On Wednesday, August 7, 2024
, at approximately 1949 hours I, Corporal R. Labny was on duty with the Houston County Sheriff’s Office Patrol Division, in uniform, with my badge displayed, and I was in a marked patrol vehicle (843).
Deputy B. Durham made me and several other Deputies aware of a terroristic threats incident that had occurred at [200 BLOCK] Ferguson St. He informed us the suspects was driving a red sedan and should be in the area of Camellia Cir. Deputy B. Durham further informed us two black males had brandished a firearm while attempting to sell marijuana to the complainant. Deputy B. Durham requested our assistance in locating the suspects and suspect vehicle. [REDACTED BY AGENCY].
While checking the area Deputy K. Ferguson informed us, he had heard several gunshots in the area of Camellia Cir.
While traveling south on Wallace Dr. near the intersection of Evergreen St. I observed a red 2024
Mazda 3 [REDACTED BY AGENCY]) fail to stop at the stop sign at the intersection of Wallace Dr. and Camellia Cir. as it traveled east at a high rate of speed. As I turned onto Camellia Cir. I could see the Mazda parked in the middle of the roadway in front of [700 BLOCK] Camellia Cir. with the driver’s side door open. I could also see three black males standing near the driveway.
As I approached their location a black male wearing a white shirt and dark colored shorts, later identified as Airrick Middlebrooks (Arrest) moved toward the residence. A second black male with shoulder length dreadlocks and a brown jacket, later identified as Brandon Bussey (Arrest) also moved toward the residence before returning to the street. The third black male wearing a white shirt and orange shorts, later identified as VICTIM quickly moved around the rear of the Mazda before retrieving a cellphone from inside the vehicle.
As I exited my patrol vehicle [VICTIM ] approached me and said, “they shot at me” as he gave me the phone he had retrieved from the Mazda. [VICTIM ] indicated the phone belonged to Brandon. I instructed [VICTIM ] to remain at the front of my patrol car.
I informed Dispatched I needed additional units to my location quickly.
A black Lexus with a heavyset, bald, black male driver was attempting pull away from [700 BLOCK] Camellia Cir. I instructed the driver to remain where he was as I began approaching Brandon and the Mazda.
Brandon stated [VICTIM ] had taken his phone as I approached him. He further stated, “I just pulled up, I don’t even know what happened.” I asked Brandon if he lived at the residence. He stated his brother lived at [700 BLOCK] Camellia Cir. I asked if the Mazda belonged to him. He informed me the vehicle was a rental car. Brandon again stated he had just arrived on scene before stating [VICTIM ] told him he was going to steal the car. I asked Brandon if he had any weapons on him, he said no. I instructed him to turn away from me and to place his hands on the back of his head. Brandon complied with my instructions.
I frisk ed Brandon, believing he was likely armed and possibly dangerous. I did not find any weapons on Brandon.
I instructed Brandon to step to the rear of the Mazda, he complied with my instructions. I again asked him if he stayed at the residence, he again said no. Brandon went on to say his brother lived at [700 BLOCK] Camellia Cir. I asked him if his brother was the third male who had gone inside, he said he did not know.
I moved to the driver’s side of the Mazda and looked inside the open door. I could see what appeared to be an “AR” style rifle tucked between the driver’s seat and center console. The rifle had a scope attached to it with a black bandana tied around both. Black bandanas are commonly associated with gang members and gang activities. I could smell the odor of marijuana coming from inside the vehicle.
I returned to the back of the Mazda with Brandon. I placed him in custody and secured him in handcuffs. I checked the handcuffs for fit and double-locked them for his safety. I remained at the back of the Mazda with Brandon and waited for additional units to arrive on scene.
Deputy Q. Ramsey arrived on scene, and I instructed him to detain [VICTIM ].
A Warner Robins Police Department (WRPD) Officer arrived on scene. I informed her I had seen Airrick moved toward the residence however I was unsure if he had gone inside or around the back.
Brandon informed me there was an additional firearm near the driveway. He said, “you can take it apart and see that it hasn’t been fired.” I instructed him to walk toward my patrol vehicle, he complied with my command. I again asked Brandon if he lived at the address, he again said no. I asked him who’s house it was. Brandon again said the residence was his brother’s before saying, “well that’s really not his house.” I asked what his brother’s name was. He stated his brother was Airrick Middlebrooks. Brandon was secured in the back of my patrol vehicle.
Deputy B. Durham, Deputy K. Ferguson, and several WRPD Officer’s moved to the house and knocked on the door. I could hear Deputy B. Durham speaking with someone through the door however, I could not hear the person inside.
As I approached the back door, I was informed a female, later identified as Qu’aneshia Rumph (Offender) was refusing to open the door. Deputy B. Durham further informed me he had located two shell casings on the porch.
I knocked on the door and instructed Qu’aneshia to come open the door. Qu’aneshia came to the door and moved the curtain covering the window. Qu’aneshia stated she did not feel comfortable coming out of the residence, further asking if we had a warrant. I informed her we did not have a warrant however I still needed to speak with her. Qu’aneshia was adamant she would not come out without a warrant. I informed her I would be seeking a warrant.
I returned to my patrol vehicle and made with Sergeant B. Daugherty by phone. I informed him of the information I had obtained. Sergeant B. Daugherty instructed me to make with the on-call investigator.
While speaking with Sergeant B. Daugherty, Qu’aneshia came outside. Qu’aneshia was moved to the end of the driveway where she spoke with Deputy K. Ferguson.
I made with Sergeant G. Pennycuff and informed him of the information I had obtained. I informed him I believed Airrick was still inside the residence.
While speaking with Sergeant G. Pennycuff, Deputy B. Durham made with Airrick inside the residence. I could hear Deputy B. Durham give him commands to step out with his hands up. Airrick exited the residence and was taken into custody without incident. Airrick was placed in the back seat of Deputy B. Durham’s patrol vehicle.
I moved back to the door and drew my service pistol. Lieutenant J. Bish with the WRPD made with a young girl (approximately three years old) inside the residence. The girl was later identified as Qu’aneshia’s child. He instructed her to come out to him, she complied. The child was turned over to another WRPD Officer.
Based on Deputy K. Ferguson hearing shots being fired in the area, the altercation I had observed near the roadway, the casings discovered near the door, and both Qu’aneshia and Airrick’s lack of cooperation, I believed there were possibly other people inside the residence who were involved in the incident. I further believed there were possibly injured parties or evidence that could be destroyed still inside.
I informed Lieutenant J. Bish, and Deputy Q. Ramsey we would need to enter the residence to secure it for further investigation. I drew my service pistol and the three of us entered the residence. While clearing the residence we made with an older black female, later identified as REDACTED. [REDACTED] was escorted out of the residence. As we cleared the residence, I could see the bathroom and hallway floor appeared to be wet. It appeared as though the toilet had recently overflowed. We completed our sweep of the residence before exiting.
I returned to the Mazda and began ing the vehicle. Inside the Mazda I located an American Tactical rifle (Serial S342735) between the driver’s seat and center console. The rifle was loaded and there was a round in the chamber. In the center console I found a clear plastic bag containing marijuana and $110.00 (4x$20, 5x$5, 5x$1) in loose cash. I collected the rifle, marijuana, and money from the Mazda. I also located what appeared to be a bullet hole in the front driver’s side of the vehicle’s hood.
I made with Brandon in the back seat of my patrol vehicle. I confirmed Brandon was aware of the Miranda warning he had already been informed of. I asked Brandon to describe what had occurred since the incident on Ferguson St. Brandon said yes, further stating “I’m not from around here, I’m from Macon.” Brandon stated he was simply turning around on Ferguson St. He stated he had made with a woman on Ferguson St. She said, “what up nephew.” Brandon added he spoke with her briefly before leaving the area. I asked him where he went after he left Ferguson St. He said Walmart before dropping food off at his girlfriend’s house.
Brandon stated after he dropped the food off, he went to Sewell Cir. Park and was watching TikTok. He stated he heard gunshots while he was receiving a phone call from his brother. Brandon went on to say he rushed over believing something had happened. He said when he arrived on scene [VICTIM ] rushed at the car. Brandon went on to say he got out of the car with the Shadow Systems 9mm pistol in his hand. Brandon said he did not see [VICTIM ] with a weapon, so he put his gun down in the grass near the driveway. I asked Brandon how he knew [VICTIM ]. He stated he did not know him at all. I asked Brandon what he saw when he arrived on scene. He stated he saw [VICTIM ] arguing with his brother. He further stated he did not know what [VICTIM ] was doing but he looked aggressive.
I asked Brandon why he got out of the car. He stated he got out of the Mazda because he was “trying to figure out what was going on.” I asked Brandon if any shots were fired while he was on scene. He stated “I didn’t fire any shots” further adding his hands could be tested for gunshot residue. I asked Brandon how the Mazda got a bullet hole in it. He stated he did not know, adding he was not in the vehicle when it was damaged. He stated the vehicle was parked on an unknown road when it was shot.
After I finished speaking with Brandon, Deputy B. Durham informed me Airrick did not wish to answer any questions without his attorney present.
I made with [VICTIM ] in the back seat of Deputy Q. Ramsey’s patrol vehicle. I informed [VICTIM ] of the Miranda warning before asking if he would answer my questions without his attorney present, he said yes. I asked [VICTIM ] what had happened. He stated his neighbor ([700 BLOCK] Camellia Cir.) had thrown trash into his yard previously. [VICTIM ] stated he decided to throw the trash back into his neighbor’s yard. [VICTIM ] went on to say Airrick was outside and the two of them began to argue. He went on to say Airrick “brandished” a gun. [VICTIM ] stated he picked up a stick and threw it at Airrick. Airrick fired several rounds from the back step toward [VICTIM ]. [VICTIM ] stated the rounds struck the ground, and the side of his house. [VICTIM ] stated Airrick went inside his own after firing the rounds. He went on to say he threw things from his yard at the door in an attempt to break a window.
[VICTIM ] stated Airrick came back outside and said, “what you wanna do?” [VICTIM ] stated he told Airrick he wanted to “hit” (fight). He further instructed Airrick to come to the road and they could fight. [VICTIM ] said once he got to the road Brandon arrived in the Mazda. [VICTIM ] stated Brandon got out with a gun and pointed it at him. [VICTIM ] stated he got mad and moved toward Brandon. He went on to say Brandon backed into the yard when I arrived on scene. I asked [VICTIM ] if he believed he was going to be killed during the altercation. [VICTIM ] stated he did not believe Brandon “had it in him.” He went on to say if he did, Brandon could have easily killed him. I asked [VICTIM ] who the man was in the vehicle that had been parked in his yard. He explained it was his supervisor “T.”
I later observed two bullet holes in the side [VICTIM ]’s residence facing [700 BLOCK] Camellia Cir.
I returned to my patrol vehicle and made with Sergeant G. Pennycuff. I updated him with the addition information I had obtained. I further informed him I believed the gun Airrick had fired at [VICTIM ] was inside the residence. Sergeant G. Pennycuff informed me he would be en route to the scene.
I made with Qu’aneshia and asked her who stayed at the residence. She informed me Airrick, her daughter, and her. I asked how long she had stayed at the residence. She stated she had lived there for approximately three years. I asked how long Airrick had stayed there with her. She said about three months. She went on to say Airrick was not added to the lease and did not stay with her regularly. I asked Qu’aneshia if there were any firearms inside her house. She said she did not really know what happened, she just knew once she saw the “green thing” she went and got into the bath tub. I asked her if I could go inside and make sure there were none. She informed me there was nothing in her residence other than a “bb gun.” I again asked if I could her residence for firearms. She stated she was uncomfortable and did not understand what was going on. I explained the information I had obtained to Qu’aneshia before telling her I believed Airrick had a firearm inside her house. I asked if I could her residence for the firearm I believed was inside. Qu’aneshia avoided the question and did not answer.
Sergeant G. Pennycuff arrived on scene, and I informed him of the information I had obtained.
Sergeant G. Pennycuff made with Qu’aneshia. He confirmed Qu’aneshia was the one on the lease, she said yes. He asked her if the Mazda belonged to her boyfriend, she said no, further stating it was a rental car. Qu’aneshia stated she was the person who rented the Mazda, “for her birthday.” Sergeant G. Pennycuff asked Qu’aneshia if it was alright “he” was driving the vehicle. Qu’aneshia shifted in her chair as she asked “who was driving it” before stating no one had told her anything.
I asked her if she knew who was driving the car. She said she did not know. I asked her if she “knew the dude with the dreads.” Sha avoided the question stating she did not know who we had detained. I informed her that her boyfriend, neighbor, and the “man driving the Mazda” were all detained. I again asked her if she knew who was driving the rental car, she said yes. I asked who he was, she said “the one with the dreads right?” I asked if she knew his name. She again avoided the question looking toward the ground and leaning away from me in her chair. She asked me what his name was. I declined to answer, further informing her he had not been driving my rental car.
Sergeant G. Pennycuff informed Qu’aneshia her neighbor had been shot at and asked if she agreed with his statement. Qu’aneshia stated she did not know that. She went on to say [VICTIM ] had thrown a “hook thing” at her and her daughter. Qu’aneshia added she went inside and hid in the bath tub. Sergeant G. Pennycuff asked if she knew why [VICTIM ] would have thrown something at her, she again said she did not know. Qu’aneshia stated her daughter had run to the door and when she followed after her [VICTIM ] threw the sickle at them. Qu’aneshia again stated the only thing she knew was [VICTIM ] threw the “hook thing” at her. She went on to say she did not know who shot at who or have any other information to provide. Sergeant G. Pennycuff asked if we could her residence for the firearm. Qu’aneshia asked to have her attorney on the phone while we ed the residence. Sergeant G. Pennycuff informed her that was fine.
Sergeant G. Pennycuff, Qu’aneshia and I entered the residence. Once inside Qu’aneshia retrieved her phone and ed a person she claimed was her attorney. After speaking with the woman for a few moments Qu’aneshia consented to the of her residence.
Sergeant G. Pennycuff asked Qu’aneshia if she knew where Airrick had gone after coming back inside, she said no. Qu’aneshia again stated she did not know anything other than [VICTIM ] had thrown the sickle at her.
Sergeant G. Pennycuff and I began ing the kitchen area before moving into what appeared to be an extra bedroom and eventually into the master bedroom. Once inside the master bedroom Sergeant G. Pennycuff discovered a Glock 45 caliber pistol (Serial #AFZH588) in a drawer near the foot of the bed. The grip of the gun appeared to be wet and there was water on the barrel. Sergeant G. Pennycuff collected the pistol and will be submitting it into evidence. We exited the residence.
Sergeant G. Pennycuff collected the shell casings near the door. They will be submitted into evidence.
Based on the information obtained during the course of my investigation I will not be seeking warrants against [VICTIM ]. [VICTIM ] was released from Deputy Q. Ramsey’s patrol vehicle and the handcuffs were removed from his wrists. I instructed [VICTIM ] to stay away from [700 BLOCK] Camellia Cir. and to avoid any further with any of the residents.
Deputy B. Durham requested the on call wrecker service be en route to our location for the Mazda. Deputy Q. Ramsey remained on scene.
Deputy B. Durham transported Airrick to the Houston County Sheriff’s Office Detention Center (HCSODC). I transported Brandon to the HCSODC. Upon our arrival Booking Information Sheets, and Personal Property Forms were completed for both Airrick and Brandon.
Based on the information obtained during my investigation I will be seeking charges against Airrick, Brandon, and Qu’aneshia. I will be seeking warrants against Airrick for aggravated assault, reckless conduct, obstruction, tampering with evidence, cruelty to children, possession of a firearm during the commission of a crime, and criminal damage to property. I will be seeking warrants against Brandon for aggravated assault, possession of marijuana, driving while license suspended, failure to obey traffic control device, tampering with evidence, and possession of a firearm during the commission of a crime. I will also be seeking warrants against Qu’aneshia for obstruction and hindering the apprehension of a criminal.
The items collected from the Mazda will be submitted into evidence.
