Officer’s Narrative:

Upon arrival, I spoke with the complainant, [VICTIM ], who stated the following: He heard some yelling in the basement. He entered the basement and noticed that his son, Jody Barrett, and his daughter, [VICTIM ], were arguing. Jody stopped arguing with [VICTIM ] and started yelling at him. Jody became irate and started to get in his face. Jody then pushed him to the ground. His left elbow had struck the ground causing a cut to the left elbow. He stated that [VICTIM ] had gotten between him and Jody to prevent any further fighting or injury. Jody had pushed her to the ground as well. Jody then left the basement and then entered the garage. [VICTIM ] then left the residence and went to the Kroger on Ridge Rd.
While he was in the garage Jody began to argue with him again about rent. Jody became irate again and using both hands grabbed him by the throat and applied pressure. I asked [VICTIM ] if Jody’s actions had impeded his normal breathing and [VICTIM ] answered, “Tight enough”. He pushed Jody away and told him to get out of his face. He informed me that his wife, [WITNESS ], witnessed Jody choking him. He called 911 and informed dispatch of the situation. He waited outside of the residence for law enforcement to arrive. He informed me that Jody was drunk during the altercation and would never act like this if he was sober. I asked if he would be willing to write a written statement form and he agreed.
I spoke with [VICTIM ] who stated the following: She got into an argument with Jody about her vehicle. Jody was upset that she was not paying him on time. He demanded that she give him the key to the vehicle. She informed him that she would give him the key to the vehicle once Jody got his property out of her yard. Jody started walking towards her in a manner that placed [VICTIM ] in fear of receiving injury. She continued to walk backward until she could no longer walk. Jody continued to walk towards her and she pushed Jody away from her. Jody was pushed into a table that had a vase on it. When Jody hit the table the vase fell off of the table and broke when it hit the ground. At that time her father, [VICTIM ], entered the basement. Jody then started to argue with [VICTIM ]. Jody then pushed [VICTIM ] to the ground. She stepped in between Jody and [VICTIM ] to prevent any further fighting or injuries. Jody then pushed her to the ground. Once Jody left the basement he went into the garage. She then returned to her vehicle and left the scene. When she was at the Kroger at Ridge Rd. her mother, [WITNESS ], called her and informed her that Jody was choking [VICTIM ]. She returned to the residence and waited for Law Enforcement. I asked if she would be willing to write a written statement form and she agreed.
I spoke with [WITNESS ] who stated the following: She stated that she witnessed Jody placing his hands on [VICTIM ]’s throat. She stated that Jody was choking [VICTIM ]. She informed me that Jody did not argue with her or strike her. I asked if she would be willing to write a written statement form and she agreed.
Deputy Heggestuen, badge number 1187, spoke with Jody. Deputy Heggestuen informed me that Jody would not explain to him what happened. Deputy Heggestuen noticed that there was blood on his right hand. When asked how the blood got there he stated that [VICTIM ] got in the middle of them.
I placed Jody’s hands behind his back and secured them in handcuffs. I double-locked the handcuffs and escorted Jody to the front of my patrol vehicle. I ed the Jody incident to arrest them for weapons or contraband. I placed Jody in the back seat of my patrol vehicle. I then transported Jody to the Paulding County Detention Center without incident. Warrants were secured on Jody. I returned to service.
