On Friday, December 20, 2024
I was dispatched to the area of Veterans Memorial Hwy and New Calhoun Hwy in reference to a vehicle wreck. Upon my arrival I observed a white 2015 Nissan Altima (Tag: [REDACTED]) and black 2022 Chevrolet Silverado (Tag: [REDACTED]) that appeared to be involved in the wreck.
I made with the driver of the Altima, Ms Ashley Nails. She advised that she was not hurt. I then made with the driver of the Silverado, Mr [REDACTED], who also stated her was unharmed. During the course of my investigation I determined that Ms Nails’ vehicle did not have valid insurance. At that time I informed her that her vehicle would be towed and she needed to call someone to get her. Ms Nails informed me that her husband, Mr Henry Nails, was en route. She advised that she did not know if his vehicle had insurance either. Once Mr Nails arrived on scene in a black 2013 Ford Lgt (Tag: [REDACTED]) I ran his tag through NCIC to verify the vehicle’s insurance status. The vehicle also returned as uninsured.
At that time I informed Mr Nails that his vehicle would also have to be towed and he would be receiving a citation for driving without insurance. He became very upset and began using foul language and yelling at Ms Nails across two lanes of traffic. Mr Nails stated that he was going to take his niece and walk to a relatives house approximately one or two miles away. I observed that the child did not have a coat and the temperature was below 50 degrees. I informed Mr Nails that his wife had already ed someone else to pick them up and to wait on scene until he had been issued his citation. Mr Nails stated that they would walk, took the child out of the vehicle, and acted like he was going to leave the scene. The child advised me that she was already cold at that time. I told Mr Nails he was not to leave the scene. He allowed the child to wait in the vehicle but became more agitated. He repeatedly used foul language that could be heard across the highway. He also cussed at Ms Nails and told her that she should go to jail causing her to become very upset.
At that time I advised Mr Nails to stop yelling, cussing, and attempting to start a fight with Ms Nails. He stopped at that time and I issued Mr Nails his citation. As soon as I walked away Mr Nails began to yell using foul language and could be heard across two lanes of traffic on the highway. At that time I placed Mr Nails under arrest. PFC White ed him for contraband and none was found. He was then placed in the rear of squad car 146. I issued Ms Nails her citations and both vehicles were towed from the scene by G&W. I then transported Mr Nails to Floyd County Jail where he continued to behave in a disorderly manner, refusing to follow lawful orders, and using foul language and gestures. Mr Nails was booked for driving without insurance and disorderly conduct.
