at approximately 1030 hours I was talking to Deputy Potts at New Seasons Church off of Atlanta Highway. While speaking with Deputy Potts I observed a grey in color tractor-trailer without the trailer stop and park in the median. I observed Ramon Cano exit the vehicle and approach us. Mr. Cano loudly stated that he needed to ask us a question. Mr. Cano requested to know who Deputy Potts was being paid by. Deputy Potts explained to Mr. Cano he was being paid by New Seasons Church. I advised Mr. Cano I was on duty and being paid by the City of Hiram.
Mr. Cano advised since Deputy Potts was not currently on duty then he shouldn’t be in his uniform. Deputy Potts explained to Mr. Cano that he was allowed to be in his uniform. Mr. Cano advised he has had an issue over the past several weeks of not being allowed to turn left from the access road onto Atlanta Highway. Deputy Potts and I attempted to explain to Mr. Cano that while Deputy Potts is directing traffic the safest way to move traffic is for everyone to continue right onto Atlanta Highway.
Mr. Cano became irate and continued to interrupt us stating that we did not drive a truck so we didn’t know what was safest. Deputy Potts advised Mr. Cano that he needed to leave because he was irate and causing a scene on private property. Mr. Cano advised he was in the road and did not have to leave. Mr. Cano then began walking back into the road while yelling “fuk you” and calling us pedophiles. Once Mr. Cano was in the roadway I advised him multiple times to get in his truck and leave. Mr. Cano continued to berate Deputy Potts and I while flipping us off and yelling “fuk you”.
I advised dispatch that I was out with an irate male and to start additional units. I grabbed Mr. Cano by his left wrist in an attempt to secure him in handcuffs. Once I grabbed Mr. Cano by the wrist he attempted to pull away. Deputy Potts grabbed Mr. Cano by his right arm and assisted me with securing him in handcuffs behind his back. I escorted Mr. Cano over to my marked patrol unit. I asked Mr. Cano what his name was and if he had an ID. Mr. Cano advised he did have an ID and it was in his pocket. I asked Mr. Cano if Deputy Potts could remove his ID from his pocket and he advised that he didn’t have to give it to us. I then asked Mr. Cano again what his name was and he reluctantly provided me with his name and date of birth.
I asked Mr. Cano if he had anyone to come and pick up his truck and he advised no but if we uncuffed him he could move it himself. I advised Mr. Cano that was not an option and requested dispatch have a wrecker en route for the truck. I issued Mr. Cano city ordinance citations for disorderly conduct and resisting an officer. Mr. Cano was ed and secured in the rear of Officer Nowak’s marked patrol unit. Officer Nowack transported Mr. Cano to the Paulding County Jail without incident. Mr. Cano’s truck was turned over to Moore’s towing.
