On July 4, 2024
, I Sgt. Tillman responded to a vehicle collision involving a single vehicle near or at the intersection of Columbus Road and Brookhaven Road. Upon my arrival, I witnessed a vehicle that was turned over on its roof. Fire Rescue personnel on scene advised that the driver was not present, and that witness stated that she left another vehicle. Fire Rescue stated that the witness advised that the driver crawled out of the vehicle and entered another that drove away from the scene. While acknowledging this information and standing close to the overturned vehicle, I noted an odor of an alcoholic beverage emanating from the vehicle.
I looked inside and noted a bottle of what appeared to have been Mango Kinky and another bottle of an alcoholic beverage that appeared to have broken during the collision. I exited the vehicle and returned to my patrol vehicle to run its registration plate. The vehicle returned to an elderly female at the address of [100 BLOCK] Alpine Drive in Macon, GA. While investigating this incident, I was notified by my dispatcher that the female who initially called the crash in and picked up the female was returning with her back to the scene. I went to make with the resident owners of the fence she destroyed. I made with a male and female couple and advised them of the incident.
I noticed that they had cameras located in the front of their and asked if they had any video of the collision. The female stated that she would try to pull the video footage and would notify me if she had anything. During this time a silver Honda drove into the scene and two females stepped out. Deputy A. Walker spoke with the driver as I walked up. The driver stated that she was told to return to the scene with the driver by dispatchers. While speaking with them, my attention was drawn to the female that exited the rear of the vehicle. She made references that she witnessed the collision but avoided indications that she was involved.
She was identified as Shanbrea Woodard by giving her name and date of birth. While she was speaking, I noted that she had scrapes on her left arm and that her left leg also had scrapes that were bleeding. As she spoke, I noted that her speech was slurred, she was slightly unsteady on her feet, the whites of her eyes were slightly reddish in color and possessed a watery/glassy appearance to them. I asked her to step over to the front of my vehicle. She made references that we could go ahead and lock her up. As she did so, she proceeded to constantly smoke. I attempted to run the vehicle owner’s information to get a picture of the vehicle’s owner but, I noticed that she appeared younger than the year age displayed on the vehicle owner’s birth year.
Prior to asking her about the collision, I did read her Miranda rights to her. She agreed to speak with me and did admit to being the driver of the vehicle. While explaining what happened, I noted the strong odor of an alcoholic beverage coming from her person. I also noted at times her droopy eyelids as well. She admitted to consuming one alcoholic beverage at a “Bootleg” located on Woodard Street. She stated that she did not remember when her last drink was but then changed her admission from one drink to two and that she had them in a white Styrofoam cup which was still located in the vehicle. I told her that I wanted to conduct several tests with her to ensure she was safe to drive. She complied with SFST’s.
I asked her if she had any injuries involving her head, legs, neck, or back and she pointed to her right and stated a previous surgical scar. I asked if it affected her ability to walk, stand, run or balance. She stated that after she takes her first step then it does not affect her. I asked if she wears glasses or s and she advised that she did not. I asked if she had any issues with epilepsy or seizures and she stated that she did not. I asked if she had medical history that I needed to be aware of and she stated that she did not. I continued with my investigation.
The first test was the horizontal gaze nystagmus test in which I noted 6 clues. I placed her in the test position for the HGN test and advised her that I wanted her to follow the tip of my finger with her eyes only. I told her that I did not want her to move her head. I asked if she understood, and she stated that she did. Her eyes displayed equal pupil size and equal tracking. I did not observe any resting nystagmus. I began the test and noted the following: Lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes and the Onset of Nystagmus prior to 45 degrees in both eyes. I also noted vertical nystagmus as well. During the test I had to remind her to focus on my finger, I noted the odor of an alcoholic beverage coming from her person, I noted her droopy eyelids, I noted that the whites of her eyes were slightly reddish in color and that they again possessed a watery/glassy appearance to them.
The next test was the walk and turn test in which I noted 7 clues. I placed her in the test position for the WAT and told her not to move from that position unless instructed. I asked if she understood, and she stated that she did. Immediately after stating this, she stepped out of the position I placed her in. I explained and demonstrated the test procedures for her and asked if she understood the instructions. She stated that she did. Prior to me telling her to begin, her right foot moved to the front as she started to walk. This put her starting off on the wrong foot other than what I instructed. When I told her to begin, she started to walk. She missed all heel to toe connections, her arms separated from her side greater than six inches as she used them to maintain her balance, she did not turn as I described, she turned while pivoting on both toes, she took a total of 8 steps on her first walk and 10 on her second walk, on her return walk she stepped off the line on her count of step 6.
The next test was the one-legged stand test in which I noted 2 clues. I explained and demonstrated the test to her and asked if she understood the instructions which she stated that she did. I told her to begin, and she raised her right foot. Her arms immediately separated from her sides greater than six inches as she used them to maintain her balance, I also noted slight left to right swaying at the start of the test as well.
I retrieved my FST Alco Sensor and asked her to provide a sample and after multiple tries I applied the quick capture feature on the Alco sensor and the device registered a positive reading for the presence of alcohol. Based on the less safe act of the collision, my personal with her, her admission to drinking prior to driving, the results of SFST’s performed, the physical manifestations of impairment observed, the statements made to the fire rescue personnel implying the driver leaving the scene was “drunk”, and the positive result of the Alco Sensor, I placed Woodard under arrest for DUI. I hand cuffed her and moved her to the rear of my patrol vehicle.
I verified her age and read her the implied consent reading for suspects aged 21 and over. I asked if she would submit to the state’s test of her blood to which she agreed. Her vehicle was removed from the scene and towed away by the use of Ackerman’s Towing. Prior to her transport she made remarks about there being marijuana in the vehicle and that she only smoked it and does not transport it. This remark was made with me asking or coercing her.
I transported her to the Bibb County’s Patrol office where we awaited the arrival of Community Ambulance Supervisor [REDACTED] who drew Woodard’s blood at my request. Woodard willingly offered her left arm, and her blood was drawn at 08:09 hours from her left median cubital vein. During the draw Woodard was quiet and made references to her being a “Drunk bi*ch”.
She was taken to the booking area and deferred by medical staff advising that she needed to be screen prior to being accepted in the facility. I then transported her to the Atrium Health Center where she was medically evaluated and cleared. I then returned her to the Bibb County Jail, and she was accepted on her charges. She was given a 180-day temporary driving sticker attached to her DUI citation.
