Discretion is advised.][NARRATIVE #1 on March 20, 2026]On 20 March 2026, at approximately 2300 hours, I, Officer Swinehart, 214, was dispatched to [200 BLOCK] Red Fox Hollow Rd in reference to a TPO (temporary protection order) violation. While en route dispatch advised there was a history of bond violation for the suspect that was on scene. Also while en route Officer Schoenholz, 215, advised to call her in reference to the previous incident that took place in December 2025.At approximately 2305 hours, myself, Officer Campbell, 220, and Officer Hughes, 217, arrived on scene and made contact with the suspect identified as Monica Abigail Lozano, DOB [REDACTED], Address [3300 BLOCK] Cove Overlook Dr Gainesville, Georgia 30501, who was in the back yard of the residence holding her daughter in her arms who was shivering and she didn’t have any shoes on or a jacket, that is fenced in with a chain link fence and had barbed wire across it, the two gates were located with chains, and had padlocks on them. When asked what she was doing at the residence she said “he was ignoring his daughter when she called him on her tablet”. Lozano started to cry and said “please don’t do this”.Currently, myself, and Officer Campbell were trying to help Lozano and her daughter [VICTIM #1], DOB [REDACTED], get back over the fence without anyone getting hurt. Officer Hughes took [VICTIM #1] to her father that was in the residence, then Officer Campbell escorted Lozano to my patrol car while I went back around the residence to climb over the fence.At approximately 2316 hours, I interviewed Lozano, she said that her daughter was trying to call her father identified as [VICTIM #2], DOB [REDACTED], and he wasn’t answering her, so she came here to find out what was going on. I advised her it was part of her bond conditions and she knew she wasn’t suppose to be at the location or have any contact with [VICTIM #2] or be on Red Fox Hollow Rd.At this time, Lozano was advised she was going to jail for Aggravated stalking, Criminal trespass, and Violation of bond conditions. I advised her to turn around and place her hand behind her back. I then placed Lozano in double hand cuffs due to her body frame, checking for proper fitness then double locking them. I placed her in the rear of my patrol car with a safety belt in place for safe transport. She asked if she could call her mother, and I got her phone for her to call her and see on the recent call history, she dialed [REDACTED], which is [VICTIM #2]’s phone number.I asked her about blocking her number to call him and she didn’t say anything. She called her mother and told her she was going to jail. Her mother advised she would be coming to the house to get her granddaughter and I advised her she was with her father and if he didn’t want her to go then she couldn’t take her. I also advised her if there was any issues then she would be trespassed from the location.At approximately 2326, I interviewed [VICTIM #2], who stated Lozano was banging on the door and climbed over the fence and went into the back yard to knock on the back door. He stated his daughter could stay with him and asked if he could get her tablet out of Lozano’s car. He also stated she didn’t have any shoes. I asked him if, him and the ex-mother in law got along and he stated the relationship wasn’t that great. He didn’t decline for her to come to the residence but I did tell him if there were any issues to just call and we would come out and address it.I returned to my patrol car and asked Lozano if I could retrieve the tablet from the car and shoes for her daughter and she stated I could. I advised her the car would be towed but she was able to call a friend to come and get it. I issued Lozano a Criminal Trespass. The tablet and shoes were handed to [VICTIM #2] and [VICTIM #1] came to my patrol car to tell her mother bye then returned to her father.Lozano was transported to the Habersham County jail where she was turned over to jail staff without incident. Back seat clear of any contraband.A follow up with [VICTIM #2] will be conducted on 21 March 2026.[End of Narrative][NARRATIVE #2 on March 21, 2026]On 21st of March 2026, at approximately 1758 hours, I conducted a follow up with [VICTIM #2] at [200 BLOCK] Red Fox Hollow Rd. I advised him that she was given a criminal trespass and gave him a copy as well with our case number for the incident that took place. He asked if she had been released and I advised no that I haven’t spoke with the judge about the charges.I then asked him if he remembered if a blocked number called him last night and he advised he did not answer because he didn’t know who it was. I advised him it was her that she had blocked her number so he didn’t know it was her calling. He then asked what he needed to do to get custody of his daughter and I advised him that he would need to go to the court house and file for emergency custody. He also advised he works out of town through the week and home on weekends and that his daughter would be with his mother.I asked if he had any issues after we left and he said he called dispatch about an hour after we left because his daughter didn’t want to go with her grandmother and she told him he needed to drop the charges and he said he told her he didn’t press charges on her but it was the cops. I advised him if there were any other issues to just call and we would respond. I then told him he could get a copy of the police report from the police department to have to go to court with to file for custody of the child.[End of Narrative].
