[NARRATIVE #1 on September 02, 2024]
On Monday 9/2/24 at 0906 hrs, Deputy Diak spoke to [VICTIM #1] in reference to her neighbors dogs. [VICTIM #1] Stated for the past two weeks her neighbors dogs at [100 BLOCK] Pioneer Dr have been loose and were coming to her property using the bathroom in her yard. [VICTIM #1] stated one dog was black and one dog was brown. [VICTIM #1] also stated within the past two weeks, she has received letters from the UPS and Fed-Ex drivers that her packages were not delivered due to the neighbors dogs being loose and aggressive. Deputy Diak advised [VICTIM #1] he would make contact with the owners.
At 0938 hrs, Deputy Diak and Lieutenant Callahan arrived at [100 BLOCK] Pioneer Dr. Deputy Diak observed the black and brown dog on another property. Deputy Diak stepped out of his patrol vehicle and the dogs ran back to the property and started barking and showing aggression. The black dog was a female and it would charge then stop while growling and barking. The brown dog would charge, but stayed further back and went around the house and started barking at Lt. Callahan.
Deputy Diak had his fetch pole and the black dog would back away when the fetch pole was waved around. Deputy Diak knocked on the door and again the black dog would charge and stop about eight feet while growling and barking. The owner of the dogs, Drake Mills, opened the door and called the dog inside. Due to the amount of calls, Deputy Diak had made the decision to write citations. Deputy Diak asked drake for his license and Drake slammed the door shut and locked it. Deputy Diak made several attempts to make contact again, but Drake would not answer the door.
Deputy Diak spoke with a female by phone who knew Drake and was advised she would contact him and have him step back outside. Deputy Diak and Lt. Callahan waited roughly five minutes and Drake never came outside. Deputy Diak knocked on the door and a dog started barking from inside. Deputy Diak heard Drake tell the dog to hush, but still did not come to the door. Deputy Diak filled out an orange card and hung it on the front door requesting a call back.
Deputy Diak has been to [100 BLOCK] Pioneer Dr multiple times in reference to their dogs running loose and being aggressive. Drake is not cooperative and will not fix the issue when addressed or will not answer the door when he is home. Deputy Diak searched the history of the surrounding area and found eight calls in reference to the dogs that live at [100 BLOCK] Pioneer Dr dating back to 12/26/23. The most recent call was a bite case that occurred on 6/5/24, case number 202403641. During this incident the dog was seized due to no proof of a current rabies vaccination. During the holding period, the dog was classified dangerous by the dangerous dog control officer Dr. [REDACTED].
Due to Drake refusing to present his ID and hindering Deputy Diak from being able to complete the call, Deputy Diak will attempt to seek a warrant for obstruction 16-10-24 (a).

[NARRATIVE #2 on September 04, 2024]
On Wednesday 9/4/24, The Whitfield County Animal Shelter placed a trap on [VICTIM #1]’s property in an attempt to catch Drake’s dogs that were continuing to be at large and come onto [VICTIM #1]’s property.
On Thursday 9/6/24, One of Drake’s dogs was caught in the trap. [VICTIM #1] advised dispatch and before Animal Control could respond, Drake trespassed onto [VICTIM #1]’s property and released his dog from the trap. [VICTIM #1] stated she had pictures and videos of the dogs being on her property and Drake trespassing on her property releasing his dog from the trap. Deputy Diak sent [VICTIM #1] a link to evidence.com so she could upload her pictures and videos of Drake and the dogs being on her property. [VICTIM #1] was advised to contact dispatch again if one of Drake’s dogs is caught in the trap again.
On Friday 9/6/24 at 1042 hrs, Deputy Diak arrived at [100 BLOCK] Pioneer Dr in reference to [DRAKE]’s dog that was caught in the trap. Deputy Diak observed Drake exiting his vehicle and again trespassing on [VICTIM #1]’s property to release his dog from the trap. Drake was taken into custody and transported to the Whitfield County Detention Center. Drake’s obstruction warrant was served on warrant number W24-1341. Drake was also issued a Magistrate citation for Spay/Neuter Requirement 4-10, Rabies Vaccination Required 4-20, and Animal At Large 4-21.
Deputy Diak advised [DRAKE] that he was criminally trespassed from [100 BLOCK] Pioneer Dr. and if he went on the property again, he would be arrested for criminal trespass. [DRAKE]’s dog was transported to the Whitfield County Animal Shelter.
