On 7/29/2024
at 0311 hours, officers responded to the area of Lovvorn Road and Burson Avenue in reference to a single-vehicle crash. The vehicle was overturned in the roadway abandoned. I ran the vehicles tag through GCIC and saw that it was registered to a Hispanic male who lived at [200 BLOCK] Candlewood Drive. I proceeded to this address and made with the registered owner [REDACTED]. [REDACTED] advised that he had loaned the vehicle earlier in the day to a family friend, Ariana Rivas. [REDACTED] was on the phone with Ariana and advised that she was currently at her address at [20 BLOCK] Crestview Circle. [REDACTED] stated that Ariana left the scene because she was scared.
I proceeded to [20 BLOCK] Crestview Circle with Officer Fowler, a deputized (Carroll County) police officer for the City of Carrollton. I knocked on the door and was met by Ariana. Ariana appeared to have just showered as her hair was wet and she was dressed in comfortable clothing. Ariana admitted to driving the vehicle, and fleeing the scene because she was scared. While speaking to Ariana, I detected the odor of alcoholic beverages emitting from her person. Ariana’s speech was slurred as she was speaking with me. Her eyes were bloodshot and watery. All of these symptoms are common for subjects under the influence of alcohol.
Ariana stated that she was “just driving” because it was her birthday and she was enjoying her freedom. Ariana noted that she was driving all around Carrollton and had been since she got off work at 22:00 hours. I found this odd because the tag of the vehicle Ariana was admittedly driving had not been detected on FLOCK ALPR cameras except for minutes before the crash. The most recent hits were on North Park Street and Maple Street, which was the most direct route from her residence and the crash scene.
I believed that Ariana was impaired and lying to me when she began explaining the events of the crash. Ariana advised that she crashed her vehicle on Alabama Street at a red light intersection. It should be noted that Ariana’s vehicle was not found anywhere near a red-light intersection, nor on Alabama Street. I spoke further with Ariana, explaining to her that her statements did not appear factual. After explaining to her what I knew about the facts of the case, she admitted to consuming alcohol before crashing.
Ariana told me that she had lied, stating that she had consumed White Claw Hard Seltzers, and multiple shots of 1800 Tequlia prior to driving. Ariana admitted that she consumed this alcohol at her house without her parents permission, and decided to start driving. Ariana stated that she did not have a destination of travel. I asked Ariana to gauge her level of intoxication prior to driving on a level of one to six. I explained that “one” would be considered sober and “six” being blackout intoxicated. Ariana stated that she was a “three” before driving as well as while speaking with me currently.
Ariana stated that she understood that drivers are responsible for reporting a vehicle crash, especially if property is damaged. She also noted that she understood she was not old enough to consume alcohol. Ariana consented to the horizontal gaze nystagmus (HGN) portion of Standardized Field Sobriety Testing (SFST). During this test I observed 6/6 clues of impairment. I did not preform the Walk and Turn or One Leg Stand portions of SFST due to having limited space available to do so safely.
Due to my findings, I advised Ariana that she was being placed under arrest. Ariana was placed into handcuffs that were double locked and checked for fit. Ariana was read Implied Consent For Suspects Under Age 21 where she consented to the state-administered chemical test of her blood.
I transported Ariana to the Carroll County Jail, where she was charged with the following:
DUI Underage 0.02 Grms or More
DUI Less Safe
Hit & Run
Fail to Report Striking Fixed Object
Failure to Maintain Lane
At 03:43 hours, True Peaks Phlebotomist [REDACTED] collected two vials of blood from Ariana’s right arm. Said blood was placed in a sealed GBI Blood Alcohol Toxicology Kit (211A). Ariana had to be transported to Tanner Medical Center to be cleared for arrest due to being involved in a crash. It should be noted that Ariana had no complaints of pain and no visible injuries. Item 211A was placed into evidence locker 004 at the Carrollton Police Department.
