On July 24, 2024
at 2346 hours, I was dispatched to [50 BLOCK] Skyline Dr in reference to the reporting party’s son. Call notes advised that “SON IS BUSTING OUT THEIR WINDOWS//YELLING//IS DRUNK”. Once on scene VICTIM advised that her son Busby, Mark (SUS) broke her windows to the front of her and left back to his shed just south of the residence.
I attempted to make with Mr. Busby but while trying to speak to him inside of his shed he yelled “you cant come in here”. After speaking to him, we left the shed area and made with Ms. [VICTIM ] again.
Ms. [VICTIM ] advised that Mr. Busby broke 2 windows on the night of 07/23/2024
but she did not call police. Mr. Busby was also drunk during this incident. On 07/24/2024
Mr. Busby came to the residence drunk, yelling, banging on the front door, and causing a disturbance. Mr. [BUSBY] then broke another window to his son [VICTIM ] room.
[WITNESS ] advised that he bought the items to replace the window but he does not know if he can fix the bedroom window because the middle wooden post was broken when Mr. Busby broke it.
I observed the glass and wooden post on the ground just out side of the bedroom window. I also saw the broken window that Mr. [VICTIM ] attempted to patch with a trash bag broken from the 07/23/2024
incident. Photos of these windows were taken and uploaded to Evidence.com.
I also saw blood on the front door this correlated with the banging on the door. Mr. Busby possibly sustained an injury from breaking the window.
I asked Ms. [VICTIM ] if he came inside and hurt anyone. She advised that he might’ve hurt his son ([VICTIM ]).
I then spoke with [VICTIM ] and he advised that he was inside his room standing near the window when Mr. Busby broke the window. After Mr. Busby broke the window he pulled a piece of glass off, reached into the window from the outside, and cut his sons hand causing him to bleed. After he was cut by his father with the shard of glass he left his bedroom to get away from the window where his father was located.
Mr. Busby started banging on the door and left towards his shed shortly after.
I issued a CRN and explained how to obtain a copy of the report. I advised of short term remedies to Ms. [VICTIM ]. I noted that if Mr. Busby comes back to the main residence on the property to call us back.
After approximately an hour Ms. [VICTIM ] called police advising that Mr. Busby was back outside of the residence causing a disturbance. Police arrived but Mr. Busby retreated back into his shed. No new damage was noted by Ms. [VICTIM ].
We then stayed close in the area for about and hour. There was no movement in front of the .
Shortly after around 0046 hours, Ms. [VICTIM ] called back advising that Mr. Busby was back in front of the . Ofcs Huseth and Reyes were close by on foot and heard Mr. Busby yelling. They made with Mr. Busby at the residence and took him into custody.
I arrived to the scene. Supervisors were notified of the arrest. Ofc Thomas transported Mr. Busby to Memorial hospital and I followed. Mr. Busby was treated and released from MMC. Mr. Busby was then transported to CCDC without incident.
I charged Mr Busby with Battery DVA (OCGA 16-5-23.1) for the visible bodily injury to his sons hand. In conjunction with the Battery I charged Mr. Busby with Cruelty to children in the 2nd degree (OCGA 16-5-70(B)) for causing cruel physical pain from the shard of glass. Mr. Busby was then charged with Cruelty to children in the 3rd degree (OCGA 16-7-70(D)) and Criminal Trespass DVA (OCGA 16-7-21) for the glass that was broken by Mr. Busby.
