds and Hunter kept “following him around” [VICTIM #1] stated “Everywhere I went, he was there.” [VICTIM #1] advised that Hunter had taken his phone preventing him from contacting law enforcement and reporting the crime. [VICTIM #1] stated that he had asked Hunter for his phone several times.
[VICTIM #1] stated that he tried to leave the home several times and Hunter would physically push and shove him into the home preventing him from leaving to seek medical care or contacting law enforcement. [VICTIM #1] advised Hunter stated “That ain’t the way it works. You don’t need to take no warrant or get the law involved.”
[VICTIM #1] stated that Hunter called [WITNESS #1] ([VICTIM #1]’s sister), stating that [VICTIM #1] needed to go to the hospital. [VICTIM #1] advised that [WITNESS #1] witnessed Hunter pushing him and confining him in the home. [VICTIM #1] advised that [WITNESS #1] did not intervine in the altercation. [VICTIM #1] advised that he felt that [WITNESS #1] was likely scared. [VICTIM #1] stated that Hunter continued to prevent him from leaving with [WITNESS #1] after being advised that law enforcement would be called to the hospital after evaluating his type of injuries.
[VICTIM #1] stated that eventually he went to his room locked and shut the door separating himself from Hunter. [VICTIM #1] stated that once he entered his room there were no further incidents with Hunter. [VICTIM #1] stated he could hear Hunter walking back and forth in the hallway cleaning things up.
[VICTIM #1] stated that he awoke on 08/30/2024 and went to the courthouse to seek action against Hunter.
Deputy Kirby advised [VICTIM #1] to seek medical attention for his injuries. Deputy Kirby was advised by District Attorney [REDACTED] that he had taken extensive photos of [VICTIM #1]’s injuries and would provide the photos via Evidence.Com for documentation.
[VICTIM #1] advised that Hunter has bad anger issues, and has struck and pushed him several times in the past. [VICTIM #1] advised that Hunter does take medication, but it was unknown if any medication had been taken close to the time of the assault.
Deputy Kirby will be seeking a warrant for Hunter for the following charges:
O.C.G.A. 16-5-21 Aggravated Assault (FV)
(Hunter used a rifle offensively that caused serious bodily injury and placed [VICTIM #1] in a chokehold which would constitute strangulation.)
O.C.G.A. 16-5-41 False Imprisonment
(Hunter, in violation of [VICTIM #1]’s personal Liberty, confined him in the home by the way of physical force.)
O.C.G.A. 16-10-24.3 Obstructing or Hindering Persons Making Emergency Telephone calls
(Hunter physically prevented [VICTIM #1] from contacting law enforcement by taking physical control of [VICTIM #1]’s phone,)
