Upon arrival i met with James Cottle, who stated that [VICTIM #1], [WITNESS #1] and [WITNESS #2] jump on him and that [VICTIM #1] cut his left hand. I then called dispatch to dispatch EMS to come Check out Mr. Cottle. I spoke with [VICTIM #1], [WITNESS #1], and [WITNESS #2] and they advised me that a James Cottle just came home and started to argue about anything and every thing and once he seen Mr. [VICTIM #1] he got him in a Choke Hold and started choking Mr. [VICTIM #1] till he was blue in the face. I then taken pictures of Mr. [VICTIM #1] face and neck where i seen he had a swollen and bloody lip and seen red marks on his neck. I went to go speak with Mr. Cottle and Mr. Cottle had left the scene at this time. I then had EMS check Mr. [VICTIM #1] out to make sure he was ok. I had gotten witness statements from the victim and witnesses. I advised the Victim that a report will be written in this matter. Warrants will be secured for the above offender and this case is currently under investigation.[End of Narrative][NARRATIVE #2 on March 02, 2025]On 3/2/2023 at 1803hrs i conducted a interview with James Cottle. I read Mr. Cottle his Miranda warning/ Constitutional Rights and he understood them. I then asked him to tell me his side of the story on what happened early Saturday night around midnight. Mr. Cottle Stated “I came home and walked in the house, “[VICTIM #1] put a pack of cigarettes in his pocket and I told him that i wasn’t going to steal his cigarettes. Then my wife [WITNESS #2] just started cussing at me and pushing me and that’s when [WITNESS #1] started to cuss me too and i told her “[WITNESS #1] I’m your daddy you shouldn’t be cussing me like that” and that’s when [WITNESS #2] swung at me again and i leaned back to where she missed me and that’s when [VICTIM #1] came at me and i put him in a headlock and that’s when everyone started to jump on me and beat me in my eye and my head.”I then said that there were multiple witnesses that said that you were starting stuff by hollering at them and everything while they was trying to clean up the house for The Department of Family and Children Services and that when you seen [VICTIM #1] you said “I’ve been waiting on you Motherfu*ker!” that’s when you put him in a chokehold till he couldn’t breathe and turned blue. Mr. Cottle stated “yeah that’s when they started to beat me and i let him go.”I then asked him why did he leave the scene when i told him to stand in front of my patrol vehicle? Mr. Cottle Stated “I wasn’t thinking. I was mad and wanted to get away from there. I wasn’t trying to get away from you or anything, I just wanted to get away from that situation.” I then advised him that i had warrants to read and he asked me if one of those was for Aggravated Assault and i advised him that it was and he stated “Please don’t put that charge on me. I already just got out on bond for that charge. I’m going to prison for that if you charge me with that charge” I then advised him that i am charging him with the charge and he stated “I want my lawyer.” I said ok and i read him his warrants for Simple Battery and Aggravated Assault.Mr. Cottle stated “please I’ll do what ever it takes to not have that charge on me. I advised him that he can’t just be going around putting people in chokeholds in the front yard and that he already advised that he wanted a lawyer so i couldn’t talk to him anymore. Mr. Cottle asked what he could do to get the charges dropped. I advised him that he will go to court and his lawyer has to work that out. I then ended my Interview with Mr. Cottle and turned over the jail staff on duty. This case is closed.[End of Narrative].
