Officer’s Narrative:

on 07/28/24 I (Officer Gallaway) responded to [300 BLOCK] Lewis Dr. for a reported verbal disturbance. The call notes did not contain a building number as there were many buildings all with the address of [300 BLOCK] Lewis Dr.
I parked my patrol vehicle, and began walking by the buildings on foot, so I could listen for any verbal disturbance. Upon walking around several buildings I came to building #[REDACTED]. Standing outside of [REDACTED] I was able to hear a male voice shouting coming from inside and what sounded like a female crying. I was unable to make out what the male was shouting.
I loudly knocked on the front door and announced myself as police, I heard a female voice yell that I had to go to the back door. When I made my way to the back door a female came outside and stated that nothing was going on. A male in a white shirt later identified as Wayne Hamilton also advised me that nothing was going on. I told the male and the female to get out of the doorway so I could enter the residence and ensure everyone was ok. I entered the residence and found another Female later identified as [VICTIM ]. I told [VICTIM ] to exit the residence so I could speak to her without everyone yelling over each other. Upon walking out of the residence, CPL Roberson arrived on scene. I requested CPL Roberson speak to Wayne while I speak to [VICTIM ]. I brought [VICTIM ] to the front of the residence to separate her from Wayne while we spoke.
While speaking to [VICTIM ] she advised the following: She was currently visiting her friends house. Wayne was also visiting and was not a resident at this location. Wayne had previously given [VICTIM ] $50. Later Wayne demanded the money back and when [VICTIM ] was in the bathroom, Wayne ran in and strangled her. She stated that the reason he would do something like that is because he was on drugs. [VICTIM ] advised me that she was unable to breath during the time Wayne was strangling her. When asked to describe the pressure used on a scale of 1 to 10, [VICTIM ] informed me that it was an 8. I also inquired about the manner in which Wayne strangled her, and she informed me that he used Two hands around her neck. She stated that she was standing up, and slipped on water but did not fall down. [VICTIM ] advised that she remained unable to breath for roughly 2 to 3 seconds.
Upon speaking to [VICTIM ] it became more obvious that her voice sounded hoarse. She was asked if she always sounds that way when she speaks and she informed us that she does not typically have a hoarse sounding voice. On the right side of [VICTIM ]’s neck was a bruise that was visible upon close inspection.
After speaking with [VICTIM ], I then spoke with Wayne. He advised the following: Nothing really happened. They were arguing over some money, and he thought he was just playing around with [VICTIM ]. He stated that he gave her a hug and that’s all that really happened.
After speaking with Wayne I spoke with another female inside the household later identified as [WITNESS ], whom claimed to have witness the incident in the bathroom.
[WITNESS ] advised the following: Wayne had previously given [VICTIM ] money. When later he became upset with [VICTIM ] he tried to take the money back. When [VICTIM ] did not give the money back, Wayne began “jacking her up” for the money. When asked to clarify what she meant by “jacking her up” She stated that Wayne was putting her hands on [VICTIM ] and attempting to get the money out from [VICTIM ]’s bra.
Also inside the house was a Male by the name of [WITNESS ]. [WITNESS ] stated that he saw parts of the incident. I did not speak to [WITNESS ] regarding the incident, however by this time SGT. Baptiste had arrived on scene. She spoke with [WITNESS ], and later informed me that he made the same statement in reference to Wayne having been jacking [VICTIM ] up for the money.
Major Crime detectives were notified, but did not respond to the scene.
After speaking with everyone, Wayne was placed under arrest for Aggravated Assault due to strangling [VICTIM ]. I placed him in handcuffs, and I brought him over to my patrol vehicle. He was ed before he was placed in my vehicle and all his personal property was taken out of his pockets and put into a bag. Wayne was then transported to CCDC and booked in without incident. His property was also booked in with him.
Pictures were taken of [VICTIM ], and uploaded to the CRN via AXON Capture. A CRN card was provided to [VICTIM ].
