On 7/14/2024
, I responded to the area of 1066 Alabama Street (Coin Laundry) in reference to a male in a green shirt and jeans chasing a female down the street. While en route, Dispatch advised the complainant said the female was in the bathroom of the Coin Laundry and the male was getting aggressive with the complainant.
Upon my arrival, the female came outside with a small child, with the male in a green shirt and jeans following behind her. The female was crying and seemed to be trying to avoid with the male. They both came outside and immediately the female pointed at the male and said something in Spanish. I pulled the male, Franklin Lopez-Rodriguez, to the side while another officer spoke with the female, [VICTIM ].
Franklin only spoke Spanish, so I had to use Google Translate to speak with him. Franklin told me that [VICTIM ] broke his phone two days ago. Franklin said today, the dispute started because he wanted to use [VICTIM ]’s phone. Franklin said she did not want him to, and he followed her all the way from their house to the Coin Laundry. Franklin said it never got physical between them. I asked Franklin where he and [VICTIM ] lived and he motioned toward the west, outside of the city limits. This struck me as odd because that is a significant distance to walk.
It should be noted that I detected the strong odor of alcoholic beverages coming from Franklin’s breath and clothes. Franklin also swayed when he walked and his movements were slow and labored. These are common indicators of alcohol intoxication. When I asked him how much he drank, he told me 7 beers.
The other officer told me that [VICTIM ] told him Franklin beats her frequently and took her phone from her. The officer said [VICTIM ] told him that a car in the parking lot was Franklin’s (GA# [REDACTED]) and that a scale with white powder on it could be seen through the window. At first, Franklin denied that the vehicle was his, but later said it was his. At this point, because of all the circumstances I observed, I placed Franklin under arrest for C66-7(A) (21) Disorderly Conduct: Public Drunk. Nothing of interest was found on his person. Afterward, a K9 positively alerted on the vehicle.
During a probable cause of the vehicle, a cup of salt and a squeezed lime were located in the cupholder. These are common accessories when drinking tequila. The scale inside had residue from a white/clear substance on it.
I interviewed [VICTIM ] next. [VICTIM ] told me Franklin took her phone from her and kicked her out of the house. [VICTIM ] said Franklin did not hit her today, but he frequently does. I told [VICTIM ] that an officer would drive her to her house to get her phone, and then she needed to find a safe place to stay.
Franklin was transported to the Carroll County Jail. After entering his name into GCIC/NCIC, it was discovered that Franklin had two active warrants out of Newnan PD (GA) and Hays County SO (TX). The vehicle was left at the scene.
It should be noted that Franklin and [VICTIM ] live at [1000 BLOCK] Lovvorn Road Lot [REDACTED] (Lawrence MHP). This address is outside the city limits of Carrollton.
