On the indicated date and time, I responded to the indicated location about a domestic dispute. Upon arrival, I made with [VICTIM ]. [VICTIM ] advised he got into a fight with his brother Samuel after Samuel jumped on his parents. [VICTIM ] was inside the residence calming down Samuel. [VICTIM ] advised he walked into the bedroom when he heard his parents and Samuel fighting and he advised Samuel was on top of [VICTIM ] and had his mother [VICTIM ] on the bed pinned down as well but he was holding her by the throat and she was gasping.
[VICTIM ] admitted he started hitting Samuel to get him off his parents when he began to fight, Samuel started hitting [VICTIM ] in the face causing swelling and marks. [VICTIM ] advised that they have sent Samuel to a few different facilities over the years and nothing has worked. [VICTIM ] advised Samuel was celebrating getting a new job and had too much to drink. [VICTIM ] advised Samuel to go to bed and he argued with [VICTIM ] until [VICTIM ] picked up the phone and told him he was going to call 911. [VICTIM ] advised Samuel charged him tackled him and put his hands around his neck. [VICTIM ] advised he did not lose consciousness or blackout.
While he was being grabbed by the neck [VICTIM ] tried to get Samuel off of [VICTIM ] when Samuel turned and grabbed her by the throat with one hand. Samuel admitted to losing his temper and confirmed he did what his family advised.
I arrested Samuel for Aggravated Assault Strangulation on [VICTIM ], Interfering with a 911 call on [VICTIM ], and Battery DV on [VICTIM ]. Samuel was cooperative and went into custody without incident. I photographed their injuries and had the parties fill out statement forms. The family did not want Samuel arrested they wanted him 10-13. I refused based on the level of violence that occurred and advised them of the procedures for getting a TPO and informed them of the domestic violence laws in Georgia. The family was concerned with Samuel killing himself because he always made threats if he ever went to jail he would. The jail was notified and placed Samuel on Suicide watch.
