On August 2, 2024
at or round 1330 hours I, Officer Johnson, was dispatched to [100 BLOCK] W. 41st St. to investigate a report of indecent exposure.
Upon my arrival to the above mentioned location I was able to see what appeared to be a man laying on the front porch of [100 BLOCK] W. 41St. His pants were settled below his buttocks which were in plain view. I made with the reporting party (who does not wish to be identified.) She explained that she had recently observed a man mast*rbating while sitting on the front porch of the abandoned located next door, [100 BLOCK] W. 41st St..
Myself and Officer Gordon made with the subject later identified as Ellery Harris. He was partially laying under a green blanket and appeared to be sleeping. When asked why his pants were down, he stated he had recently used the bathroom. Because this was not my first encounter with Harris at this same abandoned house, he was detained, placed in handcuffs and placed in the back of my patrol car.
While conducting a background check on Harris, Officer Gordon ed his belongings and after locating a clear baggy containing a white powdery substance, Harris was placed under arrest and transported to CCDC shortly after.
For being located on abandoned property, lude behavior and having Cocaine in his possession, Harris was charged with Criminal Trespass (O.C.G.A. 16-7-21), Public Indecency (O.C.G.A. 16-6-8) and Possession Of a Controlled Substance (O.C.G.A. 16-13-30(a).)
