On September 1, 2024, at 7:19 pm, I was dispatched to a single-vehicle accident across the street from [400 BLOCK] Pinecrest Road. When I arrived, a Cherokee County Fire Department member was on the scene. He stated that he noticed a vehicle off the roadway which crashed into a utility pole. There wasn’t a driver on the scene when he arrived. He stated that the residence of [400 BLOCK] Pinecrest Road had witnessed the accident about thirty minutes prior. The vehicle that had crashed was a 2013 Subaru Legacy with GA License Plate [REDACTED]. The vehicle had extensive front-end damage on the passenger side of the vehicle. I made contact with [REDACTED], who lives at [400 BLOCK] Pinecrest Road. Mr. [REDACTED] stated that he didn’t see the accident, but his wife did. However, she wasn’t home at this time. Mr. [REDACTED] showed me video footage of the accident that was captured on his Ring doorbell camera. The footage showed the vehicle losing control and driving off the roadway, striking the utility pole. The video then stopped. I requested the video be sent to me via email.
I attempted to contact the vehicle’s registered owner (Christian Figueroa) via telephone but there was no answer. I left him a message so he could call me back.
Eventually, Mr. [REDACTED]’ wife arrived home. [WITNESS #1] stated that she was standing outside when she saw the vehicle leave the roadway and strike the utility pole. Mrs. [WITNESS #1] said that a larger male with a medium complexion and long hair got out of the vehicle and, moments later, got into a white SUV and left the scene. The description that Mrs. [WITNESS #1] gave matched the description of the information on Mr. Figueroa’s driver’s license.
While waiting for Georgia Power to secure the utility pole, Sgt. Sheehan attempted to make contact with Mr. Figueroa at his residence ([1500 BLOCK] Univeter Road, Canton, GA 30115), but there was no answer. Sgt. Sheehan also left Mr. Figueroa a voice message.
At around 11:00 pm, Sgt. Sheehan notified me that Mr. Figueroa’s stepmother had contacted him via telephone and agreed to bring him back to the accident scene. Once she arrived, I questioned Mr. Figueroa.
Mr. Figueroa stated that he was on his way home from getting food when he lost control of the vehicle and ran off the roadway, striking the utility pole. Mr. Figueroa said, moments later, his stepsister drove by, and he asked her to take him home, which she did. Mr. Figueroa stated that he was scared and shaken up from the accident, which is why he decided to leave the scene. Mr. Figueroa stated that he wasn’t injured, only shaken up. Mr. Figueroa said that he was afraid because he recently was involved in a different accident and thought his father would be upset because he is a strict parent.
Mr. Figueroa was placed under arrest without incident. Two sets of handcuffs were used due to his stature. The handcuffs were double-locked and checked for comfort. Mr. Figueroa was searched incident to arrest, but nothing of interest was found. Mr. Figueroa was placed in the rear of my patrol vehicle and transported to Cherokee County ADC without incident and released to Cherokee County Sheriff’s Office. The rear seat of my patrol was checked prior to and after transport, and no contraband was found. Ingram’s Towing impounded the vehicle.
