On October 27, 2024
at 1740 hours I, Deputy C. Varner, responded to [6200 BLOCK] GA. Highway 23S lot [REDACTED] in reference to a domestic dispute.
Upon arrival I activated my department issued body camera and met with Shirley Hill. Shirley stated her boyfriend, [VICTIM ], was being verbally abusive and she wanted him to leave. Shirley stated she has lived with [VICTIM ] for 6 years. Shirley stated the argument did not become physical.
I then spoke with [VICTIM ]. [VICTIM ] stated he had not been verbally abusing Shirley. [VICTIM ] stated Shirley has been diagnosed with several health issues including dementia and hypertension. [VICTIM ] stated Shirley has not been taking her prescribed medication, causing her to become irate.
Shirley stated she would like for Burke EMA to respond for a physical evaluation. Unit M11 responded to the scene for an evaluation, and advised Shirley’s blood pressure was normal and she was in the right state of mind. Shirley denied transport to any hospitals.
Shirley then stated she took [VICTIM ]’s house key and she was not going to let him back into the residence. Deputies advised Shirley that she would need to let [VICTIM ] into the residence until he is evicted, however she refused.
Deputies advised Shirley of the eviction process. Deputies advised [VICTIM ] to call Burke County Dispatch if Shirley does not let him into the residence.
At 2015 hours Lt. Aaron Hannsz returned to the incident location regarding Shirley locking [VICTIM ] out of the residence and not letting him in. Lt. Hannsz spoke with [VICTIM ] who restated the issues he previously explained to Deputy Varner. Lt. Hannsz called and spoke to Judge Moore about the possibility of obtaining an order for emergency evaluation for Shirley based on her actions and refusal to take her prescribed medication. Lt. Hannsz advised Judge Moore that according to [VICTIM ] Shirley has previously stated that she wanted to kill herself and she recently told [VICTIM ] that she would kill him. Lt. Hannsz also advised Judge Moore that Shirley had been evaluated by the Burke County EMA and had been cleared with no life threatening issues. Judge Moore advised that there was not sufficient supporting incidents to justify an emergency evaluation.
Lt. Hannsz then spoke with Shirley and advised her of the eviction process again. Shirley stated that she understood the eviction process but she is a “Texas girl” and she would take care of it. Lt. Hannsz asked Shirley what she was going to do once he leaves the residence if [VICTIM ] forces his way into the residence. Shirley stated that she would “Blow him away”. Lt. Hannsz advised Shirley not to make threats in front of him and again asked her what she was going to do once he left the residence. Shirley again stated that she would “Blow him away”. Lt. Hannsz then placed Shirley under arrest for Disorderly Conduct, 28-40-1: Acts in a Violent tumultuous manner for the threat to harm [VICTIM ]. Shirley was placed in hand cuffs in the front of her body and placed into back seat of Lt. Hannsz’s patrol car. Lt. Hannsz then transported and committed Shirley to the Burke County Detention Center for violation of the listed county ordinance. Citation number 39479 issued.
