Discretion is advised.][NARRATIVE on March 02, 2025]On March 2, 2025at approximately 2346 hours, I (PFC Blankenship) was dispatched to [100 BLOCK] S. Sycamore St in reference to a physical domestic where the caller advised that her husband, Jose Chavez Cruz had attempted to choke her–[VICTIM ].Upon arrival, I first spoke with Jose while OFC Davis spoke with the other family members (see supplemental). Jose told me that he and his wife had a fight and that it began because she had told him that she was with another man. He was angry about this and advised it was the main reason the altercation had started. When I asked him if he had hit his wife or tried to choke her, he advised no that he had only pushed her. While speaking with Jose, I observed no physical marks on him. I did observe the strong odor of an alcoholic beverage on his breath and observed that his eyes appeared watery. I asked him how much he had to drink and he advised two beers and then pointed to an open beer on the floor next to an open carton of beers.I then briefly spoke with the 14 year old son, [REDACTED BY AGENCY] who advised me that he had seen his father choking his mother. I then placed Jose into handcuffs, fit and double locked, and had him stand apart from his family with OFC Davis.I then interviewed the other family members separately.I spoke with [VICTIM ] who was still visibly shaking and clutching her bathrobe around her person when I spoke with her apart from her children. She advised me that she and her husband are separated, but that she was allowing him to sleep there while he figured out where to live. She told me that she had told Jose that she was seeing another man (she advised me that she is not) in hopes that he would give up and leave the to move on with his life. She said that he had become angry and eventually he came into her bedroom (where he does not sleep) and got on top of her and grabbed a hold of her by placing his hand around her throat. She told me that she was able to still breathe during this encounter, but that she believed that he meant to strangle her. She was in fear for her life and advised that the look on his face scared her to where she believed he meant to severely harm her.[VICTIM ] advised that her 9 year old daughter, [REDACTED BY AGENCY] was laying in bed beside her and when Jose got on her and started to choke her–[REDACTED BY AGENCY] She advise that Jose only stopped when [REDACTED BY AGENCY] was calling the police and pulling him off of her. He advised that [REDACTED BY AGENCY] told me that his younger brother, [REDACTED BY AGENCY] had been asleep prior to and through the altercation and had not witnessed anything.I then placed Jose under arrest, ed him incident to arrest, and placed him in the back of my patrol vehicle. I transported him to the Floyd County Jail where he was booked in on Aggravated Assault FVA, Battery FVA, and Cruelty to Children 3rd x2. A victim notification was filled out for [VICTIM ] and she was advised on Eviction and TPO procedures.Pictures were taken of [VICTIM ]’s neck where visible redness was observed in a line beneath her jawline and more prevalent on the left side. I also observed a raised, red welt on the left side of her neck. [VICTIM ] advised that she had had no marks on her previous to the altercation and that the redness and the welt were new. We arrived and Officer Blankenship talked to Mr. Chavez in the living room, and I talked to [VICTIM ], [REDACTED BY AGENCY] and [REDACTED BY AGENCY], the children of [VICTIM ] and Jose, in the kitchen.[SECTION REDACTED BY AGENCY][REDACTED BY AGENCY] and [REDACTED BY AGENCY] were both physically shaken. [REDACTED BY AGENCY] I looked at [VICTIM ]’s neck. There was a red mark on the left side of her neck beneath her jaw line.
