On July 14, 2024
at 0916 hours, I met with [VICTIM ] at [3200 BLOCK] Peaks Circle in reference to a sexually explicit video that was posted on FaceBook by Victor Medina.
Ms. [VICTIM ] told me while going through FaceBook this morning, she found a video of her having sex with Mr. Medina. Ms. [VICTIM ] told me the video was on FaceBook for approximately 16 minutes and then was deleted. Ms. [VICTIM ] told me she screen recorded the video on her phone which shows Mr. Medina FaceBook name and the video itself.
Ms. [VICTIM ] told me she would show the video and I told her that was up to her if she wanted to show me a video. Ms. [VICTIM ] began the video which showed her face and at one point her breasts. The video is an obvious act of sexual activity. I told Ms. [VICTIM ] I have everything I need for the report and explained to her to save the video in case the district attorney would like a copy.
Ms. [VICTIM ] completed a witness statement and is attached to this report.
I ran Mr. Medina through GCIC/NCIC and he returned with three warrants out of Hall County. The current address on his license [4900 BLOCK] Tracey Lane, Oakwood, Georgia 30566.
Ms. [VICTIM ] told me Mr. Medina lives at [4900 BLOCK] Tracey Lane. Mr. Medina’s driver’s license returns to the same address along with the address on the warrant. Based on the information provided, it is believed Mr. Medina does in fact live at the address listed on his license and warrant.
Prior to making entry into the residence, we were met with resistance from other family members. Mr. Medina’s mother and another female were not cooperative along with the brother. At one point, the mother closed the door and locked it. She then unlocked the door and re-opened the door. I walked past the mother to begin ing for Mr. Medina along with other Hall County Deputies.
With the assistance of Hall County Sheriff’s Office, the warrant was served at the address. Mr. Medina was in a bedroom and had locked himself inside. He eventually opened the door and was taken into custody. Inside the bedroom were three phones. All three phones were taken for evidence and a warrant will be completed.
Mr. Medina’s brother was eventually arrested for obstruction and hindering apprehension by Hall County Sheriff’s Office.
I read Mr. Medina his Miranda Rights. Mr. Medina understood his rights and I asked him about the video that was posted on FaceBook. He told me Ms. [VICTIM ] has access to his phone and claims she is the one that posted the video. When asked what the password is to the phone that was “used to post the video”, he informed me he didn’t know the password. The phone was a black iPhone 11 with a broken case and cracked screen.
While enroute to the jail, Mr. Medina gave me permission to look at his settings on his phone after giving me the password. The only setting he was talking about, location services, you cannot turn the setting off for whatever reason. Mr. Medina continued by saying he wanted to press charges against Ms. [VICTIM ] because she violated a restraining order and denied posting the video. However, when I made with Mr. Medina inside the residence, I told him he was under arrest for the warrants out of Hall County and we needed to talk about a video that was posted on FaceBook. Mr. Medina then put his head down and seemed to know what I was talking about.
When asked for his password for his phone again so I can have it for the warrant, he refused to give it to me. BodyCam was on, so I was able to get the password anyway and put the phone in airplane mode.
The second phone was a black iPhone, unknown model, in a black case. This phone was not password protected. When I opened the phone to place it into airplane mode, the phone was on a pornographic website. The phone was placed in airplane mode.
The third phone was a black Motorola, unknown model. This phone is password protected and cannot put the phone in airplane mode without the password.
All three phones were placed in evidence.
Mr. Medina was handcuffed, checked for proper fit and double locked. He was placed in the backseat of my patrol car. He was transported to the Hall County Jail and released to on-duty deputies without incident.
BodyCam was on and appeared to be working properly. A copy of a property and evidence sheet with the phones listed was put into Mr. Medina’s paperwork at the jail.
Warrants were issued on Mr. Medina for Transmitting Sexually Explicit Videos/Photos.
