CHEROKEE COUNTY, Ga. – A Woodstock man has been convicted of rape after a secretly recorded confession helped seal the case, prosecutors announced Wednesday.

Nicholas J. Mittenmeyer, 45, was found guilty on March 21 of rape, aggravated assault under the Family Violence Act, and false imprisonment, following a five-day trial, according to the Blue Ridge Judicial Circuit District Attorney’s Office.

The investigation began in June 2023 when a woman reported being sexually assaulted at a residence in Woodstock. Authorities said Mittenmeyer and the victim had previously been in a relationship that ended two years prior, though the two had remained in contact.

According to prosecutors, Mittenmeyer pressured the woman into sex, and when she declined, he forcibly assaulted her. Concerned that her report might not be taken seriously due to their prior relationship, she did not immediately contact authorities.

Instead, she later confronted Mittenmeyer and recorded the conversation, during which he admitted to the assault and apologized. That recording became a key piece of evidence during the trial.

Twelve witnesses, including the victim, testified, and prosecutors submitted 26 pieces of evidence—including photos of injuries from prior incidents and the audio confession.

Sentencing for Mittenmeyer will be scheduled at a later date.
