On September 13, 2024
, I, Officer Brice, responded to the area of Shady Grove Road and Northside Drive in reference to a Carroll County Deputy asking for my assistance. Upon arrival, I met with Deputy Bullock 955. Deputy Bullock explained that he was dispatched to the area for a lookout about an SUV running off the road. Deputy Bullock advised the complainant began explaining where the incident happened and he realized that it started in the city limits of Carrollton.
I went over and spoke with the complainant who was still on scene. The complainant, [WITNESS ], advised the suspect, later identified as Adony Mendez, was driving past the Ride Share on NorthSide Drive when he ran off the roadway. [WITNESS ] advised Adony almost hit a fire hydrant and had to back up to get back on the road. It was later determined that Adony left the roadway, struck multiple roadway signs and traveled through the grass for over 150 feet.
[WITNESS ] advised he followed Adony while his passenger called 911. [WITNESS ] stated he followed Adony to 1465 Shady Grove Road (Stop and Shop) and observed that he was “all over the road.” [WITNESS ] stated he watched Adony drive into the parking lot and exit the vehicle with several containers of alcohol. [WITNESS ] advised Adony hid his alcohol behind the green dumpster. I walked over to the green dumpster at the side of the building and located a partial 12 pack of beer. The unopened cans were still cold. While examining the items, I observed that multiple beers were open and empty. I observed there were four open beers, three of which were empty and one was half empty. All of the open cans were also empty.
I went to speak to Adony. Adony was leaning against the front of Deputy Bullock’s patrol vehicle. I walked up and asked Adony how he was doing. I asked Adony for a driver’s license and he stated that he did not have one. I asked Adony for ID and was presented with a work ID badge. Adony advised that it was his work ID and that he was a mechanic. The work ID badge was from Hire Dynamics, a temporary employement agency in Carrollton. There was a photograph on the ID badge that was Adony but the name on the badge was Damien Ortiz.
I asked Adony how many drinks he had consumed and he responded “today?” “Three.” I pointed to the open containers by the dumpster and advised there were more than three open drinks there. Adony then pointed to the complainant and stated that the drinks belonged to them. I informed Adony that while I was speaking to him, I could smell the odor of an alcoholic beverage but I smelled nothing while speaking to the complainant. I asked Adony if he would do some feild sobriety evaluations and he suddenly started saying that he could only speak a little english. Although Adony had been speaking with me through the entire investigation up until this point, he suddenly could no longer speak english. I found this odd.
I asked Adony again if he would complete some field sobriety evaluations and again Adony responded by saying he only speaks a little english. I attempted to conduct horizontal gaze nystagmus, however Adony stopped following the stimulus and just stared forward. During this attempt to evaluate Adony, I had him step away from the deputies patrol vehicle and he was no longer leaning on the vehicle for support. I quickly saw that Adony was having trouble standing still and was constantly swaying side to side and forward to backward.
At this time, I asked Adony to provide a breath sample in the portable breath tester issued to me by the police department. Adony did provide a breath sample which registered positive for alcohol.
I then placed Adony under arrest for DUI and Hit and Run. Adnoy was placed in a pair of double locked handcuffs, which were checked for proper fit and tightness, with his wrist behind his back. I placed Adony in the rear seat of my patrol vehicle after a incident to arrest. I asked Adony for his name and birthday.
Adony kept saying “no english” while failing to identify himself. I then read Adony the Georgia Implied Consent Notice for Suspect Over 21. Adony failed to give me an answer. I took Adony’s lack of an answer to be a no. I then ed Adony’s vehicle incident to arrest but found no other sources of impairment.
I returned to the vehicle to and began asking Adony for his information so that I could complete accident forms and citations. I asked Adony if his name was Damien Ortiz, the name on his work ID with his photograph on it. Damien stated that was on his name and that his name was Leo. I asked Adony if he was lying to me and he stated no. I asked Adony for his birthday and he stated “[REDACTED]” but did not provide a year. I asked Adony how old he was and he stated 35. I ran the name Damien Ortiz through NCIC with no return. I then ran Leo Ortiz and again received no return. I asked Adony about it and he began stating that he was from different countries. Adony advised he was from Mexico, Honduras, Mexico City, Texas, and Puerto Rico. I realized that I was getting no where with Adony and asked for a fingerprint scanner to meet me at the jail.
Adony’s vehicle was towed, and I began transporting Adony to the Carroll County Jail. Once at the jail, Adony’s finger prints were taken but no match was found. I charged Adony with the following charges:

The following day, I was notified that the name Damien Ortiz was also ficticious and that his real name was Adony Mendez.
A crash report was also completed.
