On September 13, 2024, I conducted a traffic stop on a Chevrolet Malibu bearing Georgia license plate [REDACTED] for the driver’s side brake light not functioning. Upon activating my emergency equipment, the driver, Timothy Thomas Cole, pulled the vehicle into the Chevron located at 1847 Marietta Highway Canton, GA. After the vehicle came to a stop, I exited my vehicle and made contact with Timothy.
Upon making contact with Timothy, I explained why he was stopped and asked for his driver’s license, which he provided. I asked him if he was on probation or parole and he stated yes. Timothy informed me, he was on probation for a schedule II controlled substance. I went on to ask if there was anything illegal inside the vehicle and Timothy stated no. I asked Timothy for consent to search the vehicle and he granted it. At this point, I had Timothy exit his vehicle.
Upon Timothy exiting his vehicle, I had him step back to the front of my patrol vehicle, at which point we waited for another unit to arrive so, I could conduct a search of the vehicle. Upon a Canton Police Department Officer, May arriving, I asked him to standby with Timothy while I searched the vehicle. I also asked Officer May to search Timothy’s person, which Timothy gave consent to do and nothing illegal was located.
During the search of the vehicle, I located a black plastic container inside the bookbag on the passenger seat. Inside the container was a corner cut bag containing suspected methamphetamine. (The substance inside the corner cut bag was field tested and it confirmed the presence of methamphetamine) I also located a glass methamphetamine pipe with residue wrapped up in a purple bandanna. The pipe was also located inside the bookbag. Nothing else illegal was located inside the vehicle. It should be noted inside the bag with the methamphetamine and pipe were two sets up red num-chuks. The reason this is important is, I asked Timothy about them and he stated they were his, which shows ownership of the bookbag the methamphetamine and glass pipe were located inside. It should also be noted inside the center console of the vehicle was a box of ammunition. I did ask Timothy about the ammunition and he stated his girlfriend has firearms, however there were none inside the vehicle as she keeps them at home.
At this point, Timothy was placed under arrest for possession of methamphetamine. Corporal Blackerby had arrived on scene and transported Timothy to the Cherokee County Adult Detention Center. Before Timothy was transported, he was able to make arrangements for his girlfriend, [REDACTED] to come pick up the vehicle.
I stood by until [REDACTED] arrived. Upon her arriving the vehicle, Timothy’s wallet and phone were turned over to her at his request. I returned to service.
