On Saturday, July 20th, 2024
, at 1936 hours, I was dispatched to [10 BLOCK] Wren Court, Apartment [REDACTED], in Cartersville, Georgia, in reference to a domestic in progress.
Upon arrival, I heard a female and a male arguing with each other. I knocked on the door and observed Gilbert Herrera, who I knew to be wanted for Burglary on previous case at the above residence (Case report 2024
-00019639). Gilbert came outside and was detained for his warrant where I then spoke with [VICTIM ].
[VICTIM ] said that Gilbert had come to her residence and knocked on the door. she said once she opened the door, Gilbert entered the residence and pushed her. She then said that Gilbert slapped her across the left side of her face and began choking her. She said that the incident occurred just before my arrival. While speaking with [VICTIM ], I observed redness on her neck and redness on the left side of her face, which appeared to be fresh and was consistent with her testimony of Gilbert being physical with her. [VICTIM ] also said that she was unable to breathe. I also observed signs of petechiae in both of [VICTIM ]’s eyes. Photos of [VICTIM ]’s injuries were taken on the body worn camera of 916.
I ed Officer Dario Alfonso with The Cartersville Police Department to speak with Gilbert since he did not speak much english. Officer Alfonso read Gilbert Miranda rights and began speaking with him. Officer Alfonso told me that Gilbert had said there was no altercation between he and [VICTIM ], and also said that they never argued, which was inconsistent with [VICTIM ]’s marks and me hearing both [VICTIM ] and Gilbert arguing upon my arrival.
It was discovered while on scene that Gilbert and [VICTIM ] have previously lived together for several months.
Due to the physical injury on [VICTIM ], and her testimony saying that Gilbert assaulted her, the following warrants were taken:
(1) Aggravated Assault- Strangulation FVA
(1) Battery- FVA
Gilbert’s burglary warrant was also confirmed by dispatch.
Gilbert was transported to The Bartow County Detention Center without incident.
