Discretion is advised.]On November 19, 2024, at approximately 1525 hours, I, Officer Lukas, was dispatched to 110 North Broad Street, Winder, Ga, 30680 (Norton Commercial Real Estate), in reference to Suspicious Activity. Dispatch informed me that a male was screaming obscenities outside of the office and ran over to the ATM’s. The description of the male was a white male with a dark blue shirt, khaki shorts, and a ball cap. I traveled to the location in my marked patrol vehicle 23, code 1 (NON-EMERGENCY), until I arrived on scene.Upon arrival I observed a male matching the above description at the ATM’s located at 102 North Broad Street (Bank of America). I approached the male and asked him what was going on. He informed me his bank card was not working and he couldn’t get his money. While speaking with the male, I observed a strong odor of an alcoholic beverage emitting from his person along with him stumbling while standing and slurring his speech. I then proceeded to ask him how much alcoholic he had consumed on this date, and he stated two drinks at approximately 0900 hours. I then proceeded to ask his for identification and he informed me that he was going giving me his identification due to him not committing a crime. He then began handing me his receipts for his bank transactions and I continued asking him for his identification.The male then informed me of his credentials in which he was identified as Mr. Kevin Tousel. I was then informed by officers that his vehicle was parked in the roadway on West Stephens Street which was identified as a 2019 Black Jeep Cherokee (Ga Tag #[REDACTED]). I then asked Mr. Tousel if he drove to this location, and he stated that his brother dropped him off and he was across the street at Hardee’s. I then asked him if he would like to conduct Standardized Field Sobriety Testing, and he refused.At this time, I placed handcuffs around his wrists, double locked them, and checked them for proper fit. I then informed him he was under arrest for Public Intoxication. I escorted him to the front of my patrol vehicle and conducted a of his person incident to arrest to check for weapons, contraband, or means of escape and located negative results. He was then placed into the backseat of my patrol vehicle and buckled in for his safety. While in the backseat of my patrol vehicle, I read Mr. Tousel the Implied Consent Notice for Suspects Aged 21 or Over and he refused chemical testing.Officers attempted to gather video surveillance footage of Mr. Tousel operating his motor vehicle before his encounter with officers and had negative results.Officer Flores then asked dispatch to send the Next List Towing Company to our location and we were informed Sim’s Towing was in route. Officer Flores completed a vehicle impound sheet and once Sim’s Towing arrived on scene, Mr. Tousel’s brother, Mr. [REDACTED], arrived on scene and took custody of his vehicle.I then transported Kevin to the Barrow County Detention Center where he was turned over to the jail deputies without further incident.The backseat of my patrol vehicle was ed before and after his transport to check for weapons or contraband and I located negative results.Kevin was arrested and issued a citation for PUBLIC INTOXICATION (CITATION #WC82232) (O.C.G.A 16-11-41) for being under the influence of an alcoholic beverage in public and causing a disturbance, DISORDERLY CONDUCT (CITATION #WC82233) (O.C.G.A 16-11) for cursing and yelling in public while under the influence of an alcoholic beverage causing a disturbance, DISTURBING THE PEACE (CITATION #WC82234) (WINDER CITY ORDINANCE 16-10) for cursing and yelling in public alarming people of the public about his wellbeing and demeanor, CURSING, ABUSING OFFICER MAKING ARREST (CITATION #WC82235) (WINDER CITY ORDINANCE 20-10) for using profanity towards officers while conducting a legal arrest, and PARKING-IMPROPER/ILLEGAL (CITATION #WC82236) (WINDER CITY ORDINANCE 15-150(b)) for parking his vehicle in the middle of the roadway on West Stephens Street.Kevin was not charged with Driving Under the Influence due to me not having enough evidence to prove he was operating a motor vehicle before officers arrived.[End of Narrative].
