On 10/15/2024 I, D.S. Wood, responded to D.S. T. Lamb in reference to him being out with a possible impaired driver. Once on scene D.S. Lamb advised me that he observed the truck displaying tag #[REDACTED] driving south on Highway 154 without its lights on. He stated that he caught up to the vehicle and activated his emergency equipment to get the vehicle stopped.
He stated that once he was finally able to get the vehicle stopped he made contact with the driver, Johanna Fleetwood, and advised her of the reason for the stop. He stated that while talking to her he noticed the strong odor of an alcoholic beverage coming from inside the vehicle. He stated that was when he got her out of the vehicle and called for me to come and meet with him.
I walked up to where Johanna was and noticed that she had thick slurred speech while talking. I noticed that she also had the strong odor of an alcoholic beverage coming from her breath. I asked her where she was coming from and she stated her house in Union City and that she was taking the kids bowling in Newnan. I asked her if she had any alcoholic beverages to drink and she stated no.
I then advised her that I was going to make sure that she was safe to drive due to the odor and placed her in the starting position to check for Horizontal Gaze Nystagmus. I started by checking her for medical clearance and then observed the following clues. Lack of Smooth Pursuit 2 clues, Distinct and Sustained Nystagmus at maximum Deviation 2 clues, and Onset of Nystagmus Prior to 45 degrees 2 clues for a total of 6 out of 6 possible clues. I also observed that Vertical Gaze Nystagmus was present.
I then placed her in the starting position for the Walk and Turn assessment. I explained what I wanted her to do then demonstrated it. I asked her if she had any questions and advised her to begin when ready. I observed the following clues during the assessment. Starts too Soon, Unable to maintain starting position, misses heel to toe, steps off line, uses arms for balance, stops while walking, improper turn, incorrect number of steps for a total of 8 out of 8 possible clues. While walking Johanna walked 13 steps in one direction and did not turn to walk the 9 heel to toe steps back. She also stopped walking after she started the first pass to go back and attempt to start over.
I then placed her in the starting position for the One Leg Stand assessment. I explained what I wanted her to do and then demonstrated it. I asked her if she had any questions and advised her that she could begin when she was ready. I observed the following clues uses arms for balance, sways, and puts foot down for a total of 3 out of 4 possible clues. During this assessment she kept picking her foot up and putting it down multiple times.
Based on all the clues I observed I placed Johanna in handcuffs and advised her that she was under arrest for DUI. I read her the Georgia implied consent notice for suspects age 21 and over where I asked for the state administered test of her breath and she stated yes. I then placed her in the back seat of my vehicle and D.S. Lamb waited with the children to make sure they were picked up by a legal guardian. I then transported Johanna to the Coweta County Jail where the state breath test could be completed on the Intox 9000. I attempted the test the first time and Johanna would not give a complete sample and the test timed out with an insufficent sample.
I set the Intox 9000 up again andhad her give another sample the first attempt she did the test correctly and the machine was able to get a valid reading. The second sample Johanna would start to blow into the machine and then stop. She did this numerous times and the machine timed out and gave a insufficent sample. Due to Johanna giving a valid breath sample the first time the machine was able to get a valid reading and showed a test result of 0.240.
Once the test was complete Johanna was turned over to jail staff for procesing. Johanna was charged with DUI over a 0.08, DUI Child Endangerment for having [REDACTED BY AGENCY] D.O.B [REDACTED BY AGENCY]/2011 in the front passenger seat, DUI Child Endangerment for having [REDACTED BY AGENCY] D.O.B [REDACTED BY AGENCY]/2012, and Driving without her headlights on at night. Johanna also had another child in the vehicle [REDACTED BY AGENCY] D.O.B. [REDACTED BY AGENCY]/2010. D.S. Lamb will be completing a supplement on what he observed before I arrived at the stop. [REDACTED BY AGENCY] and [REDACTED BY AGENCY] where picked up by their parents and [REDACTED BY AGENCY] was picked up by her mother. The vehicle was turned over to a licensed driver that was approved by Johanna. I also completed a DDS 1205 form on Johanna due to the Intox reading being over a 0.08 and took her license which will be turned into the state.
