I responded to 601 W. Bay St. in reference to a male who was possibly on drugs, harassing others, and banging on things while also trying to gain access to a construction site in the area. The male was described as a white male (green or beige hoodie; striped shorts; missing a flip flop; wearing black gloves) with red hair. As I approached the scene in my patrol vehicle, I located a white male matching the description given walking westbound on the south side of E. Bay St. (between Lincoln/Habersham Streets). I turned onto Habersham St. and turned my vehicle around to make with the male. While doing so, the male crossed over to the north side of E. Bay St. and went into the E. Upper Factors Walk area. I then exited my vehicle and attempted to make with the male.
After exiting my patrol vehicle, I approached the E. Upper Factors Walk area and verbally attempted to get the male’s attention. I called out to the male by saying “Excuse me, Sir.” loud enough for him to hear me. He ignored me and continued to walk without acknowledging me. I called out to him again by saying “Hey!”, and he turned around (looking at me) and said “What?”. I said “Can you come talk to me?” and he said “No.” I then told him to “Come here now!”. He responded by telling me that he does not have to do so. He then started picking up his pace while continuously walking away from him.
He started to skip sideways in a manner indicating he was attempting to further distance himself from me. I told him to stop and he responded by saying “Are you a racist?”. After asking that question, he started running west and then south before redirecting himself east across Factors Walk. A foot chase began. I notified dispatch that I had a male running on foot who was headed east across E. Upper Factors Walk. As I quickly closed the distance on the male, he lost his footing and fell into the grass area. Myself and Cpl. Grossman immediately placed him into custody with double-locked handcuffs (checked for proper fitting).
I asked the male several times for his name and birthday, and he refused to provide them to me by telling me that he did not want to talk to me. He was ed and placed into my patrol vehicle while I continued my initial investigation. After placing him into the vehicle, he said his back was hurting and was offered medical assistance. He accepted the offer and I requested EMS to respond to the scene.
CONVERSATION WITH REPORTING PARTY:
I spoke with the reporting party ([WITNESS ]; valet manager – Brice Hotel) regarding the call for service. [WITNESS ] said she was standing at the podium owned by the Brice Hotel and was conducting usual business when she observed a white male yelling at and using obscene language towards others in the area. She said he was also throwing cones in the street while doing so. She said the male was cursing and blaming others for having a phone. She said she could not really make out exactly what was said by the male, but she heard the words “fu*k” and “phone”. She said she then walked away from her podium to go inside the lobby of the hotel for a brief moment before coming back outside and saw the male rummaging through the paperwork inside of the business’ podium. She said it looked as if he was trying to steal something. She said she verbally confronted the male by asking him “What are you doing?” and he responded by saying “I’m rearranging your paperwork” and then left the scene. She said there were customers waiting to be serviced by valet that were also watching while sitting in their vehicles. [WITNESS ] returned to her normal duties after speaking with me.
IDENTIFICATION AND RECORDS CHECK:
I was eventually able to identify the male as Nicholas Dicola after asking him for only his birthday which he provided to me. I ed his birthday in PHOENIX and was able to find a picture of a face identical to his with a name identical to the name listed above. I called out to him by saying “Nicholas?” and he answered by saying “Yes?”. I then conducted a records check by entering his name and D.O.B in the CAD system. After doing so, I found that records indicated Dicola had an active warrant out of Henry County. I confirmed the warrant through records dispatch and was told the warrant was valid and Henry County wanted to place a ‘hold’ on him.
EMS ARRIVAL – HOSPITAL AND JAIL TRANSPORT:
EMS arrived on the scene and evaluated Dicola before clearing him at the scene, however, he continued to complain of back pain. He said he has always had back pain, but he said his back was hurting worse after he fell. Because of this, I transported Dicola to Memorial Hospital before he was cleared and transported to CCDC. He was booked on charges of criminal trespass, disorderly conduct, and willful obstruction. He was also served with his warrant (2018SUCR982TP; HENRY COUNTY).
This concludes my involvement in this incident. Supervisors are aware of this incident.
