Discretion is advised.]On March 11, 2025, at approximately 0645 hours, I, Officer Jacob Harris of the Winder Police Department, was dispatched to a hit-and-run at 17 Monroe Hwy, Winder, GA, 30680. I responded in my marked patrol vehicle 07 CODE 1 (no lights and sirens) to the location.Upon arrival, I met with the caller, [VICTIM ], who was parked behind a white GMC Savana box truck (GA TAG# [REDACTED]). I asked Mr. [VICTIM ] what had happened. Mr. [VICTIM ] stated that the box truck didn’t stop at the stop sign at the first entrance of 17 Monroe Hwy going on to East May St. Mr. [VICTIM ] stated he was traveling Eastbound on East May St, when the box truck failed to yield, pulling out in front of him suddenly. Mr. [VICTIM ] noted that he tried to miss the box truck, but it was too late, and he hit the back bumper with his black Lincoln MKX (GA TAG# [REDACTED]). Mr. [VICTIM ]’s vehicle’s driver-side front fender and headlight sustained a large dent, paint transfer and a broken headlight. Mr. [VICTIM ] stated that the box truck driver, later identified as Elijah Kellogg, kept going west on E May St. and didn’t stop at the accident scene.Mr. [VICTIM ] stated that he turned around and followed the box truck to Waffle House (19 W May St. Winder, GA, 30680). Mr. [VICTIM ] noted that he told Mr. Kellogg that he hit his vehicle and was calling the police. Mr. [VICTIM ] stated that Mr. Kellogg then turned out of the parking lot, heading East on West May St., heading back toward the accident scene. Mr. [VICTIM ] noted that he followed Mr. Kellogg into the parking lot, where he parked the Box truck and jumped out, heading toward the front of the building. I asked Mr. [VICTIM ] what Mr. Kellogg looked like. Mr. [VICTIM ] stated that Mr. Kellogg was a black male with dreadlocks wearing a gray shirt and black pants.I notified dispatch that I had with the vehicle that was involved and advised what the driver looked like. Officer Flores, Officer Gibbs, and Cpl. Cureington ed the area for Mr. Kellogg. I checked the box truck door handle to see if it was unlocked and if the truck was unsecured. When I opened the door, I could smell a strong odor of marijuana.I observed the back of the box truck near the driver-side back bumper. I observed that there was paint transfer and that the bumper was bent. I took photos of the damage of both vehicles, which will be attached to this report.Sgt. Hill advised me to impound the GMC box truck and tow it to the Winder Police Department (25 E Midland Ave Winder GA, 30680) for a warrant. Sgt. Hill notified Dispatch to have a heavy wrecker en route for the box truck. The dispatcher advised that Myles’s Wrecker Service was en route. At approximately 0809 hours, Myles’s wrecker service arrived on the scene and towed the box truck to the Winder Police Department.At approximately 0833 hours, Officer Flores spotted a black male who matched the suspect’s description inside the Winder Furniture business (17 Monroe Hwy Suite U Winder GA, 30680). Officer Flores stated that the male saw him and took back off into the store.Officer Flores and I set up a perimeter around the building until other Winder units arrived.Cpl. Cureington advised me that Officer Flores was replacing me and to come around the front.When I arrived at the front, Sgt. Hill and Cpl. Cureington were standing next to Cpl. Cureington’s marked patrol unit. Sgt. Hill advised me that Cpl. Cureington and I were going into the Bealls Outlet to see if we could access Winder Furniture. Sgt Hill advised that Auburn K9 Sgt. Scott 807 was en route as well.Cpl. Cureington and I went into Bealls Outlet, Cpl. Cureington talked to the Manager of Bealls Outlet, and she took us to the back of the store and opened the door to a hallway. Cpl. Cureington went down the hallway, and I watched the door the manager told us that led to Winder Furniture. Cpl. Cureington said we would watch the door and hallway until Sgt. Scott arrived.A short time later, Sgt. Scott and Barrow County Deputy Catapano arrived on the scene. Cpl. Cureington, Sgt. Scott and Deputy Catapano ed upstairs at the end of the hallway with negative for Mr. Kellogg.We returned out front, and Sgt. Hill advised me to move my vehicle to the front and start commands over the PA speaker in my marked patrol unit.At approximately 0911 hours, I made multiple commands over the PA speaker for Mr. Kellogg to come out of the store. Mr. Kellogg did not comply with the commands that were given.Sgt. Hill and dispatch tried multiple times to someone with a key to the business. Sgt. Hill was able to get in touch with the owner, [WITNESS ], and a manager, [REDACTED]. Mr. [WITNESS ] stated that he looked at the business cameras and identified the subject was Mr. Kellogg. Mr. [WITNESS ] and Ms. [REDACTED] were unable to come to the store.At approximately 1000 hours, an employee identified as [REDACTED] arrived on the scene. Mr. [REDACTED] had the combination to a lock box that was supposed to have a key in it. Mr. [REDACTED] and I went to the door, and Mr. [REDACTED] opened the box, but the key was not there.Det. Schiltz got a warrant for the vehicle and the business. At approximately 1057 hours, Det Schiltz arrived on the scene with a signed warrant for the business. Winder Fire Department took the lock off the door. Cpl. Cureington, Auburn K9 Sgt. Scott and Barrow County Deputies went inside the building ing for Mr. Kellogg.At approximately 1111 hours, Mr. Kellogg was taken into custody.Deputy Mccurry and I walked Mr. Kellogg to my marked patrol unit. I advised Mr. Kellogg that he was under arrest for Hit and Run, Obstruction, and Failure to Yield while turning left. I asked Mr. Kellogg to turn around so I could replace his handcuffs. Mr. Kellogg complied with my commands. I placed Mr. Kellogg’s wrists in a pair of handcuffs, double-locked them, and checked them for proper fit. Deputy Mccurry ed Mr. Kellogg incident to arrest for weapons, contraband, and any means of escape. Mr. Kellogg didn’t have any contraband on his person. I checked my back seat for contraband before placing Mr. Kellogg inside and properly securing him with a seatbelt.I read Mr. Kellogg his Miranda warning. Mr. Kellogg stated that he understood his rights and would answer questions. I asked Mr. Kellogg if he was driving the box truck. Mr. Kellogg said that he was but didn’t hit anyone. I asked Mr. Kellogg why he didn’t come out of the business when I was giving him commands. Mr. Kellogg stated that he didn’t hear us.I left the scene en route to the Barrow County Detention Center. I released Mr. Kellogg and his belongings to the staff without incident. After transport, I checked the rear of my patrol vehicle for contraband, but no contraband was found.Upon my investigation, I established probable cause that Mr. Kellogg committed the offenses of Hit and Run due to not stopping or returning to the accident scene. Obstruction Misdemeanor due to Mr. Kellogg locking himself in Winder Furniture and not complying with lawful commands to come out. Driving while license suspended due to Mr. Kellogg’s driving license having been suspended on January 11, 2025. Failure to Yield while turning left due to Mr. Kellogg turning left in front of Mr. [VICTIM ] and causing an accident. Expired tag due to the tag being expired since February 1, 2024. Felony possession of Marijuana while the warrant was being executed. Cpl. Cureington ed the immediate area where Mr. Kellogg was located in the small room. Cpl. Cureington located a large container of a green leafy substance known as Marijuana. Cpl. Cureington advised that the green leafy substance known as Marijuana weighs out to be 47.42 grams.Six warrants were procured for Mr. Kellogg.
