Discretion is advised.]On May 2nd, 2025, at 1909 hours I was dispatched to 4337 Cobb Parkway at the RaceTrac in reference to an assault. Dispatch advised the complainant stated someone had punched him in the parking lot. Dispatch further advised the perpetrator was driving a silver Toyota Corolla. Upon my arrival I met with [VICTIM #1], the complainant.[VICTIM #1] told me that he arrived at RaceTrac in his truck. When he got out of his truck and began walking to the front of the store a Toyota Corolla arrived next to his truck and the driver, a black male, had called out toward him. [VICTIM #1] said that he could not understand what the driver was saying. He said it was along the lines of, “if you play that again I’ll-“. [VICTIM #1] walked to the vehicle and thought that the driver just wanted to speak to him about something. The driver allegedly used racial slurs against [VICTIM #1]. [VICTIM #1] argued back and asked the driver what he meant. Allegedly the driver told [VICTIM #1] that he would shoot him and said, “let me show you.” [VICTIM #1] said he then noticed the driver using his right arm and reached in between the seat and the center console. He said the driver hesitated for a moment and then grabbed his phone with his right arm then suddenly used his left arm to hit him in the face. I observed [VICTIM #1]’s left side of his face swollen, particularly around his eye.[VICTIM #1] then said he kicked at the driver’s side door. The male driver then drove his car away and [VICTIM #1] followed around a corner of the parking lot and kicked the Toyota Corolla again. [VICTIM #1] then stated he saw the Toyota Corolla make a U-turn, instead of going out either two exits available, and came speeding at him. The Toyota Corolla then tried to strike [VICTIM #1]. The Toyota corolla made a U-turn around the gas pumps, then drove on the lefthand side of the parking lot and almost hit [VICTIM #1] again before exiting the RaceTrac and continuing southbound on Cobb Parkway.Corporal Lumpkin was able to view and obtain video surveillance of the incident and show me. In the video I confirmed what [VICTIM #1] told me. [VICTIM #1] is seen walking up to the vehicle and conversing with the driver. [VICTIM #1] is then struck in the face by the driver’s left hand, and the Toyota Corolla begins to drive away as [VICTIM #1] kicks at the car the first time. I then observe [VICTIM #1] chase the car and stop in the middle of the road, watching the Corolla make a U-turn. I then observed the Corolla almost strike [VICTIM #1] at a high rate of speed in the parking lot. [VICTIM #1] is seen in the video trying to avoid the car and escaping narrowly. The vehicle is then observed making another turn and drives on the left side of the parking lot. [VICTIM #1] is at this point standing on the sidewalk and has his phone, calling emergency services. The Corolla passes [VICTIM #1] again, very closely, and exits the RaceTrac.I asked if he had known the driver of the vehicle. [VICTIM #1] said no. I asked if he had noticed anyone following him or trying to get his attention on the road. [VICTIM #1] said no. [VICTIM #1] gave me a description of a younger black male who was tall and had sunglasses on. The male had a beard and short black hair. [VICTIM #1] believed that the incident may have started due to him playing Arabic music in his truck while driving and the male became irritated.I gave [VICTIM #1] a case card in reference to the incident. [VICTIM #1] left the scene and Officers worked to identify the vehicle and the driver. Corporal Lumpkin found a vehicle on FLOCK cameras going southbound on Cobb Parkway and Lake Acworth Drive. The vehicle was a 2017 Toyota Corolla, silver in color with registration tag [REDACTED]. The vehicle matched the photos and videos captured by the video surveillance footage. It was registered to an [REDACTED] subject. Utilizing P2P and the address of the registered owner we located an Ogochukwu Ibenyenwa subject matching the description given by [VICTIM #1].I went to the address of Ogochukwu and found the Toyota Corolla parked in the driveway backed in. I then called [VICTIM #1] and asked if he would meet with me at a Marathon gas station. I met with [VICTIM #1] and showed him a driver’s license picture of Ogochukwu and asked if it was familiar. [VICTIM #1] stated he was not sure and was only about 80%-85% sure it could be him. Given this I decided I would go to the residence myself and try to locate the driver and speak with the residents. Officer Turner, a Paulding County Deputy, and I went to the residence. As I was walking up to the front door, I noticed a footprint of dirt and mud on the driver’s side of the parked Toyota Corolla, pictures were taken. I then made with Ogochukwu and his mother.I asked him what had occurred since we had a witness say they had seen someone kick his car. Ogochukwu confirmed and pointed at the Corolla in the driveway and said that it was his car, and someone had kicked it hard. Officer Turner asked what had occurred. Ogochukwu said that he had gotten into an argument with a male, and he ended up kicking his car. I asked what the argument was about. Ogochukwu said it was about nothing and that he said a few words to him and kicked his car. He said that he tried to drive off and the man kept taunting him and kicking his car. Ogochukwu was able to describe [VICTIM #1] and what he was wearing to me after I told him we were looking for him (we were not). Officer Turner then called Ogochukwu over to his vehicle to point out damages.Once Ogochukwu pointed out the location of the damage that was on the passenger side of the vehicle, I made the decision to place him under arrest for Aggravated Assault. I placed him in handcuffs, double locking and ensuring they were fitted correctly. I informed Ogochukwu on what was happening and did not ask any incriminating questions. Ogochukwu spontaneously uttered that it was [VICTIM #1] who threatened to kill him before placing him into the backseat of my patrol vehicle and buckled a seatbelt around him.I drove to the RaceTrac of the incident location and met with PSL Reaid. Before turning him over for transportation I read Ogochukwu the Miranda Warning. Once I asked if he would like to speak with me and give me a statement, he stated no, and I transferred custody over to PSL Reaid. PSL Reaid transported Ogochukwu to the Cobb County Jail and booked him inside.I then applied for and obtained a warrant on Ogochukwu for Aggravated Assault (O.C.G.A. 16-5-21), Battery (O.C.G.A. 16-5-23.1), Reckless Driving (O.C.G.A. 40-6-390), and Driving on a Suspended License (O.C.G.A. 40-5-121) with warrant number 25-W-3626. Ogochukwu started the incident by stopping his Corolla and speaking to [VICTIM #1]. Ogochukwu escalated the situation when he struck [VICTIM #1] in the face. [VICTIM #1]s response to being attacked was the kicking of Ogochukwu’s vehicle. Ogochukwu escalated further when he attempted to hit [VICTIM #1] using his vehicle as a weapon.
