I made with [WITNESS ] who stated around 1720 hours a black male wearing a black hoodie, grey shirt and pants came into his restaurant to use the restroom.[WITNESS ] stated that he recognized the male being the male that came and used the restroom at closing a couple days prior. [WITNESS ] approached the male as he was trying to enter the restroom and told the male that the restroom was only for paying customers. The male stated to [WITNESS ] “this is a public restroom” in which [WITNESS ] stated that it was not and that he could not use it. [WITNESS ] stated that the male then went around him and into the restroom where he pulled his pants down showing his genitals and stated “I’m using this bathroom.”[WITNESS ] was able to provide video footage of the male entering the restaurant and a photo of the male. Stogner 50 responded to Srg. Sparks 88 who was making with the offender of this case on the corner of Gloucester Street and Amhearst Street. The male was a black male wearing a grey shirt, light blue jeans and a black hoodie which fit the description given by [WITNESS ].The male was identified as Tobiaus Rashaun Evans and was handcuffed which were double locked and checked for tightness. The male was then placed in the rear of my patrol vehicle where he was later transported to the CDC.[End of Narrative].
