Jones and I were dispatched to [100 BLOCK] Nowell Street Apt [REDACTED] about Chad Phiel pulling a sword on the complainant [VICTIM ]. Dispatch said parties were separated in different rooms but heard Chad yelling in the background.Dispatch also told us [VICTIM ] had a pistol on his person and was refusing to put it down. Upon our arrival, we came in with [VICTIM ].We asked where Chad was and he told us in the apartment. When we walked into the apartment Chad’s wife [WITNESS ] came to the door saying she was trying to calm Chad down and he was sick.We told Chad to come out from his room with our department issue pistols pointed at him because we thought he could still have the sword. Chad walked to us empty-handed and Cpl-Jones placed Chad in handcuffs.When we got parties separated, Cpl. Jones spoke with [VICTIM ] inside the apartment and I spoke with Chad about the incident.I read Chad his Miranda rights because he was in handcuffs. Chad kept interrupting me. After I was done reading the Miranda rights, Chad agreed to speak with me. He said he got into an argument with [VICTIM ] because he pushed his wife [WITNESS ] to the ground at the front door while [VICTIM ] was outside the door. He said [WITNESS ] was kicking [VICTIM ] out of the apartment and had his bags packed for him. When he saw his wife was pushed down to the ground he got in [VICTIM ] face and started arguing with him. Chad told me [VICTIM ] stayed at the house for several days. I asked Chad if he drew a weapon on [VICTIM ] and he said no.I spoke with Cpl. Jones and [VICTIM ], they told me During the argument Chad had his sword out. Chad took an aggressive stance towards him and pointed the blade at him. [VICTIM ] said he was within a foot of the blade and thought Chad was going to stab him with it. Cpl. Jones said Chad was sending [VICTIM ] threatening text messages saying he was going to end his life and was arguing over money.When I spoke to [WITNESS ], she kept saying she wanted [VICTIM ] to move out of her apartment and she advised about the eviction process. I asked about the argument. She said she was trying to give [VICTIM ] his bag of belongings through the door and was not letting him inside. [VICTIM ] pushed the door and entered the apartment. Her dog then ran outside and she took off after it. She did not see the sword being taken out. She claimed the whole argument was verbal and she did not fall to the ground.I asked Chad where Sword was in his bedroom. He told me it was in the closet or under his bed. I asked him if we could go get it and if he could show us where it was. He entered his bedroom and claimed the ASP Paton was what he used. We asked [VICTIM ] if the ASP was the weapon used against him. He told us, no, it was a black sword. Chad then gave us permission to keep looking and Cple. Jones located it under the bed. I took custody of both weapons because they were both claimed to be in the altercation.[VICTIM ] said he did not want Chad to go to jail or press charges.Chad was placed under arrest for Family Violence Aggravated Assault because [VICTIM ] has been living in the apartment with Chad since September 2024.[WITNESS ] told me she did have a TPO against Chad but it has expired and did not know what to do with Chad because they have been together for a long time. [WITNESS ] said she was planning on writing the courts to get the TPO taken off file. I looked the TPO up and it appear to be an active TPO.I transported Chad to the Police Department where I fingerprinted him and took him to the Walton County Jail.I listened to the 911 phone call, I heard [VICTIM ] asking for a police Officer because his roommate was trying to kick him out. Then he told the dispatcher Chad drew a sword at him and he did not want to shoot him. [VICTIM ] was calm and collected when he was speaking to the dispatcher. I heard a little bit of yelling in the background but I could not tell what was being said.[End of Narrative].
