On September 29, 2024
at approximately 1720 hours I was dispatched to Tanner Carrollton Emergency Room split flow 2 in reference to an assault.
Upon arrival I met with [VICTIM ] who was being treated for injuries resulting from a physical domestic that occurred at [800 BLOCK] Davenport Mill RD, Bowdon. [VICTIM ] was accompanied by his girlfriend, [WITNESS ] who is the daughter of Franklin Keith Owens, all of which live in the same household. I asked [VICTIM ] what occurred at [800 BLOCK] Davenport Mill Rd, [VICTIM ] stated that he was attacked by Franklin Owens with a metal baseball bat. I asked him what led up to the attack, [VICTIM ] advised that Franklin has been drinking in excess today and that when he exited his bedroom to get [WITNESS ]s doordash order that [WITNESS ]s father was standing to the left of the door and swung a metal baseball bat at him, [VICTIM ] stated Franklin struck him in the right side of his head with the bat. [VICTIM ] stated that he raised his hands in front of him in an effort to defend himself, [VICTIM ] stated that Franklin continued to hit him in the arms two more time, totaling 3 times that he was hit with the bat. [VICTIM ] then called out to [WITNESS ] for help, [VICTIM ] then fell to the ground and “pretty much blacked out” while [WITNESS ] wrestled the bat away from Franklin. I observed knot above [VICTIM ] right ear, he had a cut on the knuckle of his pointer finger, and a red mark on his left bicep. I took photos of [VICTIM ] injuries they will be uploaded to the “linked files” tab.
I asked [WITNESS ] what took place she advised that, her boyfriend [VICTIM ] left their room to get their doordash order, when her father Franklin was standing outside of their room, [WITNESS ] stated that Franklin began attacking [VICTIM ] by hitting him, withn a metal baseball bat. [WITNESS ] stated that she heard [VICTIM ] screaming her name, thats when she ran out of their room and jumped on Franklin and pulled him off of [VICTIM ]. [WITNESS ] stated that [VICTIM ] slid down the wall and she believes that he passed out for around 30 seconds, [WITNESS ] stated that she was able to take the bat away from Franklin, and she asked him why he attacked [VICTIM ], [WITNESS ] claimed that Franklin repeatedly made the statement that he wanted to kill [VICTIM ]. [WITNESS ] stated that she helped [VICTIM ] to the car and drove him to Tanner Medical Center in Carrollton. [WITNESS ] advised that she was not injured during the altercation.
After interviewing both [VICTIM ] and [WITNESS ], I asked them if they would be willing to fill out witness statement forms, both agreed and wrote out statements. Investigator Jackson 93 arrived at Tanner Carrollton and took over the investigation. After Investigator Jackson completed her interviews, she advised that she would be obtaining an arrest warrant for Franklin, as well as a warrant. Other deputies were already on scene at [800 BLOCK] Davenport Mill Rd. Myself and Deputy Brynildsen went to the residence and they had already located Franklin. Franklin had a cut above his left eye, as well as scratches on his neck, as well as a bloody knot on the back of his head.
Investigator Jackson arrived on scene and read Franklin Miranda Warning, Franklin agreed to talk to Investigator Jackson without a lawyer present. During the questioning Franklin admitted that there was a altercation between him and [VICTIM ] and he attacked him with a metal bat. Investigator Jackson explained the warrant to Franklin, Franklin showed Investigator Jackson where the bat was, she took possession of the bat, she also photographed the scene. Franklin was taken into custody without incident, he declined medical treatment he was transported to the Carroll County Jail.
