On July 6, 2024
at approximately 5:45 I, Dep. D. Medina responded to the intersection of Beech Ave. and Winton Ave. in reference to a person with a firearm.
While in route to the location I was notified that ShotSpotter had detected two shots fired from the same area where the person with a firearm was seen and suspects vehicle was a white two door Honda all in aproximately the same time the call came in to dispatch.
On arrival, I found a black female dressed in black leaning over the white car and and peaking through the drivers side window of a white two door Honda, Georgia tag [REDACTED]. I asked her what her name was and refused to give me her name. I advised her of the occurrence and she stated it had nothing to do with her. I asked her once more for her name and she mumbled a first name and last name [REDACTED] but refused to give date of birth. At that moment she was detained and placed in the patrol vehicle until further. I proceeded to go to the car and saw that it was unoccupied. I ran license plate [REDACTED], and the vehicle came back to Nathaniel Joshua Banks.
I then was able to get a statement from [VICTIM ], who stated she had been at that house earlier to drop someone off at [1200 BLOCK] Winton Ave. She stated that when she arrived, she parked to the right of the white Honda Accord on Beech Ave. As she was in her car, she saw a black male, wearing white and gray shirt, gray pants and twists in his hair come out of the vehicle and begin confronting her and telling her “you are killing the vibe” and got upset for her being there. She stated that words were exchanged but she stayed in her car. It was at that moment he approached her and slapped her in her left side of her face through the window. She stated more words were exchanged, when she saw him return to the white Honda and pulled out a gun and walked up to her. I asked what type and color and she stated it was black and was something like a rifle or AK and stated that he then shot the firearm. After that she left the area in fear for her life and waited for deputies to arrive in a nearby street to report it. Ms. [VICTIM ] stated that she does want to press charges and is in fear of retaliation because they are “crazy”. I showed Ms. [VICTIM ] a picture of the registered owner and she immediately identified him as the suspect. She also did comment that the unidentified female was out there when it occured but did not have anything to the with incident.
I then went back to the area of where she said she was parked at and where he shot the firearm and canvassed the area. There were multiple 9mm casings found that seemed to previously have been there because they were crushed. On the side closest to the curve, I found one rifle LC 23 or 5.56 casing that appeared as if it was recently fired.
I then made with owner of [1200 BLOCK] Winton Ave. and stated that he did hear the shots but had not seen anything. I asked if he knew who was the owner of the white Honda and he stated he did not know who’s it was specifically but could be a friend oh his since they always ride different cars. I advised if he knew the female that was outside his house and he stated that he knew her from the area. I advised dispatch to have a tow truck in route to pick the vehicle up due to suspended registration and Ackermans Towing responded. Before towing the vehicle and documenting property for the two truck, I saw a black phone and a Georgia drivers license which had the name and picture of Nathaniel Joshua Banks and were left in the seat. Female that was detained was properly denitrified as [REDACTED] and since she was in a stated of inebriation, she was turned over to family that arrived on scene to pick her up.
Recovered shell casings will be submitted in crime lab as evidence and warrants will be drawn for Nathaniel Joshua Banks and will be charged with Aggravated assault. Ms. [VICTIM ] was given a case card and advised on how to get a restraining order.
