On 8/11/2024
at 14:46 hours I received a call for an animal neglect at [200 BLOCK] Village Drive. Dispatch advised while in route that the complainant stated the animal had been in the sun all day and has no food or water. Dispatch also advised the complainant stated that they believe the owner was .
Once on scene at [200 BLOCK] Village Drive, I saw the dog on the back porch of the address dragging its rear legs around the porch and could hear the dog panting uncontrollably before I got to the porch. Once I got on the back porch, I checked the dog out and the dog was extremely hot to the touch and tangled in a garden hose and clearly suffering from a heat related injury. The animal’s chest was covered in a thick clear saliva and was physically weak. The Brown Male Pit bull was tethered to a porch rail on a short leash and was provided no shade to escape the direct sunlight. The Temperature on my car while on scene was 97 degrees Fahrenheit. There was a small amount of food present but there was no water in the small children’s bowl provided to the dog for water.
I made with Fabian Mendoza Granados, and I asked him if he was the owner of the Brown Male Pit Bull and he stated that he was. I told Fabian that he cannot leave his dog outside in the heat. I then told him to take the animal inside and out of the sun and asked him to retrieve his identification. Fabian was seemingly unbothered by what took place with the animal and showed zero since of urgency or compassion for the animal while I was on scene.
Chatham County Animal Control Officer 06 arrived at the scene shortly after and I advised him on the situation. I advised ASO 6 that when I made my approach to the porch the dog was dragging his back legs and struggling to walk and there was no water or shade present. ASO 6 asked the son of the owner to bring the animal outside that he wanted to see the dog because the father spoke little to no english. The son returned inside the and came back out and said the dog didn’t want to come outside.
Myself and ASO 6 then made our way into the to evaluate the dog. The dog was laying in the laundry room unable to walk and continued to pant uncontrollably. ASO 6 after making his evaluation of the situation advised the owners son that they have two choices. They can either load the dog up immediately and take him to the Veterinarian and he would follow them, or he was seizing the animal and take it to receive immediate medical treatment. After some translation and debate the owners, son stated they would take the dog to the veterinarian and then changed their mind and asked ASO 6 to take him. ASO 6 advised them that if he takes the dog, he will seize the dog, and they may not get him back.
While ASO 6 was doing his evaluation of the dog I asked the son how long the dog had been outside in the direct sun light. The son stated that he had been out there all day, and I arrived at the scene at around 15:00 hours. With the evidence that I had present while on scene and the testimony of the time frame the dog was neglected and the dog clearly suffering from a heat related illness from having no shelter from the direct sunlight with temperatures reaching almost 100 degrees Fahrenheit and no water present, I made the decision to arrest the owner of the animal Mr. Fabian Mendoza Granados and charge him with Animal Cruelty. Fabian was placed in handcuffs behind the back, double locked and sized to fit and placed in the rear of my patrol vehicle. I ed Judge Harmon to see if this was a bondable offense and she stated Fabian was not to receive a bond at this time.
ASO 6 made the decision to seize the dog and transport it to the Chatham County Emergency Veterinarian. ASO 6 advised that the dog’s body temperature was 107.7 degrees when it arrived at the Veterinarian and with the level of injury to the animal it would cost thousands of dollars to save the animal and Animal control would only cover the cost up to a certain amount.
Fabian was transported to the Chatham County Detention Center and processed as TBA at this time.
Fabians family was served paperwork from ASO 6 giving the family 5 days to do a written appeal of the decision to seize the animal. The son translated it to the mother because she spoke no English.
Photos of the animal and the conditions will be attached to the case. ASO 6 also advised he will email a copy of the his report to attach to the case.
