On July 30, 2024
, at approximately 1425 hours, I responded to [100 BLOCK] Grimsby Rd regarding a domestic dispute.
Once on scene, I made with Mr. James McCurdy who reported he and the mother of his child, Ms. [VICTIM ] were involved in a physical altercation. He stated it started this morning when he came into the room to ask her about the baby formula. Mr. McCurdy stated Ms. [VICTIM ] became upset about him not going to McDonalds to get food. He reported Ms. [VICTIM ] got out of the bed standing on the side while he stood at the front of the bed. He stated Ms. [VICTIM ] got in his face causing him to shove her back because he was in fear of Ms. [VICTIM ] striking him.
Mr. McCurdy reported after shoving Ms. [VICTIM ], she came back at him in an aggressive manner swinging at him with closed fist striking him. He stated he pushed her on bed and pinned her down using his forearm. He reported having his forearm around her neck region but not directly on her neck. Then Mr. McCurdy reported he and Ms. [VICTIM ] suddenly ended up on the ground where she began to strangle him. He reported he could not breathe for approximately 5 seconds during the approximately 15 seconds the strangling went on.
Mr. McCurdy reported he was backed into the corner of the room where Ms. [VICTIM ] was on top of him screaming at him. He reported he was able to get her off him and get out of the room. He reported he had her phone and left to go to the convenience store. Mr. McCurdy reported coming back to the residence when Ms. [VICTIM ] began arguing with him again. He said he told Ms. [VICTIM ] he was going to call the police, causing her to lock herself in the room. I did observe a cut on Mr. McCurdy’s neck. Pictures of the injuries were taken.
I spoke with Ms. [VICTIM ] who was still very emotional. She stated Mr. McCurdy started conflict this morning by “talking down” to her and being degrading towards her. She did not specify what was said. She reported they then started arguing over Mr. McCurdy wanting to change the baby’s formula and that escalated the situation.
Ms. [VICTIM ] did admit to getting up out the bed and reported Mr. McCurdy took that as her challenging him. She stated he then stepped to her and pushed her causing her to fall on the bed. She reported they suddenly ended up on the floor when the altercation ensued. Ms. [VICTIM ] reported Mr. McCurdy put his hands around her neck to get her off him. She stated he then took a black laundry tub and put it on top of her head. She said after that, Mr. McCurdy took her phone, wallet, and car keys and left the residence.
Ms. [VICTIM ] said she called Mr. McCurdy off her Ipad telling him to bring her belongings back. She reported when Mr. McCurdy returned , he began yelling at her saying “Both of us finna go to jail”. She said she closed the door and locked it to get away from him. She reported he continued to bang on the door saying he was going to call the police because he got marks on his neck.
Ms. [VICTIM ] reported their child was sleeping in the room during this incident.
Due to both parties saying, they were strangled, Family Violence detectives were notified and responded to the scene. Reference the detective’s supplemental to CRN 240730061 for their investigation with both parties.
After the investigators concluded their investigation, Mr. McCurdy was placed under arrest. Reference the detective’s report for details of the charges.
Cpl. Rich transported Mr. McCurdy to Memorial Hospital for evaluation and Mr. McCurdy was booked into CCDC without incident.
