Discretion is advised.]On 11/03/2025 approximately 2305 hours, I Deputy Coffey responded to the Habersham County Sheriff Office in reference to a walk in report.Upon my arrival I met with the complainant [REDACTED BY AGENYC] in the front lobby. [REDACTED BY AGENYC] stated that she needed to speak to me in reference to making a report about her [REDACTED BY AGENYC] being touched in a sexual manner inappropriately by a 50 year old man at [REDACTED BY AGENYC] Clarkesville GA. [REDACTED BY AGENYC] stated that [REDACTED BY AGENYC] also with her waiting in her vehicle outside. I asked [REDACTED BY AGENYC] to go ahead and get [REDACTED BY AGENYC] to come in with her so that we could talk in a more quiet and private setting.[REDACTED BY AGENYC] followed me into the patrol room where she and [REDACTED BY AGENYC] started to explain what happened….[REDACTED BY AGENYC] stated that he had been talking to a man “Later Identified as Michael Shane Foster” over the phone via facetime video for about a little over a month that he had met through his family member [REDACTED BY AGENYC]. [REDACTED BY AGENYC] said that he has had a lot of conversations with “Shane” and that Shane would call him all the time to talk. [REDACTED BY AGENYC] said that Shane had asked him to come to Florida multiple times to see him and spend some time with him. [REDACTED BY AGENYC] stated that the frequent late night conversations were not really sexual towards [REDACTED BY AGENYC] but Shane would tell [REDACTED BY AGENYC] that he was attractive and that he thought [REDACTED BY AGENYC] was “Hot”. [REDACTED BY AGENYC] stated that Shane would tell him that he “Shane” was Gay “Homosexual” and talked about how he enjoyed being gay.[REDACTED BY AGENYC] then talked about how his family member [REDACTED BY AGENYC] about Shane and talking to him soo much, because she believed that Shane was “Grooming” him and trying to get close to him in a sexual way. [REDACTED BY AGENYC] stated that [REDACTED BY AGENYC] even cussed Shane out over the phone before over this and told Shane to leave [REDACTED BY AGENYC] alone. [REDACTED BY AGENYC] stated that he continued to talk with Shane on facetime, and Shane would tell him that he really wanted to come see [REDACTED BY AGENYC] when he got the chance. However [REDACTED BY AGENYC] was always at the house watching [REDACTED BY AGENYC] worked and she didn’t like the idea of Shane being around [REDACTED BY AGENYC]. Around Mid October 2025 [REDACTED BY AGENYC] was put in Jail in Habersham County. It was at this time that Shane found out [REDACTED BY AGENYC] was in Jail and really wanted to come see [REDACTED BY AGENYC] even more…On Friday October 31st, Shane boarded an airline from Florida that someone else purchased for him, and came to visit with [REDACTED BY AGENYC] and other Family Shane has in the area. [REDACTED BY AGENYC] stated that Shane acted normal the first day he was there, but then started acting really weird like he was on drugs on the second day. [REDACTED BY AGENYC] stated that he never saw Shane act so weird before and it kind of scared him.On Sunday that same weekend, [REDACTED BY AGENYC] said that he was laying in his bed watching TV when Shane came in the room and sat on the end of the bed talking to him. [REDACTED BY AGENYC] said that it was about 7:00pm when his [REDACTED BY AGENYC] had left to go to the Movies when Shane came in the room. [REDACTED BY AGENYC] stated that Shane was talking to him and kept scooting up on the bed getting closer and closer to him and ended up laying right beside him, and Shane put his arm around him across his shoulder around the back of his neck, and was basically cuddled up to him. [REDACTED BY AGENYC] said that he was afraid and did not feel right about it and did really want Shane touching him and [REDACTED BY AGENYC] was scared.I asked [REDACTED BY AGENYC] what he did when Shane put his arm around him, and [REDACTED BY AGENYC] stated that he was afraid to move because Shane is a big guy and he didn’t want to make him mad and have to fight him. He was just too scared to do anything in fear of Shane’s reaction. [REDACTED BY AGENYC] said that Shane then pulled his arm away from it being on his shoulder and reached down to his private area and was touching [REDACTED BY AGENYC] P*nis through his pants groping him, touching him inappropriately when [REDACTED BY AGENYC] then got up and moved away from Shane. [REDACTED BY AGENYC] said that shane then left the bedroom and he could hear shane messing around with things in the house and getting kind of loud. [REDACTED BY AGENYC] said that it really upset him and he was scared to say anything to Shane and went to bed.The next morning, Monday November 3rd, [REDACTED BY AGENYC] stated that [REDACTED BY AGENYC] was up and ready to go to school and really wanted to get to school that morning. [REDACTED BY AGENYC] stated that this behavior was very odd and out of character for [REDACTED BY AGENYC], as she is always having to make him go to school because he hates going. She stated that she knew something was very off balance and felt something weird had happened and had that uneasy feeling.[REDACTED BY AGENYC] went to School that morning, and stated that after his 1st period class, he asked to go speak to the principal. [REDACTED BY AGENYC] said that he spoke to his principal Mrs. [REDACTED] and told her what had happened that previous night. [REDACTED BY AGENYC] said that he just really felt like he needed to tell someone what happened because he felt really scared and confused. Mrs [REDACTED] contacted [REDACTED BY AGENYC] and explained what [REDACTED BY AGENYC] had said and spoke to [REDACTED BY AGENYC] about the incident, then called Department of Family and children services to get involved. DFACS met with [REDACTED BY AGENYC] and [REDACTED BY AGENYC] and after they were finished, [REDACTED BY AGENYC] to the Sheriff Office to file this report…I then asked [REDACTED BY AGENYC] to fill out a witness statement with all this information she and [REDACTED BY AGENYC] provided to me at which she did, and she wrote it all down for [REDACTED BY AGENYC]. I asked [REDACTED BY AGENYC] if Shane was still at the house on [REDACTED BY AGENYC] Rd, which she and [REDACTED BY AGENYC] stated that they didn’t think so, that Shane supposedly got a ride to Atlanta to get back on a flight to go back to Florida.At this time, I contacted my shift Lieutenant and told him what the complaint was, and he advised me to inform the on-call investigator to inform them as well, at which I did. Investigator Jason East called me and I explained the incident to him, and he suggested that before [REDACTED BY AGENYC] leave the office, to have patrol drive over to the residence on [REDACTED BY AGENYC]. to check and make sure that Shane was not there.I contacted my shift supervisor and asked him to check the residence at [REDACTED BY AGENYC], at which he and the patrol Deputies did, and they found Shane there at the residence. Once they Made contact with Shane, they asked him if he would voluntarily come to the Sheriff Office to speak with Investigator East, at which he agreed and was given a ride to the Sheriff Office where I met Shane and awaited Investigator East to arrive to conduct an interview.Upon arrival Investigator East was briefed by me and given the witness statements. At this time Shane was taken into the Investigators trailer and had a seat in the interview room where Investigator East spoke with Shane and interviewed him.
