On 12/20/2024
at approximately 0021 hours, I, D/S N. Wheat, initiated a traffic stop at the 52 mile marker of I85 south on a black Mercedes E350 W bearing GA temporary tag of [REDACTED] for speeding.
While patrolling the area of Interstate 85 around the 56 marker south. I observed a vehicle traveling at a higher rate of speed than other vehicles, I estimated the vehicle to be traveling about 90 MPH as it was traveling away from me. I was running same direction front radar with my Eagle 3 Radar unit that was checked for accuracy at approximately 04:20 PM this date. The readout displayed 91 miles per hour in a posted 70mph zone and I locked it in. I then attempted to catch up to the vehicle and as I did, I initiated a traffic stop by turning on my emergency lights and siren. After the vehicle changed lanes to the far right lane and eventually came to a stop in the emergency lane. I advised the tag to 911 and then I exited my vehicle. I started to walk toward the Mercedes and the driver, later identified as Gabino Cerpas, took his foot off the brake and initiated a vehicle pursuit by accelerating away from the traffic stop.
I got back into my vehicle and attempted to catch up to the vehicle. Traffic was light to moderate at times and it was cloudy. The vehicle continued at speeds over 120 miles per hour south on the Interstate and took exit 51 onto GA 154. The driver turned left to go south on GA 154. The vehicle then passed another vehicle and struck the vehicle with its front driver side to the front passenger side of a Honda Van bearing GA tag of [REDACTED]. Gabino continued driving and turned onto exit 51 on ramp north bound and left the scene of the accident. I continued to pursue onto Interstate 85 north bound. I reached speeds higher that 140 in an attempt to catch the vehicle and the vehicle stayed in the 2 far right lanes. We continued until exit 61 where I attempted to perform a Precision Immobilization Technique. I was unsuccessful and Gabino pulled over at mile marker 62.
A felony stop was conducted and we were able to place Gabino and his two passengers in custody. The front seat passenger was Jose Guzman Hernandez and the rear passenger was Oswaldo Roberto Ramirez.
I conducted a vehicle inventory/ due to the odor of marijuana and located a small bag of suspected marijuana in the rear driver side floorboard in a gray bag. The bag also had a red grinder that has residue of marijuana inside. The bag of marijuana and grinder will be placed into evidence. The front driver seat had a compartment under the seat and inside it was a small bag of suspected marijuana. It also contained a small white round container containing a white paste like substance suspected to be THC wax due to the packaging stating that it was greater than 77% THC. Both will be placed into evidence.
I read Gabino Miranda and asked if he would like to speak to me and he refused. I then read Jose Miranda and asked if he would like to speak to me and he agreed. I asked him about the marijuana and grinder located in the gray bag in the rear passenger floorboard. Jose advised me that he did not know anything about it. I then walked back to Oswaldo and began to read him Miranda and he advised me he did not speak Spanish.
Next list wrecker was started for the vehicle and it was Baxters. Sgt. T. Thompson was on scene and turned the vehicle over Baxters. D/S T. Wood and I transported all three subjects to get cleared for jail at Piedmont Newnan Hospital to get cleared for jail.
I then came to Coweta County Jail to continue paperwork. All three subjects were cleared from Piedmont Newnan and D/S T. Wood and Sgt. T. Thompson transported all three subjects to the Coweta County Jail and they were turned over to jail staff with no further incident. BWC was activated for these events.
While preparing the evidence, the suspected THC wax was field tested for CBD or THC and it had a negative reaction to both on two attempts. I then field tested the wax with a multi drug field test kit and it showed a positive reaction for meth/amphetamines. The suspected meth/amphetamine will be sent to the GBI for analysis.
I am charging Gabino with Felony Fleeing/Attempting to Elude Officers, Speeding, Reckless Driving, Hit and Run, possession of methamphetamine, possession of marijuana less than 1 oz, and possession of drug related objects.
I am charging Oswaldo and Jose with possession of marijuana less than 1 oz and possession of drug related objects.
