On 11/17/24 officers responded to a physical domestic in progress at [10 BLOCK] Fitzwater rd with injuries involved and a child present.
Upon arrival officers were met by Mrs. [VICTIM ] who opened the door in a panic and crying uncontrollably. She pointed to the top of the stairs, this was where Mr. McDowell was, holding their two year old son.
Mrs. [VICTIM ] stepped back into the kitchen and asked me to please come with her. She was still crying and shaking and was having trouble talking to me. I offered to call fire and EMS on scene and have her sit down, however she refused both.
Mr. McDowell was in the front room standing by with two other officers.
I continued to speak with Mrs. [VICTIM ] who started to settle down but kept holding the right side of her face. She stated her and her husband were in the middle of a divorce and he keeps telling her shes a bad mother and that hes taking full parental custody. She said that after the argument she needed to leave to take care of her mother who is very sick.
She was coming to say goodbye to her son in the living room, Mr. McDowell was on the couch. She walked past Mr. McDowell to hug her son and he got up yelling about her stepping on his feet, and he punched her in the face. Using his right hand, closed fist, directly under her left cheekbone.
During this incident, Mr. McDowell’s phone was either tossed, or possibly fell out of his hand. The phone hit the child under his left eye. The child started to cry, this is when police were called.
Mr. McDowell stated his wife came into the living room trying to take his phone. He said when she grabbed it from his hands it fell, hitting the child in the eye. He denies hitting his wife at all, stating he just pushed her away from him.
Mrs. [VICTIM ] denied medical treatment on scene but was still examined by officers. She had a red mark under her right cheek, and her face began to swell. When touched, the entire right side of her face stung. Before we left the scene Mrs. [VICTIM ] informed police she started to feel light headed and nauseated. She wanted EMS but not fire to respond, however quickly changed her mind because she didn’t want to make a scene in the neighborhood. She instead stated she would drive herself to the doctor when police left.
Mrs. [VICTIM ] also informed police that although she has never called 911, her and Mr. McDowell have had issues before. She stated he has choked her on multiple occasions, but he had never punched her. Expecially in front of her child, leading her to calling the police.
Mr. McDowell was asked to step outside and was placed under arrest. His cuffs were checked for fit and double locked. He was ed and placed into my patrol car.
He was transported to CCDC and turned over to jail staff.
