On Thursday, July 4, 2024
, at approximately 7:30 P.M., Captain D. C. Bentley and I were assigned to the security detail at 100 Pine Grove Rd Cartersville, GA (Dellinger Park). Captain Bentley was making a routine patrol near the stage area when he observed two white males, later identified as Mr. Devin Sanders and Victim, in a verbal altercation which appeared to be escalating towards a physical altercation. Captain Bentley heard Mr. Sanders utilize profane language such as “You dumb motherfuker”, and “You Pusy” in front of a large crowd of individuals including Mr. [REDACTED]’s wife and their three children, Juvenile 1, Juvenile 2, and Juvenile 3.
Captain Bentley stepped in to separate Victim and Mr. Sanders in which Mr. Sanders initially did not cooperate by continuing to curse aloud and remain in the immediate area. Captain Bentley gave a lawful order to Mr. Sanders to sit in a nearby chair while he completed his investigation and placed a hand on Mr. Sanders to escort him to the chair. Mr. Sanders pulled away from Captain Bentley and stated “Don’t fu*king touch me.” Mr. Sanders sat down and was given a lawful order to produce his identification by Captain Bentley. Mr. Sanders refused and Captain Bentley requested assistance via a mobile radio.
I arrived on the scene to assist and observed Captain Bentley give another lawful order to Mr. Sanders to produce his identification. Mr. Sanders initially stated he would not, and after a third lawful order, Mr. Sanders produced his Georgia Driver’s License.
Captain Bentley gave Mr. Sanders a direct order to stand up and place his hands behind his back at which point Captain Bentley and I gained physical control of Mr. Sanders’ arms. Mr. Sanders began tensing up and attempting to prevent us from placing Mr. Sanders’ hands behind his back for handcuffing. Mr. Sanders was escorted to the ground and handcuffed to the rear. The handcuffs were checked for fit and double-locked for safety.
Mr. Sanders was ed incident to arrest with no contraband located. Mr. Sanders was escorted to Officer D. Alfonso’s marked patrol unit, which was ed before and after each shift, before and after each transport with no contraband located, and placed inside without further incident. Mr. Sanders was transported to Bartow County Jail by Officer Alfonso and turned over to deputies on duty.
After Mr. Sanders had been removed from the scene, it was discovered Captain Bentley’s sunglasses, which he was using in the performance of his duty due to the heat and sunlight present at Dellinger Park during the security detail, had been destroyed during the process of escorting Mr. Sanders to the ground and subsequently placing Mr. Sanders under arrest.
Warrants were obtained for Mr. Sanders by Bartow County Magistrate Court. The following warrants were obtained:
-Obstruction of Law Enforcement Officers- O.C.G.A. 16-10-24(a)
-Disorderly Conduct- O.C.G.A. 16-11-39(a)(3)
-Interference with Government Property- O.C.G.A. 16-7-24(a
Copies of the warrants were uploaded to the case file. A photo of Captain Bentley’s sunglasses was uploaded to the case file.
