On Friday, Sep. 29, 2024
at 0232, I was dispatched to [40 BLOCK] Manning Rd. in reference to Suspicious Activity.
Upon arriving on scene, I spoke with REDACTED BY AGENCY who said her step dad, David Massengill (suspect) has been abusive and has made inappropriate sexual comments to her. She said Wednesday, (Sep. 25, 2024
) or Thursday, (Sep 26, 2024
), her and David got into a verbal argument because she unplugged a router cord and placed it where David usually places it when he unplugs it. She said she only unplugged the cord because David got later than he usually does. [REDACTED BY AGENCY] said when David got he came into her bedroom and asked about the cord. She said she told him where the cord was and he got upset. She said they began to argue and David finally left the room. She said when David left she locked her bedroom door because she did not think he would come back into the room.
[REDACTED BY AGENCY] said a few minutes later David returned and found her door locked. She said he broke the door in and they began to argue again. [REDACTED BY AGENCY] said David grabbed her by the left arm and the neck and slammed her to the floor. [REDACTED BY AGENCY] did have a bruise on the back of her left arm and visible red marks on the right side of her neck. Photo’s were taken of all injuries. [REDACTED BY AGENCY] said her sister WITNESS was present during the incident. [REDACTED BY AGENCY] also said that her mother, WITNESS and [WITNESS ] knows about everything going on in the residence.
[REDACTED BY AGENCY] also said David has shown her and her sister pornographic videos and the should walk around without wearing bra’s. She said David has told her that she should walk around him naked. [REDACTED BY AGENCY] said that David has come into the bathroom while she was using it. [REDACTED BY AGENCY] said David told them that he has not been around girls alot. [REDACTED BY AGENCY] said David trapped her in her mother’s bathroom one time and wanted to know if her breast where bigger than her mother’s. She said David took a measuring tape and measured her around the breast.
I then ed the on-call investigator, Inv. F. Aspenwall 15 and informed him that I would be taking this report. I did not ask [REDACTED BY AGENCY] any questions that were related to any sort of sex crime, but she did speak out about it.
I then relocated to [900 BLOCK] Adairsville Pleasant Valley Rd. to speak with [WITNESS ]. Once on scene, I spoke with [WITNESS ] and informed her that [REDACTED BY AGENCY] was safe and in our custody. I then asked [WITNESS ] if [WITNESS ] was and if she could go get her so I could speak with her.
I then spoke with [WITNESS ], who confirmed that David and [REDACTED BY AGENCY] had been in a altercation and David did grab [REDACTED BY AGENCY] by the left arm and slammed her to the floor. [WITNESS ] said she did not know how the marks got onto [REDACTED BY AGENCY] neck.
After speaking with [WITNESS ], I spoke with [WITNESS ]. [WITNESS ] said she works at night and did receive a call from her daughters asking her to come . [WITNESS ] said when she arrived , her step son told her that [VICTIM ] had gotten her a*s busted. [WITNESS ] said she talked to [REDACTED BY AGENCY] the next day and saw the bruise on her arm and a small cut on her neck. [WITNESS ] said she immediately went to David and told him if her daughters need to be spanked, she would be the one to do it.
I then asked [WITNESS ] to have David come outside so I could speak with him. Once David came outside, I placed him under arrest for Cruelty to Children 1st degree (F) (FVA) and Battery (M) (FVA).
After reading David his Miranda Rights, he agreed to speak with me about the incident. David confirmed him and [REDACTED BY AGENCY] had gotten into a verbal argument over the router cord. David said [VICTIM ] fell to floor and he popped her on the butt. David said he know [REDACTED BY AGENCY] had a problem with cutting, and would usually cut herself on her arms and neck.
After speaking with all parties, I transported David to the Bartow County Detention Center without incident. I then secured warrants for the two charges above against David.
I then ed DFACS and made a referral report.
