On Sunday, September 15th, 2024
at approximately 0407 hours I was dispatched to [1900 BLOCK] Euharlee Rd, Kingston, Georgia 30145 in reference to a domestic dispute.
Prior to my arrival, I was advised by Bartow Dispatch the complainant, [WITNESS ], was not on scene but had received phone calls from victim [VICTIM ] asking for [WITNESS ] to come and pick her up from her residence at [1900 BLOCK] Euharlee Rd because her ex-boyfriend, Logan Higgins, had choked her. [WITNESS ] advised Bartow Dispatch [VICTIM ] had texted her a short time later stating Logan was trying to take her cell phone away from her.
Myself and other deputies arrived on scene at [1900 BLOCK] Euharlee Rd. While driving up the driveway, we observed [VICTIM ] appearing to be in distress while vomiting in a wooded area along the driveway. [VICTIM ] stated Logan had left because he knew law enforcement was in the area and was walking down the driveway to be picked up by [WITNESS ]. For safety, deputies escorted [VICTIM ] to a nearby church where we met with [WITNESS ] and her boyfriend [REDACTED].
I spoke with [WITNESS ] and asked what had happened. [WITNESS ] said she received three phone calls from [VICTIM ]. The first phone call that was missed was at 0310 hours. The second phone call that was missed was at 0313 hours. The last phone call that [WITNESS ] was able to answer was at 0349 hours. [WITNESS ] said [VICTIM ] told her that she needed her to come pick her up because Logan was freaking out about something and couldn’t talk over text about it. [WITNESS ] asked [VICTIM ] if Logan put his hands on her and [VICTIM ] said yes and that he choked her. [WITNESS ] said Logan got on [VICTIM ]’s phone with her and [WITNESS ] said she told Logan to just go away. Logan told [WITNESS ] he was in Cartersville by himself and [VICTIM ] asked for him to come because [VICTIM ] wanted him to. [WITNESS ] told me [VICTIM ] lives with Logan but they are no longer in a relationship together. [WITNESS ] told me [VICTIM ] shares a child with Logan.
Deputies spoke with [VICTIM ] [VICTIM ] told us Logan got angry because he found out she was talking to another guy after going to a party at Logan’s friend’s house. [VICTIM ] said Logan confronted her about this and [VICTIM ] denied talking to another guy. [VICTIM ] said Logan tried to take her cell phone from her. [VICTIM ] said Logan then tried to choke her on the couch in the living room. [VICTIM ] said while being choked she could not breathe. Deputies checked [VICTIM ] for signs of Petechiae and observed [VICTIM ]’s eyes to appear to be blood shot. [VICTIM ] said she was then drug off of the couch and onto the floor while Logan was still trying to take the phone away from her and kicked her in the face. [VICTIM ] said she tried calling 911 on her cell phone by swiping the SOS Emergency option on her (phone and it got disconnected during the scuffle. [VICTIM ] said she told Logan she was calling 911. At one point, [VICTIM ] said Logan took her phone away from her but she said she was able to get it back. [VICTIM ] said she then faked to be on the phone with 911 and Logan fled the scene.
[VICTIM ] showed deputies her cell phone call log. I observed multiple missed calls from Logan beginning at 0311 hours. I observed the phone calls [VICTIM ] made to [WITNESS ] on her call log. I also observed an Emergency SOS notification on [VICTIM ]’s Iphone stating that it was activated approximately around the time [VICTIM ] was saying the altercation took place. I took a photograph of [VICTIM ]’s cell phone call log on my county issued Bodyworn camera.
Deputies observed a red marking on the right side of [VICTIM ]’s face and a fresh cut above the red marking. [VICTIM ] said Logan kicked her in the face while she was on the ground. Deputies also observed what appeared to be a human bite mark appearing slowly on [VICTIM ]’s neck in an up and down direction. Individual teeth markings were visible from this marking. Deputies also observed a cut and swelling on [VICTIM ]’s left leg that were raised. Deputies also observed cuts and swelling on [VICTIM ]’s back of her right leg. [VICTIM ]’s leg injuries apeared to be from someone having their hands scratching with their fingers and grabbing a hold of the legs with their hands. Photographs of these injuries were taken with my county issued Bodyworn Camera. [VICTIM ] refused medical treatment at this time.
[WITNESS ] advised me she would be taking [VICTIM ] to [WITNESS ]’s father’s house to stay. [VICTIM ] told deputies Logan has a history of conducting physical violence with her during arguments that she has not reported to law enforcement. Deputies advised [VICTIM ] she needs to get out of the household to prevent any further issues from occurring since the two are no longer in a relationship and mainly due to the the stated history of violence in the residence. Deputies provided [VICTIM ] with a case pamphlet providing her with a case number, our badge numbers, and today’s date. We also provided [VICTIM ] with a domestic violence pamphlet referring her to domestic violence resources. After speaking with [WITNESS ], [VICTIM ], and [REDACTED], they all left the church.
I attempted to call Logan with the phone number provided by [VICTIM ] for him by being patched through by telephone by Bartow Dispatch. Logan answered the phone. I asked if he was Logan and he said yes. I advised Logan of who I was and I was a deputy with the Bartow County Sheriff’s Office. I asked Logan if he could meet with me regarding talking about this incident. Logan said yes. Logan then told me he was going to have to hang up and call back in.
Logan called back in a short time later and I asked Logan where he wanted to meet. Logan told me he would meet with law enforcement at his house located at [1900 BLOCK] Euharlee Rd where the incident occurred. I told him we could meet there. Due to Logan’s family being on the property and the unknown factor of what weapons Logan could have in the household, the decision was made to try to locate Logan on the way back to his house and conduct a traffic stop on him to get his side of the story.
Logan was located in the area of [800 BLOCK] Taylorsville Macedonia Rd and a traffic stop was conducted on him (Refer to Case 024-00025903). Logan said he was meeting one of us at the house. I asked for Logan to step out of the vehicle. Logan told me he would rather speak with us at the house. I told him we were already here with him so he could talk with us here. Logan complied with stepping out of his vehicle and going to our patrol vehicle to talk.
I asked Logan what had happened tonight. Logan told me his “baby mama” [VICTIM ] was living with him. Logan said [VICTIM ] asked for him to come to the house. Logan said he went and picked up [VICTIM ] and took her to his friend’s house. Logan said she got angry because she was hungry and Logan said he got upset. The two left and Logan said [VICTIM ] went to his dad’s house. Logan said the argument was only a verbal argument and nothing physical ever happened. When asked about the markings on [VICTIM ]’s body, Logan said [VICTIM ] just likes to tumble around and has mental health issues. Logan said he had a one night stand with [VICTIM ] and had a kid together but they are not in a relationship any longer but live together. Logan said he left the house. When asked if he left because law enforcement was coming, Logan said he did not want to be there by himself and he did not know law enforcement was coming. [VICTIM ] had told us Logan had asked her why law enforcement was coming to the house. Logan said he never took away the phone from [VICTIM ] when she was attempting to call 911.
Due to probable cause to believe a crime was committed by statements and injuries, I placed Logan under arrest for Aggravated Assault by Strangulation (FVA), Battery FVA, and Obstructing or Hindering Persons Making Emergency Phone Calls. Handcuffs were placed on Logan, checked for proper fit, and double locked. Logan was placed into the back of my county issued marked patrol vehicle. Logan was escorted to the Bartow County Sheriff’s Office Detention Center and turned over to the jail staff without incident.
State Warrants for Aggravated Assault by Strangulation (FVA), Battery FVA, and Obstructing or Hindering Persons Making Emergency Phone Calls was taken out and secured. Logan’s truck was towed by Matthew Smith Towing.
I ed [WITNESS ] by being patched through by Bartow Dispatch to advise her and [VICTIM ] that Logan had been arrested.
On Sunday, September 15th, 2024
at approximately 1910 hours I was dispatched to call into Bartow Dispatch to be connected with [VICTIM ] by telephone (Refer to Case 024-00025960 CFS 43). [VICTIM ] advised me her bruising became more apparent over time and had taken photographs of the injuries. I asked [VICTIM ] if I could meet with her somewhere so I could verify the bruises. [VICTIM ] said I could meet her at [100 BLOCK] Shaw St, Kingston, Georgia 30145.
I responded to the area and met with [VICTIM ]. [VICTIM ] showed me photographs that she had taken of her injuries. I requested for [VICTIM ] to email me those photographs to my county issued email address to be added to the report as an attachment. I observed another bite mark to [VICTIM ]’s left shoulder with teeth prints that had become apparent overtime just like what was observed on her neck. [VICTIM ] reported earlier this morning that it takes a long time for her body to bruise up. [VICTIM ] reported that a Ring camera located on the property of [1900 BLOCK] Euharlee Rd possibly caught a recording of [VICTIM ] being pushed in the front yard at one point by Logan. This footage was not obtained at this time.
Later in the night at approximately 2326 hours [VICTIM ] emailed me at my issued county email address and stated “Not sure if you will see this message or even know how to help but last night he kicked the side of my head it seams to hurt a lot and is a bit swollen I’m not sure if it’s something to worry about or if it’s just really sore.” I sent back an email to [VICTIM ] stating “If you need medical attention at this time, my advice to you is to seek medical attention. If you have any other questions, please feel free to us.” I have attached a copy of this email to this report as well.
