Officer’s Narrative:

On the above date and time I was dispatched to the above location in reference to a black male assaulting the complainant, 81 yr old [VICTIM ], and the suspect was walking with a female from this residence down the road.
Upon arrival at the residence (a small Air Stream style camper) I met with [VICTIM ] and he stated that someone was banging on the door and when he opened it, the black male punched him in the forehead/left eyebrow area as well as the left ear knocking him to the floor then started kicking him. He further stated that he did manage to hit the black male across the head with a fry pan before he dragged [VICTIM ] out of the house by her hair and dragged her away. I did observe physical injuries to [VICTIM ]’s head, left ear, right arm, and right hand. I asked if he needed medical attention and he first stated no, but then a little while later he wanted EMS to check him out so I called dispatch to send an ambulance. I asked if he knew the black male and he stated that it’s [VICTIM ]’s ex-boyfriend, Antonio. As I was speaking with him a white in color 2015 Hyundai Sonata, TN tag # [REDACTED] pulled up. I shined my flashlight on the driver and [VICTIM ] yelled, “that’s him”.
I then went to the driver and asked for ID and he presented me a drivers license. [VICTIM ] walked closer to the driver where I was and stated it wasn’t him. The driver was identified as [WITNESS ] from Knoxville, TN. I asked [WITNESS ] if he knew Antonio and he stated it was his cousin. I asked what Antonio’s last name was and he stated Foster. [WITNESS ] stated he dropped Antonio off at the end of the driveway because he wanted to visit his ole lady and tried to call Antonio, but had no cell phone service. I told [WITNESS ] that Antonio punched [VICTIM ] then grabbed [VICTIM ] forcing her to leave with him. He stated he had no knowledge of Antonio doing this. I asked him to standby while I tried to figure this all out and he complied. I then called backup and Deputy Reynolds arrived. I also ed Cpl Fielding and advised him that we may have a kidnapping and he directed me to have dispatch the on call investigator.
I ed dispatch to have them the on call investigator and while waiting on his return call, [WITNESS ] asked if he could step out of the vehicle and I advised him that he could. He asked if he could video this and I advised him that we didn’t mind and further advised him that I was waiting on an investigator to call me back. [WITNESS ] asked me if he was under arrest and I advised him that he wasn’t under arrest, but was being detained until I could figure all this out and he stated okay. Investigator Daniel Sanford then called me and as I was speaking with him, the female come walking with no shoes on. I then advised Investigator Sanford that the female just returned so we may not have a kidnapping and he stated to let him know if he was needed and we disconnected.
I went to where the female was and she was identified as 23 yr old [VICTIM ] and she is also eight months pregnant. I told her that [VICTIM ] advised she was dragged out of the camper by her hair after Antonio attacked him. At first she stated that she pushed Antonio off [VICTIM ] and told him he needed to leave and Antonio told her he needed to talk to her so she walked down the road with him. I asked if Antonio and her hid when I come by because we were watching for a male and female walking and I didn’t see her. She stated her feet was hurting from the gravel so she stepped into the grass. [VICTIM ] also has a four year old child that was present during this incident that was in the bedroom where [VICTIM ] was when she heard the altercation between Antonio and [VICTIM ]. [VICTIM ] further advised that she moved in with [VICTIM ] and changed her phone number to hide from Antonio because of a domestic situation that happened between them in Knox County Tennessee.
Deputy Clark had also arrived on scene and because of the domestic that supposedly happened between them in Tennessee, he ed DFACS. [REDACTED] from DFACS arrived on scene to investigate the safety of the four year old child. [VICTIM ] and [VICTIM ] was sitting on the camper step and [VICTIM ] told her she needed to tell us the truth of what happened because she didn’t willingly walk with him. I then re-activated my BWC (body worn camera), and asked her if Antonio grabbed her by the hair and forced her from the camper like [VICTIM ] said. She then stated he didn’t grab her by the hair, but did grab her by the right arm telling her that they need to talk and forcefully removed her out of the camper keeping hold of her arm all the way down the driveway to Burton Rd. I asked if Antonio was hiding her from us seeing them because two patrol cars come up this same road and didn’t see either of them and she stated her feet hurt so they were just standing in a grass area. I then asked why Antonio let her go if she was held against her will and she stated that she kept on telling him, “please, please, let me go back to by baby”, pleading with him to release her and that’s when she walked back to the scene barefoot.
In addition, from the time this call come in at 0129 hours until she walked back up to the scene at 0213, Antonio did steal her away from this residence and held her against her will for nearly 45 minutes before letting her go and fleeing the area. I asked [VICTIM ] what Antonio’s last name was and she stated Foster. I asked for his date of birth and she stated either [REDACTED] or [REDACTED]. Upon having dispatch run these dates, there was no match found. I then pulled up a picture off of Facebook and asked [VICTIM ] if it was him and she stated it was. I also advised dispatch to broaden their with these dates in TN as well as Colorado because [VICTIM ] stated something about him getting into trouble in Colorado. Dispatch later advised that they found his Facebook page and looked into his mother’s Facebook account and noticed she had Antonio’s birthdate as [REDACTED] and located his drivers licenses in both TN and CO with photo’s, the one from Colorado had a military photo from where he was in the Army. BWC was re-activated several times for statements. Photos of [VICTIM ] and Antonio Foster is in file. [VICTIM ] had no visible injuries.
[REDACTED] from DEFACS also advised [VICTIM ] that she needed to go somewhere else for the safety of her and her four year old child. After determining a location to go, Deputy Reynolds followed her to the county line to make sure no one followed her.
A brief summary of the charges listed:
(Burglary) – Antonio Foster did enter this residence forcefully and without authority with the intent of committing a felony (Exploitation of Elder Person) as well as (Battery) by punching and kicking 81 yr old [VICTIM ] and also (Kidnapped) [VICTIM ] by stealing her from said residence without legal authority and against her will, and (False Imprisonment) detained [VICTIM ] without legal authority for nearly 45 minutes as she plead with him to let her go back to her baby. (Simple Assault FVA) Antonio Foster grabbed [VICTIM ] by the arm placing her in reasonable fear of receiving violent injury during the kidnapping and false imprisonment. [VICTIM ] is also eight months pregnant with Antonio’s baby and did reside together in TN. (Cruelty to Children 3rd Degree)- [VICTIM ]’s four year old daughter was also present in this same dwelling place during this entire incident.
