On 10/17/24 I (Cpl. White) responded to a verbal domestic dispute along with Cpl. Sawyer. Dispatch advised the parties were separated at the time of the 911 call. I responded non emergency. When we arrived I activated my bodycamera. We were able to speak to the victim/complainant ([VICTIM ]) and the juvenile witness (juvenile [WITNESS ]). They advised that shortly before [VICTIM ] called 911 for help he and his girlfriend/offender (Elvira Guzman) were at their residence (incident location) and got into an argument. Due to a language barrier the juvenile witness had to translate. He advised that she thought that he was talking to someone he “was not suppose to” and believed he might be cheating. They began to aruge and yell back and forth. [VICTIM ] advised that he had a black Iphone 15 Pro Max in his hand and even though it did not have any service time on it he could still use it to call 911 for help. [VICTIM ] stated that he did call 911 for help with that phone and during the conversation when [VICTIM ] was requesting help through 911 Ms. Guzman physically took the phone away from him and hung the phone up preventing him from completing his requested call for help.
I was able to speak to the juvenile and during the conversation and based on a previous calls to this address with the same parties I knew that [VICTIM ] and Ms. Guzman have lived at the incident location for two years together as boyfriend and girlfriend and the juvenile [WITNESS ] was Ms. Guzman’s son. While speaking to the juvenile he confirmed [VICTIM ]’s story adding that he walked into the living room after hearing them starting to argue. He advised that he got something to eat and went back into his room. He stated that he came back out of his room when he heard the yelling getting louder and witnessed his mother (Ms. Guzman) take the phone away from [VICTIM ] while he was on the phone with 911 operator. I could tell the juvenile was visibly upset while speaking with me however, due to previous calls I have known him to be honest when it came to his witness testimony on both involved parties.
While speaking to the parties they both advised that after Ms. Guzman took the phone away from [VICTIM ], she hung up the phone and left the residence in a 2008 red Ford SUV vehicle. While speaking to the parties we were able to observe the mentioned vehicle pull into the driveway and I was able to confirm as well as the parties stating that this was Ms. Guzman who arrived back at the residence. Ms. Guzman exited the vehicle and I was able to speak with her through translation with the juvenile son once more. I asked Ms. Guzman what she and her husband was arguing about. She stated at first, nothing and then changed her statement to they were aruging over [VICTIM ] being on the phone and she thought that he was talking to someone and possibly cheating. I asked her how she came into possession of [VICTIM ]’s black Iphone and she stated that she took it from him. I asked her was he using the phone when she took the phone away from him and she stated, yes he was. I asked why she did that and she once again stated that she wanted to know who he was talking to. Once she discovered who it was, she hung the phone up and left the residence with [VICTIM ]’s phone in her possession.
