, around 2226 hours, I was patrolling the area of Alabama Street near the Quik Pik (1046 Alabama Street in my black and white marked with reflective “POLICE” lettering. I observed a male lying on a bench facedown behind the store. This area is known for loitering, alcohol consumption, and illegal narcotics after dark. I radioed to dispatch that I was getting out with a male, and Ofc. Kelly said he was with me. While approaching, I called for Ofc. Jimenez to assist with the encounter. While standing there, I informed Ofc. Kelly said about the open container, which was still sweating with condensation. I also told Ofc. Kelly said that he had a strong odor of an alcoholic beverage, admitted from the male person.
I informed the male that I was the police while in a marked police uniform while attempting to wake him. I got no response numerous times, so I began rubbing his ribs in an attempt to get him to wake. After doing this twice, he looked at me and then put his head back down. At this point, I was out with him for loitering, and he was highly intoxicated. I grabbed his left shoulder, picked him up, and rubbed his chest. The male awoke and looked at me, locking eyes with me and grunting. I informed him that I was the police and told him to stop pulling, and it was okay. The suspect began thrashing his upper body and lunged towards Ofc. Kelly trying to take him to the ground. Ofc. Kelly bear-hugged him, and the suspect continued to advance on my backup officer. For the safety of my officer, I drew my department-issued Taser-7 SN:X40019M9W activated it and informed him I was going to tase him.
I deployed the two probes to the small of his back, and due to being so close, it didn’t get full lock up. I immediately took the taser and used press to his calf to get a full lock up. We then went to the ground and began trying to effect the arrest. Once on the ground, the male was kicking constantly, striking my lower leggings and thrashing his upper body back and forth, trying to break free. While we were fighting to gain control of his arms in fear, he was trying to reach for a weapon because the suspect had not been frisked for weapons. It also should be known that during this entire struggle Ofc. Jimenez was giving loud, clear commands in Spanish to calm down. The male continued to fight and rolled into me in an offensive position and wouldn’t give his hands, so I activated my taser for another five-second cycle. I was then able to gain control of the male’s left arm and Ofc. Kelly got his right. I then asked Ofc. Jimenez to handcuff him, and she did.
I then stood up, holstered my taser, and caught my breath before telling dispatch what happened and requesting a supervisor. I then grabbed the suspect sitting him up on his butt so he could catch his breath. I then removed the taser probe and attempted to pick him up and have him sit on the bench. Once I picked him up, he began yelling and tensing up again. I then escorted him over to Ofc. Kelly’s car and began ing him incident to arrest. The suspect headbutted the car, and I told him not to. The male continued to fight us and had to be dragged into the car.
The male was identified as Charly Villalobos-Reyes and charged with the following under and issued a Spanish court
